use and a second pier to provide water access for two additional lots.

9. PROTECT DESCRIPTION
The applicant owns approximately 8 acres of land adjacent to Masonboro Sound at the end of
Bozeman Road, off Carolina Beach Road (US Hwy 421), in New Hanover County. The
property is located between Old Chimney Subdivision to the north, and Carolina Inlet Marina
to the south.
The property is wooded and averages 14 feet elevation above mean sea level, gently sloping to
about 4 feet elevation at the water's edge. Longleaf and Loblolly Pine, Live Oak, and Hickory
are the predominant species. On the property's eastern shoreline, there is a border of wetlands,
approximately 60-130 feet wide. The waterward marsh border is predominantly Smooth
Cordgrass (Sn rtina alterniflora), 30-50 feet wide. Other high coastal marsh plants intermix
into the vegetation at the transition to highground. Species observed include: Black Needle
Rush (Tun us, ro .m ri n us), Saw-grass (Caldium jamaicense), Spike Grass (Dis ichlis mica a),
Sea Oxeye (Borrichiafrutescens), Salt Meadow Grass (Spartina patens), and shrubs, Marsh-
elder (Iva frut s .ens), and Grounsel-bush (Baccharus halimifolia). A "404 type" wetland
border, delineated by the U.S. Army Corps of Engineers, makes up the landward side of the
wetlands along this shoreline. The applicant has subdivided the eight (8) acre tract into three
(3) lots (Lots 2,3,4). The two waterfront lots (Lots 3 & 4) are approximately 1450 feet long
and 95 feet wide. There is a 30 ft. easement along the center property line to allow for
driveway access and water access for the third lot (Lot 2), which is located landward of Lots 3
and 4. Lot 2 is approximately 480 feet deep and 165 feet wide and occupies the western
portion of the property. At this time, there are no final plans for the applicant's residential
construction and development of Lots 2 and 3 will be the responsibility of future lot owners.
The AIWW is approximately 940 feet wide in the project area. It is classified as SA by the NC
Division of Water Quality, and is OPEN to the harvest of shellfish. The area is a designated
primary nursery area (PNA) by the NC Division of Marine Fisheries. The New Hanover
County Land Use Plan classifies the wetland and water area as Conservation, and the high
ground as Resource Protection.
The applicant is proposing to construct his private residence and pier on Lot 4 and obtain
authorization to construct a second pier to provide water access for Lots 2 and 3. The
applicant's private pier would extend from the center of Lot 4 and would be approximately 200
feet long and 6 feet wide. The common pier for Lots 2 and 3 would extend from the 30
easement at an northern angle until centered in front of Lot 3. It would be approximately 155
feet long and 6 feet wide. Both piers would be elevated over vegetated wetlands and only the
last 80-90 feet of each pier would be waterward of mean high water (MHW). The applicant is
proposing the same docking facilities at the terminus of each pier. These consist of a 16' x 16'
gazebo at the waterward end of the pier. Perpendicular to the pier, a fixed dock would extend
25' X 8' north, and 19' X 8' south of the gazebo. The fixed docks would access two 14' X 14'
boadifts. Two finger piers, 30' X 4' and 24' X 4', would access the landward sides of the
boatlifts.

10. ANTICIPATED IMPACTS
The project as proposed will provide water and boating access to the applicant and two
future property owners of the Koballa tact. The project would shade approximately 5400
square feet of vegetated wetlands. It will incorporate approximately 3496 square feet of open
water and Public Trust Area. There will be future ground disturbance and creation of
impervious surface associated with the construction of three single-family residences.

elder (Iva fnrtescens), and Grounsel-bush (Baccharus halimifolia). A "404 type" wetland
border, delineated by the U.S. Army Corps of Engineers, makes up the landward side of the
wetlands along this shoreline. The applicant has subdivided the eight (8) acre tract into three
(3) lots (Lots 2,3,4). The two waterfront lots (Lots 3 & 4) are approximately 1450 feet long
and 95 feet wide. There is a 30 ft. easement along the center property line to allow for
driveway access and water access for the third lot (Lot 2), which is located landward of Lots 3
and 4. Lot 2 is approximately 480 feet deep and 165 feet wide and occupies the western
portion of the property. At this time, there are no final plans for the applicant's residential
construction and development of Lots 2 and 3 will be the responsibility of future lot owners.
The AIWW is approximately 940 feet wide in the project area. It is classified as SA by the NC
Division of Water Quality, and is OPEN to the harvest of shellfish. The area is a designated
primary nursery area (PNA) by the NC Division of Marine Fisheries. The New Hanover
County Land Use Plan classifies the wetland and water area as Conservation, and the high
ground as Resource Protection.
The applicant is proposing to construct his private residence and pier on Lot 4 and obtain
authorization to construct a second pier to provide water access for Lots 2 and 3. The
applicant's private pier would extend from the center of Lot 4 and would be approximately 200
feet long and 6 feet wide. The common pier for Lots 2 and 3 would extend from the 30
easement at an northern angle until centered in front of Lot 3. It would be approximately 155
feet long and 6 feet wide. Both piers would be elevated over vegetated wetlands and only the
last 80-90 feet of each pier would be waterward of mean high water (MHW). The applicant is
proposing the same docking facilities at the terminus of each pier. These consist of a 16' x 16'
gazebo at the waterward end of the pier. Perpendicular to the pier, a fixed dock would extend
25' X 8' north, and 19' X 8' south of the gazebo. The fixed docks would access two 14' X 14'
boatlifts. Two finger piers, 30' X 4' and 24' X 4', would access the landward sides of the
boatlifts.

The project as proposed will provide water and boating access to the applicant and two
future property owners of the Koballa tact. The project would shade approximately 5400
square feet of vegetated wetlands. It will incorporate approximately 3496 square feet of open
water and Public Trust Area. There will be future ground disturbance and creation of
impervious surface associated with the construction of three single-family residences.

permit and/or a CAMA major permit to apply for and receive a Stormwater Management Permit by the Division of

of 15A NCAC 2H.1000 and may result in appropriate enforcement action by this Office.

After visiting the referenced site, it was found that the northeast property comer of Lot # 2 of the Patrick and
Cheryl Koballa Lots is located approximately 1/4 to 1/2 mile south of Channel Marker 153 on the Intracoastal
Waterway. This Channel Marker represents the southern boundary of the Outstanding Resource Waters in this
area, indicating that the Koballa property does not abut Outstanding Resource Waters. The property is
considered to be located on SA waters.
