Bratton submitted comments, 7-7-2020 with Cover Letter.pdf -----Original Message ----- From: Gil Johnson [mailto:rgiljohnson@gmail.com] Sent: Thursday, July 16, 2020 2:01 PM To: Sams, Dan <dan.sams@ncdenr.gov> Subject: [External] Permit 92-10 Amendment to Comments Submitted by Sam Bratton dated 7-7-20 CAUTION: External email. Do not click links or open attachments unless you verify. Send all suspicious email as an attachment to report.spam@nc.gov<mailto:report.spam@nc.gov> I've reviewed the comments submitted by Sam Bratton on 7-7-20, related to Mining Permit 92-10 Modification Application. The last 13 pages of Mr. Bratton's submittal included the original permit document, with their comments written in the margins, but failed to include the cover letter. As a supplement to Mr. Bratton's submittal, please allow me to include the cover letter that accompanied their permit. Note that Director Stephen Conrad was very specific about Wake Stone carefully reviewing the document and notifying his office of any objection or question concerning the permit terms. The last page of the signed permit, including the "sooner" language in the Sunset Provision was underlined, but no comment or objection appears to have been included, inferring Wake Stone's acceptance of the terms of this clause. This clause remained unchanged through eight subsequent permit modifications. I understand Wake Stone attempted to modify the Sunset Clause in 2011 using the same argument, but former DEQ staff member Jim Simon knew this was not a typo and rightfully declined their request. Please include my message and the attached cover letter with Wake Stone's copy of the approved permit, in the public comments related to this matter. Thank you for your consideration.
