PO Box 449 Franklin, North Carolina 28744 RE: Permit No.45-02- Fletcher Mine Henderson County-French Broad River Basin Dear Mr. Mason: This letter is in response to your email sent on August 6, 2020 requesting the approval of a temporary crossing on Higgins Branch and a temporary access through buffer area as indicated on the map dated August 5, 2020 for the 1-26 construction project referred to in the approval letter dated October 24, 2019. The approval letter references the stockpiling of clean uncontaminated undercut material from NCDOT Project Nos. C204264 and C204266. This request is hereby approved and is contingent upon the following: Reestablishment of the buffer and removal of the temporary crossing over Higgins Branch at the end of the project. Please attach this approval letter your existing mining Permit for future reference. The expiration date, mine name and permit number on the permit document shall remain the same as before this modification. The issuance of a mining permit and/or any modification to it does not supersede local zoning regulations. The responsibility of compliance with any applicable zoning regulations lies with you. As a reminder,your permitted acreage atthis site is 121.57 acres and the amount of land you are approved to disturb is 77.80 acres. In addition to the Higgins Branch crossing Harrison construction proposes creating a temporary access the Interstate 26 construction project which will effect approximately 30+or—feet of the 15' buffer on the south west side of the quarry property as depicted in the attached revised drawing. After completion of the Interstate 26 construction project the effected buffer will be re-established. The original crossing was a pipe in Higgins Branch that was removed in approximately 2010 when the fill/waste area was considered complete and assumed the crossing was no longer needed. All roads and erosion control measures have remained in place, no new roads are required (see attached map). This crossing will create direct access from 1-26 for stockpiling of clean uncontaminated undercut material from NCDOT Project Nos.C204265 and C204266 as stated in the October 14, 2019 letter from Director S. Danial Smith (see attached letter).This crossing makes the transport of material more efficient and most importantly safer as it eliminates round trip truck traffic on public roads through residential neighborhoods along Fanning Bridge road. The Army Corp of Engineers has determined that with the temporary"Bridging Span" type crossing a 404 permit would not be required.
