Each of the comments are repeated below followed by our response (in red). 1. During a recent inspection it was noted that some of the Erosion and Sediment Control (E&SC) measures needed additional maintenance. Please provide proof that E&SC measures have been properly maintain as noted on the enclosed inspection report Response: See attached letter from Sean Madden with FSC Il, LLC. 2. During a recent inspection it was noted that the mine map provided with the transfer application did not match current site conditions, nor the onsite mine manager's map. Please provide an updated map that clearly reflects current site conditions. The map should include all the required items outlined in the Mine Permit Application (see requirements on pg. 3 of the mine permit application). Response: An updated mine map is attached. 3. Please provide the location of the operation on pg. 1 of the application in decimal degrees, rather than degrees, minutes, and seconds. Response:The latitude and longitude the operation is 35.5819 and -79.3225, respectively. A revised page 1 of the application is attached. 4. Please complete the affected acreage table,which should match acreages on the map, and provide an expected life of the operation (in years), so that the reclamation bond can be properly determined.). In response to the request, FSC received correspondence from you requesting additional or revised information for the Mine such that the request for transfer could be reviewed. FSC secured an extension through July 19,2022 to respond to the letter requesting additional information. Pursuant to the letter, you requested additional or revised information regarding the following: 1. During a recent inspection it was noted that some of the Erosion and Sediment Control (E&SC) measures needed additional maintenance. Please provide proof that E&SC measures have been properly maintained as noted on the enclosed inspection report. 2. During a recent inspection it was noted that the mine map provided with the transfer application did not match current site conditions, nor the onsite mine manager's map. Please provide an updated map that clearly reflects the current conditions. That map should include all the required items outlined in the Mine Permit Application (see requirements on pg.3 of the mine permit application). 3. Please provide the location of the operation on pg. 1 of the application in decimal degrees, rather than degrees, minutes, and seconds. 4. Please complete the affected acreage table, which should match acreages on the map, and provide an estimate life of the mine operation (in years), so that the reclamation bond can be properly determined. Page 2 FSC retained WithersRavenel to create updated maps reflecting the current site conditions. The maps are being submitted by WithersRavenel to your attention both via email and hard copy. Along with the updated maps,the information contained in requests numbers 3 and 4 are also being provided. Finally, FSC has addressed the E&SC maintenance issues. Specifically, FSC has performed maintenance on basin 4, basin 2, and basin SB 6, repaired the silt fence below basin 4, and provided baffles to basin 2. If any additional proof is required,please let me know. FSC is respectfully represents that it has addressed each of the items listed in your letter and requests that the permit transfer be approved.
