To: Whom it may concern:
We are in receipt of Robert Chiles Engineering's letter dated April 6, 2022, with notice of the
Dunn Mine Owner's intent to expand the mine.
As you are aware, our company owns real estate which is contiguous with the mine owner's
property mentioned above. We have several concerns which are not to be taken lightly, as we
fully intend to protect our property. We also expect these concerns to be resolved before
issuance of any permit or permit modification. Further, we expect the concerns to be set out to
our satisfaction in any such permit or permit modification.
Concerns are as follows:
1. Noise: Noise from machinery will be increasingly louder, should the mine be permitted
to expand. The permit application requests for the mine to be expanded in the direction
of our property, which the mine property shares a several thousand foot long common
line with. We request that an earthen berm, sufficient to control noise, be built and
vegetated at the onset of any permit issuance.
2. Hours of Operation: Hours of operation to be "normal business hours", only, in order to
limit noise, dust, etc.
3. De-watering: The permit application states that NO de-watering will take place.
However, we understand from the landowner that one of the main purposes of the
permit application is to be granted de-watering rights. If this is granted, then our
property stands to be at large risk of vegetation being diminished and/or eradicated,
due to a much lowered water table (if pit is built near our property line). We have many
very large mature trees that greatly depend on this water, especially since we have a
very sandy, non-organic soil, as the mine next door has. Without these trees, our
property will have greatly dimished property value.
4. Diminished Property Value: As a result of all three items listed above, our property will
have greatly diminished property value since we are on land that was until recently, a
full sized golf course. We maintain several leases (residential, commercial, hunting) on
the property and we intend to maintain our tenants' rights to use this property with its
quiet enjoyment.
We are not opposed to the granting of a permit to expand this mine, however, the above
concerns need to be satisfied within any permit.
