In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and §74-51 of the Mining Act of 1971, please provide the additional or revised information in accordance with the following comments: Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining landowners and chief administrative officer of each county and municipality have been properly notified. Please provide proof for Clifford W Ranzau & Brenda Ranzau; Mary B D Grooms Estate C/O Dorothy Amartey 2. Please clearly label and indicate on the mine map the mine permit boundary. Please clarify the name of the applicant. The application lists DCI Investments, LLC as the applicant and the mine maps show Diamond Constructors Inc. of Fayetteville as the applicant. Please make sure that the name on the application matches the name on the maps. 4. Please label a north arrow on sheets CS-01 and CS-03 5. Please clearly label and indicate on the mine map all structures within 300' of the mine excavation. Aerial imagery shows a house on the west side of the permit boundary and a water tower/ pumping station on the south side. 6. Please clearly label and indicate on the map the wetlands that were identified in your response to question C.5b of the mine permit application. 7. Please clarify how mining will occur below the water table without dewatering the excavation. Your response in an email dated August 30, 2022, indicated that the water table is 20-25 feet below the ground surface and the excavation will only reach a maximum depth of 20 feet and therefore will not encounter groundwater. However, 2021 aerial imagery on the Robeson County GIS website show an initial excavation on the property that is filled with water. Please clarify your reclamation plan. Your response in the application and shown in cross sections on the mine map indicate that the site will be reclaimed as a lake, however the plan view of the reclamation map shows the site being reseeded and vegetated. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time, you must submit information, in writing, to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response, we encourage you to provide the additional information requested by this letter as soon as possible.
