Having heard all the evidence and argument presented at the hearing, the Robeson County Board of Commissioners finds that the application is complete, that the application complies with all of the applicable requirements of the Robeson County Subdivision Ordinance and/or the Robeson County Zoning Ordinance for the development proposed indicated is hereby approved, subject to all applicable provisions of the Robeson County Subdivision Ordinance, and/or the Robeson County Zoning Ordinance, and the following conditions: Gradient, PLLC SUP Page 1 Book 2362 Page 626 (1) The applicant shall complete the development strictly in accordance with the plans submitted to and approved by the Robeson County Board of Commissioners, of Robeson County, North Carolina: (2) In issuing the Special Use Permit, the Robeson County Board of Commissioners has placed the following additional conditions or requirements upon the owner, successors and assigns in exercising the rights granted herein: a. A buffer around the property as per site plan submitted; b. Hours of Operation are to be Monday -Saturday 7:00 a.m. — 9:00 p.m.; c. Hours of operation and 9-1-1 address are to be posted on the premises at the end of the road; d. A permanent gate with locks and warning signs are to be continually maintained; e. Applicant is to comply with the requirements set forth by North Carolina Department of Environmental Quality (DEQ); f. The mining pit shall not exceed 15.50+/- acres; g. The mining operation shall not violate the Robeson County Junkyard Ordinance; h. * An access easement off Hallmark will be given to Robeson County to access water tower; i. The businesses are subject to an annual $50.00 inspection to ensure compliance with all conditions set forth in this permit; and j. Page 2 Book 2362 Page 627 (3) This permit shall automatically expire within one (1) year after the aforelisted meeting date if the use authorized herein has not been commenced when no substantial construction, erection, alteration, excavation, demolition or similar work is necessary before commencement of such use or less than ten (10) percent of the total cost of all construction, erection, alteration, excavation, demolition or similar work on any development herein has been completed on the site. (4) It is understood by the owner, his assigns and/or successors in interest, that any violation of the Robeson County Zoning Ordinance, including but not limited to the conditions set forth in Paragraph (2) above, may result in the institution of appropriate action or proceeding to prevent the unlawful violation of this permit. (5) If any of the conditions affixed hereto or any part thereof shall be held invalid or void, then this permit shall be void and of no effect. (6) That the terms of this permit shall supersede and take the place of any and all permits issued on this property. (7) Review and Revocation of Permit — If the Community Development Administrator or other interested party determines that a violation of the Special Use Permit may have occurred, the Robeson County Board of Commissioners may conduct a public hearing to determine whether or not the terms of the permit have been or are being violated. Upon such finding, the Robeson County Board of Commissioners may revoke or modify said permit. (8) Abandonment & Obsolescence — If the use permitted under this Permit is not utilized for at least 12 months the Community Development Administrator is to be notified. Upon request by the Community Development Administrator, the use shall be completely removed within 90 days and the site restored to its pre-existing condition. If the lessee of the property is unreachable, the removal of the use shall be the responsibility of the landowner. If this permit authorizes development on a tract of land larger than one acre, nothing authorized by the permit may be done until the property owner properly executes and returns to the County the attached acknowledgment of the issuance of this permit so that the County may have it recorded in the Robeson County Register of Deeds. Should the Department determine that a significant public interest exists relative to G.S. 74-51, a public hearing will be held within 60 days of the end of the 30-day comment period specified above.
