Subject: Modification Thomas Borrow Pit, Permit # 16-83, ADI response
Dear Mr. Parr;
On behalf of Ralph Thomas, I am writing in response to your December 22, 2021 letter
requesting additional information on the above -referenced mining permit modification
application. I will respond to each item in the order of your letter for clarity.
1. Please see attached letter from Mr. Gregory Hartman, CFM, Carteret County Floodplain
Administrator
2. Please see attached copies of Certified Mail Receipts for adjoining neighbor notifications,
including Willie Baucom.
3. The NPDES General Stormwater permit NCG020993 was issued 12/14/2021
4. The entire site is within the Floodplain. A note has been added to the Mine Map.
5. We have reviewed the December 8 inspection report (Dated December 14, 2021). The
report indicates that the site was in complete compliance. The only recommendation was, "Be
sure to maintain erosion and sediment control measures until pit excavation begins to prevent
sediment leaving site'. There is no comment in the report regarding any "additional sediment
and erosion control measures" needed anywhere onsite. We know of nothing needed to
maintain compliance other than to continue to "maintain" existing measures.
6. The Site Plan shows silt fence extending around the perimeter of all disturbed areas.
There is no "initial clearing" at this site, as it is already a cleared, open field.
7. The mining area will occasionally discharge via an existing ditch into an existing 2.7-acre
pond onsite. The pond is a previously mined area which has an existing overflow into adjacent
wetlands. With 4+ feet of freeboard, the pond will hold more than 880,000 gallons before
overflowing. The sandy soil within the pond allows for rapid absorption before the pond
overflows. Any overflow from the pond discharges into over 100 acres of Freshwater Forested /
Shrub habitat wetland, specifically a Palustrine System, which is defined as nontidal wetlands
dominated by trees, shrubs, persistent emergents, emergent mosses or lichens. The wetland
area is more than adequate to receive all overflow discharges from the pond. It is impossible to
state that the mining area discharges into North River. Further, since the wetlands that
eventually receive the overflow are freshwater and non -tidal, they cannot, by definition, be
classified as SA/HQW.

I have reviewed the most recent mine plan for the Thomas Borrow Pit, located at 3101 US Highway 70,
Beaufort, NC 28516 on Parcel# 731803114048000. 1 acknowledge that it is located within the special flood
hazard area as delineated on the Federal Emergency Agency's Flood Insurance Rate Map Panel 7308J
with an effective date of 7116/2003. After reviewing the proposed mine plan, I approve of the expansion to
the existing Thomas Borrow Pit sand mine at this location.
