In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and §74-51 of the Mining Act of 1971, please provide the additional or revised information in accordance with the following comments: 1. Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining landowners and chief administrative officer of each county and municipality have been properly notified. Certified mail receipts for JTG Holdings, LLC were not included in the April 20, 2022, response. The Certified mail # on the receipt of Darryl Keith Lilly is not clearly visible. Please rescan the receipts so that all certified mail number are clearly visible or provide the signed returned cards. 2. The reclamation plan provided shows both Phase 1 and Phase 2 as part of the excavation, however it was mentioned in the application that phase 2 will not occur until a modification is submitted to the Department. Please provide a reclamation plan for Phase 1 only. The undisturbed buffer is shown outside of the mine permit boundary. Areas designated as buffers to mining activity need to be shown within the mine permit boundary. Please clearly label and show on the mine maps buffers internal to the mine permit boundary. 4. Please clarify how the overburden storage areas will be accessed. There are no roads shown to overburden storage nearest S132. Please clarify how the eastern overburden storage area will be access once the existing roads are mined through. 5. Please clarify how SB2 will be accessed. There are no roads shown to this sediment basin. 6. The map cover sheet shows "New London Quarry". Please clarify if the intent is to rename this site from Parker Mine as indicated in the application to "New London Quarry." If so, please provide a new pg. 1 of the mine permit application with the new name. If the intent is to keep the Parker Mine name, please clearly indicate this on the mine maps. Overburden piles are shown with an internal 1:1 slope. Please provide information on additional measures for slope stability and additional safety measures for slope maintenance and repair, or you may instead propose slopes with a less steep angle, for example minimum 2:1. Please clearly identify and label on the mine map the existing site conditions showing the previously mined area and limits. 9. The Erosion and Sediment Control Measures (E&SC) at each basin have been proposed using old standards. Please show provide details showing up to date standards. 10. The drainage area for the overburden storage area was not included in calculations of the drainage areas. Please provide proof that all drainage areas are included, and E&SC measures have been sized appropriately. 11. There are some diversion channels that appear to rise in elevation. There is concern that these channels will not function properly under gravity. Please clarify the path for each diversion channel so that they will allow for positive drainage to the basins. 12. Drainage areas for basins are difficult to review with the current page match line configuration. Please clearly identify each drainage area and provide maps each entire drainage area. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time, you must submit information, in writing, to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period.
