Singleton & Sons, Inc, Washington, NC, to allow excavated removal of a 19.25-acre sand stockpile with established groundcover on property owned by Rich Family Farms, Inc., Washington, NC, off US 264, Belhaven, NC, in Hyde County. The proposed permit area is in a flat, sandy, tree farm area, and will not present any problems regarding runoff to adjacent areas when all proposed erosion and sediment control measures are in place. The purpose of the excavation will be to return the land to agricultural and wildlife habitat status. The proposed Rich Farms Mine excavation will be in an existing 24.52-acre spoil sand stockpile area originated from dredging of the adjacent Intracoastal Waterway by the US Army Corps of Engineers in approximately 1998. The proposed 19.25-acre excavation area currently consists of six to eight feet of sand above natural ground level, surrounded by existing 12 to 15-ft tall continuous vegetated sand berms. The operator proposes to excavate the remaining sand from the spoil area inside the berms down to natural ground level, leaving the existing berms in place after reclamation. There will be no excavation outside of the berm aeeas or in the NC Coastal Area Management Area of Environmental Concern between the active mine area and the adjacent Intracoastal Waterway. The excavation area will be located geographically 1600 feet from the nearest public highway and will be accessible only by a privately -owned access road. Excavation activities will be screened from public view on all sides by existing vegetated sand berms and full -growth pine tree farm. Public access to the permit area is limited by private property, and gated private road access. There will be minimum 25-ft wide unexcavated buffers on all sides of the permit area. Upon receipt of the approved permits from NCDEQ, Mr. Hanna plans to excavate the sand stockpile back to natural ground level for farm cultivation to proceed afterward. Reclamation of the permit area will include grading, leveling, and establishment of groundcover on all affected areas. The permit is requested for a 10-year period. All adjacent landowners have been contacted and made aware of the proposed excavation operation, and land entry agreements have been obtained. Mine maps must be accurate and appropriately scaled drawings, aerial photographs, or enlarged topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the maps along with their corresponding (approximate) acreage. Thus, all mine and reclamation maps must denote those activities that are Intended to be conducted during the life of the mining permit. PROTECTION OF NATURAL RESOURCES 1. Describe in detail the sequence of events for the development and operation of the mine and reference the sequence to the mine map(s). Attach additional sheets as needed. See addendum-1, attached. 2. Describe specific erosion control measures to be installed prior to land disturbing activities and during mining to prevent offsite sedimentation (include specific plans for sediment and erosion control for mine excavation(s), waste piles, access/mine roads, and process areas), and give a detailed sequence of installation and schedule for maintenance of the measures. Locate and label all sediment and erosion control measures on the mine map(s) and provide typical cross-sections/construction details of each measure. Engineering designs and calculations are required to justify the adequacy of any proposed measures. a. Operator will widen existing dirt access road from Carolina Pines Road to the mine site excavation area, and will stabilize the road shoulders with groundcover. b. Operator will construct and maintain a 30-ft wide by 40-ft long gravel construction entrance at the intersection of the access road with Carolina Pines Road. c. Operator will maintain existing foliage visual screen along perimeter of the affected area. d. Prior to usage, the operator will construct a vegetated 2-ft tall sand berm along the perimeter of western exterior processing area to prevent sedimentation leaving the area. 3. A) Will the operation involve wash' the material mined, recycling process water, or other wastewater handling? B) Will the operation involve discharging fresh or wastewater from the mine or plant as a point discharge to the waters of the State? Addendum-1: Page 6 - Mine Permit Application — Rich Farms Mine C. Protection of Natural Resources 1. Sequence of Events for Development and Operation: a. Operator will obtain all required mining permits from NCDEQ. b. Operator will widen existing dirt access road from Carolina Pines Road to the mine excavation area and will stabilize the road shoulders with groundcover. c. Operator will construct and maintain a 30-ft wide by 40-ft long gravel construction entrance at the intersection of the access road with Carolina Pines Road. d. Operator will establish a 2-acre staging and processing area on the west side of the excavation area outside of the western berm. A break in the berm there will provide access for mining equipment to enter the excavation area. All other existing berms will remain. e. Operator will maintain existing foliage visual screen along perimeter of the affected area. f. Topsoil and sand will be removed from the spoil area to a level not less than the natural ground level of adjacent woodlands. g. Excavation will start on the west end of the project area and will proceed to completion 100 feet at a time until the entire spoil area inside the berm is removed. h. All stormwater inside the berm will remain internal; there will be no stormwater drainage outside of the bermed area. i. If utilized, the operator will construct a vegetated 2-ft tall sand berm along the perimeter of western exterior processing area to prevent offsite sedimentation. j. After each 100 feet of ground is removed, the affected area will be levelled, graded, and sown with groundcover per NCDEQ requirements for reclamation. k. All trash will be removed from the excavation area, and the entire affected area inside the permit area will be fertilized and seeded with groundcover. Any remaining affected slopes will be stabilized with groundcover. Area inside the remaining berm and outside processing area will be allowed to return to natural field state. I. After reclamation, permit area will be utilized by the landowner for scenic and recreational purposes, and as wildlife habitat. Locate all existing wells on the mine map(s) that lie within 500 feet of the proposed excavation area. Provide data to support any conclusions or statement made, including any monitoring well data, well construction data, and current water withdrawal rates. Indicate whether the proposed mine locale is served by a public water system or private wells. Not applicable. D) If you answered yes to any of the above questions, provide evidence that you have applied for or obtained the appropriate water quality permit(s) (i.e., non -discharge, NPDES, Stormwater, etc.) from the Stormwater Program. In addition, the applicant is required to register water use with the Division of Water Resources, Ground Water Management Branch, if the operation withdraws more than 10,000 gallons per day and needs a capacity use permit from the Division of Water Resources, Ground Water Management Branch, if the operation lies in a capacity use area and withdraws more than 100,000 gallons per day. Not applicable. 4. A) Will the operation involve crushing or any other air contaminant emissions? YES FX]NO If yes, indicate evidence that you have applied for or obtained an air quality permit issued by the Division of Air Quality or local governing body. Not applicable. B) How will dust from stockpiles, haul roads, etc., be controlled? Spraying water from water supply trucks on haul roads and process areas will control dust. Stockpiles will also be sprayed with water weekly if necessary to control dust. A) A buffer will be required between any mining activity and any mining permit boundary or right-of-way. It may be an unexcavated buffer (no excavation, but roadways, berms, and erosion & sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note that all buffers must be located within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer may be needed depending on site conditions. Show all buffer locations and widths on the mine map(s). Operator will maintain a minimum 75-ft wide undisturbed buffer (contains undisturbed 75-ft wide CAMA AEC setback including 30-ft wide CAMA shoreline buffer) between excavation area and Intracoastal Waterway shoreline to the south inside permit area. Operator will maintain 20-ft wide unexcavated buffer between eastern permit boundary and excavation edge, a 45-ft wide unexcavated buffer between the northern permit boundary and excavation edge, and a 25-ft wide unexcavated buffer along the western and southern perimeter of the processing area inside the permit area. B) A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can be justified. Depending on site conditions, a buffer wider than 50 feet may be needed. How wide an undisturbed buffer will be maintained between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands at this site? Show all buffer locations and widths on the mine map(s). Operator will maintain a minimum 75-ft wide undisturbed buffer (contains undisturbed 75-ft wide CAMA AEC setback including 30-ft wide CAMA shoreline buffer) between excavation area and Intracoastal Waterway shoreline to the south. 6. A) Describe methods to prevent landslide or slope instability adjacent to adjoining permit boundaries during mining. Minimum 2 horizontal to 1 vertical slopes or flatter for clayey material and minimum 3 horizontal to 1 vertical slopes or flatter for sandy material are generally required unless technical justification can be provided to allow steeper slopes. Existing stabilized and vegetated berms adjoin all permit boundaries and exterior faces will not be disturbed. Processing area outside existing bermed area will have 2-ft tall x 6-ft wide berms constructed around it to prevent offsite sedimentation. B) Provide a cross-section on the mine map(s) for all fill slopes (berms, waste piles, overburden disposal areas, etc.), clearly indicating the intended side slope gradient, installation of any benches and/or slope drains (with supporting design information) if needed, and the method of final stabilization. All fill slopes will have minimum 3:1 grade upon reclamation. Cross -sections for all cut slopes must be provided on the mine map(s). All cut slopes, if any, will have minimum 3:1 grade upon reclamation. Operator's intention is to grade and level all affected areas back to same flat level as that of adjacent woodland. D) In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross sections of the mine excavation clearly noting the angles of the cut slopes, widths of all safety benches and mine benches, and the expected maximum depth of the excavation. Not applicable, no hard -rock excavation. 7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling, house, public road, or public, commercial or industrial building from any mine excavation. Locate all such structures on the mine map if they are within 300 feet of any proposed excavation. Closest dwelling is 1800 feet from excavation area, closest public road is 1300 feet from excavation. Existing mine access road passes under elevated US264 bridge across Intracoastal Waterway. Bridge clearance over mine access road is 90 feet. There will be no mining below natural ground level. Access to excavation area is by single gated, private road controlled by applicant. 8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area and when it will be implemented. Vegetated earthen berms, appropriate fencing and adequate boulder barriers may be acceptable high wall barricades. A construction detaillcross-section and location of each type of barricade to be used must be indicated on the mine map(s). Caution signs, warning signs, no trespassing signs, and/or keep out signs will be installed around boundary of permit area. Permit area is located 1300ft from nearest public road (Carolina Pines Road) and is only accessible through gated, private owned dirt road. 9. Are acid roducing minerals or soils present? YES NO If yes, how will acid water pollution from the excavation, stockpiles, and waste areas be controlled? Not applicable. A) Describe specific plans (including a schedule of implementation) for screening the operation from public view such as maintaining or planting trees, bushes or other vegetation, building berms or other measures. Show the location of all visual screening on the mine map(s) and provide cross -sections through aft proposed berms or proposed spacing, sizes and species for tree plantings. Existing 12 to 15-ft tall vegetated berms surround proposed excavation area and will provide full visual screening of affected areas. Entire permit area is surrounded by full -growth woodland that will provide full visual screening. B) Could the operation have a significantly adverse effect on the purposes of a publicly owned park, forest, or recreation area? If so, how will such effects (i.e., noise, visibility, etc.) be mitigated? No public owned park, forest or recreation area located nearby. The steep side slopes of this type of berm eliminate the possibility of working on it with farm machinery. 4- NEW BERM E%IBTING� GRADE Berm Construction The berm construction comprises of the scraping back of the topsoil from the area where the berm and storage basin is to be built. A subsoil material, free of stones, rubble, stumps etc. and with at least 10% clay should be used to construct the berm. The material for the berm may be obtained from the area behind or in front of the berm location or moved from a borrow pit located elsewhere on the farm. An earth mover will be required to move material from a pit located a distance away while a bulldozer would be used if material is located in the berm area. The berm material is to be placed in layers and compacted as each layer is added. After the berm has a final shape the sides of the berm should also be compacted. Emergency Overflow To provide for larger -than designed peak flows, an overflow system is used, namely: • "The level -top vegetated berm crest" which provides for very flat berm top so that the water will overflow along the berm length in a thin layer so as not to create erosion problems.
