We will address each item as received in your letter. Your July 8, 2021 application states that you will avoid or impact Stream Feature F and Wetlands W13 on the newly acquired Powell and Kinney tracts, depending on whether USACE determines these features to be exclusive. Your maps show that you intend to impact these features. Please provide the USACE determination to impact these features or provide maps showing plans to avoid these features. To date, the USACE has not reversed its initial determination for Stream Feature F and Wetlands W13; even though, the current WOTUS rule would support the determination that these features are exclusive. Therefore, the mine maps M&ECP-1, M&ECP-2, and RP-1 have been revised to show our plans to avoid these features. Runoff from the overburden piles has been diverted to the corresponding sediment basin. The affected acreage table has been adjusted, as well, to reflect the changes in disturbed acreage. Please see the below adjusted Table, which can also be found on the M&ECP-1 and M&ECP-2 Mine Maps. Your current permit condition 5A mentions groundwater monitoring wells. These wells are not marked on the most recently submitted maps. Please clarify if these wells or any other wells are still in use. Please indicate and label on the mine map any new wells that have been installed. Groundwater observation wells numbers 1 through 6 are no longer in use. Four of the wells were terminated as they fell within the pit excavation. Another well was covered with an overburden pile. Since the wells are no longer operable, Hanson has removed the wells from the mine maps and requests that Mine Conditions 5A, 56, and 5C be removed from the mine permit. To our knowledge there have been no issues of the lack of water from nearby wells due to our Holly Springs quarry operations. Hanson does realize, however, the value that groundwater studies and observation wells can provide Hanson, as well as the Department, when troubleshooting any groundwater issues from the surrounding area. Thus, Hanson will include a Groundwater Monitoring Plan with the next mine modification application to expand the existing pit.
