Subject: Roberts Road Mine, Carteret County, Mining Permit Application
Dear Mr. Parr;
I am writing in response to your July 19, 2021 letter to Mr. Rick Williford, Sunland Sand and
Gravel, in which you requested additional information on the proposed Roberts Road Mine in
Carteret County. I will respond to each item in your letter in the same order for clarity;
1. A Pumping Operating and Maintenance Plan (O&M Plan) is attached.
2. The wetlands within the permitted area were delineated by Mr. John Roberts, Licensed Soil
Scientist. His delineation was reviewed and approved by Mr. Thomas Charles of the US Army
Corps of Engineers. See attached report for details.
3. The purpose of the perimeter berm is to contain any runoff within the mining area. It will be
established prior to any clearing or land disturbance. A silt fence will be installed along the
outside toe of the perimeter berm, especially adjacent to wetlands as a secondary protection
against offsite sedimentation. A detail of the berm and silt fence has been added to the site
plan. The perimeter berm is intended to be placed around the perimeter of the mining area and
has been labeled on the site map.
4. As per your recommendation, we contacted Mr. Ron Hudson, District Ranger, Croatan
National Forest, concerning protection of Red Cockaded Woodpecker. Mr. Hudson was very
helpful and provided guidance on how we can modify the site plan to provide protection to the
Woodpecker. As per his guidance, we have added an additional 50 foot of buffer along the
southern mining limit, when it is closest to the property line (the additional buffer wasn't
necessary in the area of the wetlands). This is currently classified as "buffer", however, the area
may possibly be mined in the future, as long as the operation complies with the restrictions
recommended by Mr., Hudson; that is, "timing restrictions on equipment use during the breeding
season (April -July)". A copy of my email correspondence with Mr. Hudson is attached.
5. The Haul Road is contained within the permit boundary. For clarity, the "access easement"
has been labeled as part of the "permit boundary" on the site map. The acreage for the haul
road has been added to the affected acreage chart, and the reclamation bond calculation sheet
has been revised with this acreage.
6. The "acreage table" from the permit application form has been added to the site map

8. According to Carteret County GIS map data, there are no structures within 300 feet of the
mine excavation. The closest structures are located on Countryside Court, approximately 450-
500 feet from the excavation.

We have reviewed the application your company submitted for the referenced mine site. In order for this office to
complete its review of the referenced project in accordance with G.S. §74-50 and §74-51 of the Mining Act of 1971,
please provide the additional or revised information in accordance with the following comments:
1. Please provide a Pumping Operating and Maintenance (O&M) plan for the proposed dewatering at the
site.
2. Please provide proof of wetland delineation and confirmation of Jurisdictional Determination from
USACE.
3. Please clarify the construction sequence of the perimeter berm (including temporary silt fence) and
identify on the location of the berm on the mine map.
4. US Forrest Service (USFS) has identified possible habitat for Red Cockaded Woodpecker in Croatan
National Forest. Please provide a study or statement from USFS on your proposed mitigation methods
to avoid an adverse impact to wildlife. Please contact Ron Hudson, District Ranger
(rondall.hudson@usda.gov), (252-638-5628 x4001) for more information.
5. N.C.G.S. §74-49 defines "affected land" as the surface are of land that is mined, the surface area of
land associated with a mining activity so that soil is exposed to accelerated erosion, the surface area of
land on which overburden and waste is deposited, and the surface area of land used for processing or
treatment plant, stockpiles, nonpublic roads, and settling ponds. Please clearly indicate and label on
the mine map that the haul road to the nearest public road is included in the Mine permit boundary.
6. Please clearly indicate the acreage table on the mine map.
7. Please clearly indicate on the map legend the name and title of the person preparing the mine map.
8. Please clearly indicate all structures within 300' of the mine excavation on the mine map.

Please note, this office may request additional information, not included in this letter, as the mining application
review progresses. Be advised that our review cannot be completed until all of the items listed above have been
fully addressed.
In order to complete the processing of your application, please forward two (2) copies of the requested information
to my attention at the following address:

As required by 15A NCAC 5B.0113, you are hereby advised that you have 180 days from the date of your receipt
of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request
additional time, you must submit information, in writing, to the Director clearly indicating why the deadline cannot
be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be
made to grant or deny the mining permit based upon the information currently in the Department's files at the end
of the 180-day period.
Though the preceding statement cites the maximum time limit for your response, we encourage you to provide the
additional information requested by this letter as soon as possible. Your prompt response will help us to complete
processing your application sooner.
