Madden Company Attorney 701 Corporate Center Drive, Suite 101 Raleigh, NC 27607 Tel: (919) 576-5127 Sean.Madden@fredsmithcompany.net February 16, 2022 VIA OVERNIGHT MAIL AND E-MAIL Brian Wrenn — Director Division of Energy, Mineral and Land Resources Department of Environmental Quality 1612 Mail Service Center Raleigh, NC 27699 Re: Daurity Springs Quarry — Mining Permit No. 19-22 — Chatham County — Cape Fear River Basin ("Mine") Dear Mr. Wrenn: As you are likely aware, FSC II, LLC dba Daurity Springs Quarry ("FSC") submitted transfer requests for the permits of the above -referenced Mine. In response to the request, FSC received correspondence from Adam Parr, Assistant State Mining Engineer, requesting additional or revised information for the Mine such that the request for transfer could be reviewed. The letter from Mr. Parr included 4 items that needed to be addressed within a 180-day time frame. Pursuant to that letter, FSC is respectfully requesting an extension of time to complete the outstanding items. FSC represents to you that the majority of the items listed by Mr. Parr have been addressed. However, due to circumstances beyond FSC's control, it requires additional time to complete the remaining outstanding items. Specifically, FSC requires additional time to complete an updated mine map. FSC has engaged a third -party consultant to assist in the creation of the updated mine maps. During the process, the consultant identified wetlands that had not previously been included on prior maps. Due to this finding, the proposed map must be submitted to the Army Corps of Engineers for approval of the wetlands. We have been told that the approval process can take from 60 to 90 days. It is my understanding that the updated mine map is the only outstanding item that needs to be addressed among the list of items from Mr. Parr. Accordingly, FSC respectfully requests an extension of time of 120 days to allow sufficient time to complete this work and provide the additional or revised information so that the request for transfer of the permits may be adequately reviewed.
