Thank you for your email. I do need clarification on something please. I asked if a violation had been issued
for mining without a permit. Mr. Parr stated that there was a violation issued and that the letter to the
applicant was posted in the materials emailed to me. I did find an email exchange between Mr. Parr and Mr.
Hoffman about the activity on the site and that there was to be no activity as a permit was being
considered. I did not find a letter of violation in the materials. Was there a notice of violation mailed to the
applicant or did the emails suffice for this?
Also, I know there was a question about an existing storm water permit issued by the Asheville office and
that Mr. Hoffman's application earlier this year had been denied or not yet approved. I would like to know
what happened with these permits. Mr. Mike Smith send Mr. Hoffman an email requesting that he call him
right after I had left the Asheville office to look at the permits. I asked about the previous borrow pit on the
property. ( The permit issued in 2018 is included in the materials received.) When I asked about getting
copies of the permit application from Mr. Hoffman, Mr. Smith told me they did not make copies in the
office. If I wanted copies, I would have to make another appointment and meet a staff member at a place
that makes copies to pay for them. I asked about emailing the information to me and he said I would have
to bring a thumb drive and make an appointment to transfer the files. I understand about not being able to
copy large maps at the office. I did not understand why they would not make copies of the letters or let me
make the copies. My daughter tried to photo the pages but the pictures were not clear. I was not told to
contact anyone else for this information. I need some clarification on these permits.
In summary I am requesting the following:
■ A copy of the violation letter issued for mining without a permit
■ A copy of Hood Creek Soils storm water application and documents concerning the application
■ A copy of email concerning the 2018 storm water permit
■ A copy of any emails between DEQ and Ray Hoffman/Hood Creek Soils
I would like to have a copy of the violation letter as soon as possible. I realize that gathering the email
exchanges make take a little time. Thank you for your time and help with this matter.

There was a Notice of Violation issued for mining with out a permit. This letter to the applicant has also
