Proposed Modification to the Mattie Mine (Permit No. 74-97) APR U -) 26U

Dear Mr. Parr,
On behalf and at the direction of Mr. Joseph Briley Jr. (J.O.C. Farms, LLC), enclosed is an
application package for a proposed modification to the Mattie Mine, located off of US 264 East
approximately 4 miles east of Greenville, NC. The current permitted area is 31.10 acres. The
new proposed area is 32.07 acres for a new total of 63.17 acres. The proposed new area is on
the same tract of land as the current permit. The settling basin shown on the previous map
dated 11-15-2017 is not required because the site drains internally and the capacity of the
existing excavation far exceeds what is required to contain stormwater.
Six copies of the N.C. Mining Permit Application, six copies of the mine map and a check for
$1,000.00 is enclosed. All adjoining property owners have been properly notified along with
the Pitt County Manager and the N.C. Department of Transportation.
The purpose of the modification is to expand the permit boundary to include the entire tract of
land in the permit and to address the NOV letters dated July 15, 2021 and March 7, 2022 from
Samir Dumpor, PE (WaRO, DEQ). The following is to address comments in those letters.
Operating Condition 2B: There is a water wagon on site and will be used to prevent dust when
necessary. Stock piles of rock/gravel are on site and will be used to maintain the construction
entrance.
Operating Condition 3A: Part of the 50' undisturbed buffer was encroached on with trucks.
The north side of the excavation has been back -filled to provide truck access around the
excavation without disturbing the buffer. The encroached upon portion of the buffer is in the
process of grading and seeding.
Operating Condition 4A: The sediment basin that was originally design is not needed. The site
drains internally and the capacity of the existing excavation far exceeds what is required to
contain stormwater without discharging into the blue line stream.
Operation Condition 4C: No dewatering has occurred. There is no need to dewater the
excavation. There is a pump on site that is used to screen sand. The water runs back into the
excavation area. There is typically a second pump on site as a backup in case the primary pump
fails. The NOV implies that the sediment observed in the blue line stream was a result of a
pump on site. That is not the case.
Operating Condition 5: Permit boundaries are currently not marked. The proposed new permit
boundaries will be marked with a metal stake and PVC sleeve.
Operation Condition 12: This letter is to satisfy the requirement in writing of the desire to
modify the permit to include the area that has been disturbed outside the current boundary
and the remaining area to the property lines.
