Adam, Emily specifically states that if they stay out of the ditch feature and the woods then they
would be out of their jurisdiction. Therefore, if they are going to dig the ditch then we are going to
need a 401/404 certification which may or may not be doable!.

The applicant on this modification application has provided correspondence from the USACE with
regard to wetlands near the site. However he still has not delineated or had a jurisdictional
determination complete.
I am also concerned that he told the USACE that he was staying out of the ditch and wooded area.
His excavation is outside the wooded area but he will be excavating the ditch. Also, his screening
berm is located on top of the ditch and encroaching into the wooded area.
I will try to reach out directly to USACE, but if you have any other comments in the meantime please
send them my way.

Adam, please find our comments. The proposed mine site could possibly be located in wetlands and
there is also a stream that is located adjacent or within the mine boundary. A JD and a stream
