On August 9, 2021, after proper notice of the public hearing, the Pitt County Board of
Commissioners met and held a quasi-judicial evidentiary hearing to consider the following application:
Applicant: PSD Properties, LLC
Property Owner(s): PSD Properties, LLC (Parcel 85515)
Jerry Nichols and Elsie Nichols (Parcel 85653)
Property location: Tax Assessor's Office Parcel Numbers 85515 & 85653, located on the northern
side of SR 1562 (Alvin Road) north of its intersection with NC 33 East. The subject property is
169.74 acres, of which approximately 15.67 acres is being added to 19.6 acres of existing mined
property, for a total of 35.27 acres being approved to be used for the sand mine.
Proposed Use of Property: Sand Mine
Having heard all the evidence and argument presented at the hearing, upon motion made by
Commissioner Melvin McLawhorn and seconded by Commissioner Chris Nunnally, by unanimous vote,
the Board finds that the application is complete and complies with all applicable requirements of the Pitt
County Zoning Ordinance, and the Class 1 Special Use Permit for the purposes indicated above is hereby
approved, subject to the development standards of Section 8.(DDD.) of the Pitt County Zoning Ordinance
and the following conditions:

2. The lowest floor and all attendant utilities shall be at or above 16.30 feet (NAVD)
3. Pursuant to Section 6.5-52e of the Pitt County Flood Damage Prevention Ordinance, it shall be the duty of the permit holder to
submit to the Floodplain Administrator the Elevation/Floodproofing Certification within 7 calendar days after establishment of the
lowest floor.

8. Proper Erosion and Sediment control measures shall be installed and maintained in accordance with North Carolina State
Standards
during fill operations.
