The stream determination and the notarized certification has been completed by Rivers and Associates in Greenville, NC. They have forwarded you a copy and Pitt County a copy. 3. The County has given us a special use permit which is enclosed. 4. 1 have indicated on the map that we will be using the existing haul road with the original permit. 5. 1 have marked on the map where we are closing the ditch off. The ditch is only internal drainage and does not discharge water. 6. 1 have included the updated acreage table for the permitted area. 7. We are using existing haul road from the Nichols sand mine #74-99 and updated the mine map for the entrance construction. Please review. Thank You Mark Smith Pitt County, North Carolina Class 1 Special Use Permit Approval PSD Properties, LLC Sand Mine On August 9, 2021, after proper notice of the public hearing, the Pitt County Board of Commissioners met and held a quasi-judicial evidentiary hearing to consider the following application: Applicant: PSD Properties, LLC Property Owner(s): PSD Properties, LLC (Parcel 85515) Jerry Nichols and Elsie Nichols (Parcel 85653) Property location: Tax Assessor's Office Parcel Numbers 85515 & 85653, located on the northern side of SR 1562 (Alvin Road) north of its intersection with NC 33 East. The subject property is 169.74 acres, of which approximately 15.67 acres is being added to 19.6 acres of existing mined property, for a total of 35.27 acres being approved to be used for the sand mine. Proposed Use of Property: Sand Mine Having heard all the evidence and argument presented at the hearing, upon motion made by Commissioner Melvin McLawhorn and seconded by Commissioner Chris Nunnally, by unanimous vote, the Board finds that the application is complete and complies with all applicable requirements of the Pitt County Zoning Ordinance, and the Class I Special Use Permit for the purposes indicated above is hereby approved, subject to the development standards of Section 8.(DDD.) of the Pitt County Zoning Ordinance and the following conditions: - Provide a 50 foot riparian buffer on all stream features present on the site, or provide documentation from North Carolina Division of Water Quality or Pitt County Planning showing that the feature is exempted from the Tar -Pamlico Buffer Regulations. - Complete a No -Rise Certification and obtain a flood development permit from Pitt County Planning prior to any development within the floodway. - Obtain an operating pernlit from the North Carolina Department of Environmental Quality's Energy, Mineral and Land Resources Division prior to any work on site.
