Dear David:
As you are aware, Smith Gardner Inc. (S+G) has been engaged by Merritt's Gravel Pit to assist
in permitting, design, and operations at the above referenced site. We are providing notice of
this transition and, as Successor Engineer, we are performing necessary diligence in capturing
the current conditions at the site as well as preparing comments to last Department
correspondence dated March 15, 2021 (attached). Please find each comment in italics
followed by current response or progress in bold below.
Comment No. 1. The following items must be shown on your mine map.
a. All water supply wells within 500 feet of the mine excavation.
b. All occupied dwellings within 300 feet of the mine excavation.
c. Visual screening along Damascus Church Road.
d. Names of all adjoining landowners in the appropriate locations on the plans. This
includes the adjoining landowners for both the existing mine and proposed addition.
e. The proposed final slopes of beneficial fill and other areas are 2H:1V. Generally, from
a permanent stabilization perspective we consider this too steep for fill slopes to
remain stable over the long term. The proposed slopes as drawn on Drawing C-2 are
rejected unless you provide appropriate slope stability calculations with factor of
safety indicating the proposed slopes can be expected to remain stable in the long-
term.
f. Please revise maps provided to accurately reflect current conditions.
g. Proposed highwalls and required barriers must be clearly identified on plan sheets.
h. Indicate the location of the two 500-gallon above ground storage tanks with
.. containment on plans. The tanks' containment structures should be shown in the
Details drawing.
i. On a separate map, show the contributing watersheds and delineate how they are
affecting sediment basin and channel. Delineations must correspond with topography.
j. Explain the purpose of the "shallow excavation area" near Damascus Church Road, as
shown on Sheet C-1.

redesign.

S+G is responding to these comments in the form of a consolidated and new mine map as
"Successor" Engineer. All comments are acknowledged and will be addressed in the
updated Mine Map. At this time, we have the following activities underway:
• S+G site reconnaissance and review of files has been completed;
• Securing base property surveys by Don T. Israel, PLS has been completed;
• Wetlands and Streams Evaluation by Carolina Ecosystems the week of August 161h;
• Survey Ground Control by Surveying Solutions, PC on August 161h.
• Imagery and Topographic Data Collection by S+G on August 17th.
We anticipate data reduction and a preliminary base map prepared by August 23rd to
address all issues of stormwater, high wall identification, buffers, and reclamation
throughout this week. We would like to request an in -person meeting with S+G, the
Department, Katelin Merritt of Merritt's Gravel Pit, and Kipp Liobl of ABI Equipment (as
operator) to review the preliminary map and gain consensus on current status of the site, .�

satisfied with current protection considering the vegetative areas surrounding the former
mine area and yields any further concerns regarding stormwater and buffers to the Town of
Carrboro's jurisdiction.

Town of Carrboro
With regard to the prior concerns by the Town of Carrboro, both parties reached a mediated
settlement that dismisses the prior orders and suit. As a part of the settlement, an
undisturbed and vegetated buffer is required along the southern property line lie. Wildflower
Learning Community, Inc.). This vegetative buffer will be illustrated on the updated Mine Maps
forthcoming. As a result of this settlement, no other issues exist with regard to the ephemeral
stream. A copy of the settlement agreement is attached.

In accordance with G.S. 74-50(bl), the mine operator is required to make a reasonable effort, satisfactory to the
Department, to notify all owners of record, both public and private, of all tracts of land that are adjoining the mining
permit boundary; ifan adjoining tract is owned or leased by the applicant or is owned by the lessor of the mine tract,
all owners of record of tracts adjoining these tracts must be notified (that are within 1,000 feet of the mining permit
boundary). In addition, the Dune operator must also notify the chief administrative officer of the county or
municipality in which any part of the permitted area is located. Any person may file written comment(slication
to the
Department at the above address within thirty (30) days of the issuance of thus Notice or the filing of the app
for a permit, whichever is later. Should the Department detercnine that a significant public interest exists relative to
G.S. 74-51, a public hearing will be held within 60 days of the end of the 30-day comment period specified above.
A copy of the permit application materials is on file and available for public review during normal business
