REGAN Secretary TRACY DAVIS plrecsar This letter is to advise you of recent amendments to the North Carolina Mining Act of 1971 which impact the permit term of your existing mining permit. Pursuant to the passage of House Bill 56, which became law on October 4, 2017 as SL 2017-209, all existing mining permits and any newly issued mining permits are to be issued for the life of site or for the duration of the lease term_ The "life of site means the period from the initial receipt of a permit for the operation until the mining operation terminates and the required reclamation is completed. Considering the above, this letter hereby modifies your existing mining permit to remove all references to the prior expiration date to convert your permit to a life of site or lease permit effective immediately. No action is required on your part for this modification to be effective. Please attach this letter to your existing mining permit for future reference. The mine name and permit number on the permit document, and all existing operating and reclamation conditions contained therein, shall remain in full force and effect. Furthermore, all provisions of GS §74-51 and GS §74-52 still apply to all new, transferred and modified mining permits. In addition to the life of site or lease mining permit provision, St. 2017-209 also enacted a new annual mining permit operating fee of $400 per mining permit number. By statute, the initial payment of this annual $400 fee must be submitted to this office by December 31, 2017 — see the attached Invoice to remit the initial annual fee payment by this deadline. Beginning in 2018, the $400 annual operating fee must be submitted by July 1 of each year with the required Annual Reclamation Report as required by GS §74-55. Failure to submit the fee by the required deadline will result in a $501month late fee and could result in the denial of future permit actions and/or revocation of your mining permit. Lastly, pursuant to GS §74-54, the capon reclamation,bonds has been raised.from $500,000.to-$1 million. Any adjustments needed in existing bonds will be initiated by this office or addressed during your next requested permit action unless you contact this office with a written request to have your bond reevaluated. The issuance of a mining permit and/or any modification to it does not supersede local zoning regulations. The responsibility of compliance with any applicable zoning regulations remains with you. MINING PERMIT EXPIRATION DATE: July 9. 2020 Page 2 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment and Natural Resources hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. nofinitionc Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.&S. 74-49, Modifications: August 4, 1992: This permit has been modified to change the type of temporary highwall barrier allowed by the mining permit to a three strand barbed wire fence. four feet high, as indicated on the construction detail submitted with the modification request. However, once a permanent, non -progressing face has been established, a more substantial, permanent highwall barrier, such as a chain link fence, will be required before the site can be released from its reclamation obligations. September 24, i 993: This permit has been modified to suspend the monitoring requirements in the permit until blasting and/or dewatering is reinitiated. January 1, 2000: This permit has been modified to change the name on the permit from Vulcan Materials Company to Vulcan Construction Materials LP. Page 3 Expiration Date This permit shall be effective from the date of its issuance until July 9, 2020. Conditions This Permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: OPERATING CONDITIONS: Wastewater and Quarry Dewatering A. Any wastewater processing or mine dewatering shall be in accordance with the narmittinn requirements nnri rulers nrnmr dngfi-H hv the N r FnvirnnmAntal Management Commission. B. Any storm water runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Division of Water Quality to secure any necessary storm water permits or other approval documents. 2. Environmental Management Commission and enforced by the Division of Air Quality. B. During processing operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. Buffer Zones A. Any mining activity affecting waters of the State, waters of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. B. Sufficient buffer shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. Page 4 C. All buffer zones shown on the Mine Map last revised November 15, 1999 shall be maintained to protect adjoining property. These buffer zones, with the exception of the installation of required sediment control measures and approved earthen berms, shall remain undisturbed. 4. Erosion and Sediment Control A. The operator shall notify the Winston Regional Office. band Quality Section, at least 48 hours prior to reactivating the site. B. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, check dams, sediment retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. B. All mining activities, including the installation and maintenance of all erosion and sedimentation control measures, shall be conducted as indicated on the Mine Map last revised November 15, 1999 and the supplemental information received by the Land Quality Section on June 11, 2010. The observation wells 1 thru 3 shall be monitored at least 30 days prior to resuming blasting and/or dewatering activities at the sate. B. The observation wells shall be monitored twice a month (bimonthly) at the same I I I TI 1 ❑ay and approximate time orC day. i ne static water levels shall be measured with an accuracy of plus or minus 0.1 foot and shall be referenced to a datum point and a record of the water levels maintained. The bimonthly precipitation and the volume of pit water discharge shall also be recorded. Copies of these records shall be provided to the Department on or about the end of each month. Static water level monitoring frequency may be increased or decreased as deemed appropriate by the Department. Page 5 6. Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut slopes along the perimeter of the quarry opening shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum twenty (20) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of any overburden slope and a 15 foot wide bench shall be incorporated with every 25 feet of elevation change in overburden slopes. 7. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Blasting The operator shall monitor each blast with a seismograph located at a distance no farther than the closest off site regularly occupied structure not owned or leased by the operator. A seismographic record including peak particle velocity, air overpressure, and vibration frequency levels shall be kept for each blast (except as provided under Operating Condition Nos. 8B and 80 of this permit). The following blasting conditions shall be observed by the mine operator to prevent hazard to persons and adjacent property from surface blasting: A. Ground Vibration With Monitoring: In all blasting operations, the maximum peak particle velocity of any component of ground motion shall not exceed Figure 1 (below) at the immediate location of any regularly occupied building outside of the permitted area such as a dwelling house, church, school, or public, commercial or institutional building. 0 10.❑ ai Tasc 'dibraticn F^?Guenc;. Ground Vibration Without Monitoring: - In the event of seismograph malfunction or other condition which prevents monitoring, blasting shall be conducted in accordance with the following formulas: W = (D/D,)2 D, = D Wtrz V = 160(Dg)-1.e W = Maximum charge weight of explosives per delay period of 8.0 milliseconds or more (pounds). The peak particle velocity of any component shall not exceed 1.0 inch per second, for the purposes of this Section. C. Air blast With Monitoring: Air blast overpressure resulting from surface blasting shall not exceed 129 decibels linear (dBL) as measured at the immediate location of any regularly occupied building uilding not owned or leased by the n_ne_rntnr outside of the permitted area such as a dwelling house, church, school, or public, commercial or institutional building, unless an alternate level based on the sensitivity of the seismograph microphone as specified below is being used: Lower Frequency Limit of Max Level, Measuring System in Hz In dBL 0.1 Hz or lower -flat response 134 peak 2.0 Hz or lower -flat response 133 peak 6.0 Hz or lower -flat response 129 peak D. D = Distance from the blast site to the nearest inhabited building not owned or leased by the mine operator (feet). P = Unconfined air overpressure (decibels). A = Air blast or air overpressure for typical quarry situations (decibels). Page 8 The air blast/overpressure shall not exceed 129 decibels, for the purposes of this Section. E. Record Keeping: The operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; blast location, distance from blast to closest offsite regularly occupied structure; and weather conditions at the time of the blast. Records shall be maintained at the permittee's mine office and copies shall be provided to the Department upon request. F. Excessive Ground Vibration/Air blast Reporting: If ground vibration or Air blast limits are exceeded, the operator will immediately report the event with causes and corrective actions to the Department. Use of explosives at the blast site that produced the excessive reading shall cease until corrective actions approved by the Department are taken. However, blasting may occur in other approved areas within the permitted boundary. Authorization to blast at the blast site may be granted at the time of the verbal reporting of the high ground vibration or high air blast reading if the circumstances justify verbal approval. Failure to repoii will constitute a permit violationn. G. Flyrock Prevention: The operator shall take all reasonable precautions to ensure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of the Mining Permit. H. Flyrock Reporting: Should flyrock occur beyond the permitted and guarded areas, the operator shall immediately report the incident to the Department. Further use of explosives on the mine site shall be suspended until the following actions have been taken: A thorough investigation as to the cause(s) of the incident shall be conducted. 2. A report detailing the investigation shall be provided to the Department within 10 days of the incident. The report shall, at a minimum, document the cause(s) of the incident along with technical and management actions that will be taken to prevent further incidents. The report shall meet with the approval of the Department before blasting may resume at the mine site. Page 9 Studies: The ooerator shall provide to the Department a copy of the findings of any seismic studies conducted at the mine site in response to an exceedence of a level allowed by these blasting conditions. The operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. J. Notice: The operator shall, when requested by the Department, give 24-hour advance notice to the Land Quality Section Regional Office prior to any blast during a period for which notice is requested. 9. High Wall Barrier A. A temporary highwall barrier consisting of a three strand barbed wire fence, four feet high shall be established until a permanent, non -progressing face has been established. A more permanent physical barrier consisting of a six foot high chain link fencing with three strands of barbed wire shall be installed as soon as possible (after mining activities resume at the site) and maintained at all times along the perimeter of any highwall to prevent inadvertent public access. B. Warning signs shall be posted around the perimeter of the operation at a minimum spacing of 100 yards. 10. Visual Screening A. Existing- vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be employed as deemed appropriate by the Department. B. Vegetated earthen berms shall be located and constructed as shown on the Mine Map last revised November 15, 1999. In addition to grasses, long leaf and/or Virginia pines or other acceptable evergreen species shall be planted as deemed appropriate by the Department to improve visual and noise buffering. 11. Plan Modification The operator shall notify the Department in writing of the desire'to delete. modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. Page 10 12. Refuse Disposal A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste MananamPnt Nn nPtrniPjlm nrnrillrtc arriHcz CnIVPntC nr thPlr OnranP rnntninom or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. If mining refuse is to be permanently disposed within the mining permit boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such disposal: 11. the approximate boundaries and size of the refuse disposal area; 2: a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and 5. verification that a permanent vegetative groundcover will be established 13. Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. Page 11 14. Bondin The cerijritv which was posted pursuant to N.C.G.S. 74-54 in the form of a $500,000.00 blanket bond, is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. RECLAMATION CONDITIONS: Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with water, provide a permanent barricade (fence) along the top of any high wall, and grade and revegetate any areas in unconsolidated material. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows- Page 13 A. All areas of unconsolidated material such as overburden or waste piles shall be graded to a 2 horizontal to 1 vertical or flatter slope and terraced as necessary to insure slope stability. B. Any settling ponds and sediment control basins shall be backfilled, graded, and stabilized or cleaned out and made into acceptable lake areas. C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation. E. No contaminants shall be permanently disposed of at the mine site. These comments are provided in accordance with certain provisions of the Mining Act of 1971 (as amended, 1982; G.S. 7446 through 74-68; 15 NCAC 5) and the North Carolina General Statutes (G.S. 113-131 et seq.). The mining operation is requesting permit renewal of an existing permitted quarry site that appears to be inactive. No permit modifications are indicated. Since the activities proposed are currently permitted, we will not object to the proposed permit modification with the exception of the proposed planting schedule. The application references use of non-native plants for revegetation. This mix includes Sericee lespedeza, Tall Fescue, Hulled Common Bermuda Grass and Rye (grain) in conjunction with fertilizer, liming and mulching. We recommend using a native piant seed mix. Sericea lespedeza and other non-native Plants should be removed from the planting schedule. In addition, we do not recommend planting monoculture forests during mine reclamation. The following recommendations are provided for your consideration as permit conditions: 1. During any new land clearing activities, woody debris (slash or large trees) removed during development of the site should be placed along the outer stockpile/compost area construction limits in the form of brush piles and downed logs to provide cover and nesting habitat for wildlife. 2. Should any stream relocation activities become necessary, relocations should use siato-of-the-art bioengineering techniques. Any channel relocations and riparian plantings should be planned and constructed by a company having professional bioengineering stream restoration training and experience within the state of North Carolina. Native riparian plants should be incorporated into stream relocation buffer zone,. Streambanks should be planted with autochthonous (native) plants like silky dogwood, rhododendron, dog hobble, mountain pepperbush, paw paw, red maple, silky willow, tag alder, black willow, sycamore, river birch, or other native woody species. Woody species selection should be based on riparian plant suitability to geophysical site conditions. 3. Fifty (50) foot undisturbed natural buffers are recommended for intermittent channels and one hundred (100) loot undisturbed natural buffers should be established for perennial streams. 4. Any stream crossings necessary should provide for aquatic life passage. Bridges are preferred over culverts and pipes. Culverts 48 inches diameter or larger should be buried a foot into the streambed. Culverts less than 48 inches diameter should be buried to a depth equal to or greater than 20% their size to allow for aquatic life passage. These measurements should be based on natural thalweg depths. 5. Stringent erosion control measures should he installed where soil is disturbed and maintained until project completion. As appropriate to protect listed species and/or stream classifications, sediment and erosion control measures may need to meet design standards for sensitive watersheds (15A NCAC 4B .0024). 6. Native plants are preferred and recommended for revegetation and reclamation activities. Please see the attached plant recommendations. 7. We recommend that the mine operation consult with professional wildlife biologists with the North Carolina Wildlife Resources Commission biologist to further discuss mine planting schedules and reclamation activities. Additional planting suggestions and plant supply sources may be obtained from Stewardship biologist, Elizabeth Hughes at 829-651-8390. It is important to use all of the components of the Basic Mix. The cover crop grain & legume provide rapid green -up while the creeping red fescue is developing. These components can be obtained locally. - Grains like oats, wheat, and rye may be sold by weight (pounds) or by volume (bushels). To simplify things, this mix recommends I — 2 BAGS of grain rather than pounds or bushels. With this mix, 1 bag or about 50 — 60 Ibs par acre should be adequate for most sites, but where slope or soil conditions warrant, increase grain amounts to 100 —120 Ibs (use 2 bags). -The perennial grass will establish within the first year and is the key to good site stabilization. Creeping red fescue has a wide range of adaptation when used for erosion control along roads and highways; cuts, fills, and other disturbed areas; and for stream and channel bank stabilization. It thrives in sun or shade, and is drought -resistant after establishment. For perm anent seeding of harsh dry sites, Hard Fescue Festuca 10 Ibs / acre $ 3 / lb brevi ila (s n. troth h Ua) can be added to the Basic Mix Application Notes - Disturbed sites with loose soils can usually be sown without extensive seedbed preparation if seeded as soon as the other work is completed. - Where necessary, prepare seedbed with conventional farm equipment (tractor and disk), or the soil surface can be bladed and then tracked with a bulldozer, Hydro -seeding can be used with the Basic Mix for slopes where equipment access is difficult. - Red fescue is adapted to sandy and acid soils so extensive soil amendments are usually not needed. On poor and subsoil sites, a low nitrogen fertilizer such as 5-10-10 may be required. If required, apply any necessary soil amendments, then drill or broadcast the seed mix. - The larger cover crop grains can be sown separately first and covered lightly to prevent loss of seed from wildlife such as turkeys and doves. -The rest of the seed mix should then be sown, but not covered with soil. It is better to firm the small seed into the soil than in try to cover it. - Culti-pack conventional seedbeds to ensure good seed -to -soil contact. Use higher rates as site conditions warrant. - If the site calls for it, natural fiber matting is recommended over plastic matting or matting that contains strands of plastic that can entrap small animals. - Monitor the site until the perennial grass component is fully established. Mature stands of the Basic Mix are short-statured and will not require mowing. The seeded mix should persist for many years, but will eventually yield to developing successional species. - Native wildflowers and grasses can be added to the Basic Mix to beautify and diversify the site, and provide food and cover for wildlife such as deer, turkey, quail, and songbirds. The following lists contain native species that are reasonably priced as natives go. The easy, proven performers are listed at the top of the tables, with the more challenging species towards the bottom. These seeds can be ordered from a reputable seed dealer. For sources, refer to Wildlife Seed List at http://www.ncwildlifc.or Wildlife Species Con/WSC WPM.htm . - Mixes with native seed can be culti-packed or tracked in with a bulldozer; hydro -seeding is apparently not recommended. Mixes with mainly wildflowers can be sown in early fall. If you answered yes to any of the above questions, provide evidence that you have applied for or obtained the appropriate water quality permit(s) (i.e., non -discharge, NPDES, Stormwater, etc.) from the Division of Water Quality, Water Quality Section. In addition, the applicant is required to register water use with the Division of Water Resources if the operation withdraws more than 10,000 gallons per day and needs a capacity use permit from the Division of Water Resources if the operation lies in a capacity use area and withdraws more than 100,000 gallons per day. Vulcan holds NPDES General Permit NCG 02000, COC 020183 from DWQ. 4. a. Will the operation involve crushing or any other air contaminant emissions? Yes ® No ❑. If yes, indicate evidence that you have applied for or obtained an air quality permit issued by the Division of Air Quality or local governing body. Vulcan holds DAQ Air Quality Permit Number 065121106. b. How will dust from stockpiles, haul roads, etc., be controlled? Fugitive dust from stockpiles and haul roads will be controlled by use of a water truck. Water will also be applied at the appropriate areas throughout the crushing circuit by use of spray bars. 5. a. A buffer will be required between any mining activity and any mining permit boundary or right-of- way. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion & sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note that all buffers must be located within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site'? A minimum buffer of 25 feet is recommended, although a wider buffer may be needed depending on site conditions. Show all buffer locations and widths on the mine map(s). A 25 feet unexcavated buffer will be maintained along all permit boundaries including along highway rights -of -way. b. A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can bejustified. Depending on site conditions, a buffer wider than 50 feet may be needed. How wide an undisturbed buffer will be maintained between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands at this site'? Show all bit r locations and widths on the mine map(s). A 50 foot buffer will be maintained between other watercourses and wetlands, if encountered. • 0 APPLICATION FOR A MINING PERMIT 6. a. Describe methods to prevent landslide or slope instability adjacent to adjoining permit boundaries during mining. Minimum 2 horizontal to 1. vertical slopes or flatter for clayey material and minimum 3 horizontal to I vertical slopes or flatter for sandy material are generally required, unless technical justification can be provided to allow steeper slopes. A 25 foot minimum buffer will be maintained between any new cut slopes and adjacent properties. The slopes will be constructed at a 2H:1V slope angle and seeded immediately upon completion. b. Provide a cross-section on the mine map(s) for all fill slopes (benns, wastepiles, overburden disposal areas, etc.), clearly indicating the intended side slope gradient, installation of any benches and/or slope drains (with supporting design information) if needed, and the method of final ,stabilization. No changes are anticipated to original, approved design. c. In excavation(s) of unconsolidated (non -rock) materials, specify the angle of all cut slopes including specifications for benching and sloping. Cross -sections for all cut slopes must he provided on the nine map(s). Overburden slopes that exceed 30 feet in height will have a 15 foot bench incorporated with every 25 feet of elevation change. Final overburden slopes will be at a 2H:1V slope angle. d. In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -sections of the mine excavation clearly noting the angles of the cut slopes, widths of all safety benches and mine benches, and the expected maximum depth of -'the excavation. An eight to twelve degree back slope from vertical with a 30 foot wide bench at SO foot intervals will be provided. 7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling house, public road, public, commercial or industrial building from any mine excavation. Locate all such structures on the mine map if they are within 300 feet of any proposed excavation. There are no subject structures within 300 feet of the quarry limit. All property surrounding the mined area will be adequately buffered to prevent any erosion onto adjoining property owners. Slopes will be placed on no steeper than 2:1 ratios and will be properly vegetated. Posted signs "No Trespassing - Open Pit " will be placed around the perimeter of the operation at a 100 yard spacing. Vehicle access to the site will be controlled at the entrance of mine on SR 1711. All drilling and blasting will be conducted in accordance with all applicable United States Bureau of Mines and North Carolina Standards, and upon recommendations of our consultants. Distance to the closest dwelling is approximately 1,500 feet. 4 ' 0 APPLICATION FOR A MINING PERMIT 8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area and when it will be implemented. Vegetated earthen berms, appropriate fencing and adequate boulder barriers may be acceptable high wall barricades. A construction detail/cross-.section and location of each type of barricade to he used must he indicated on the mine map(s). A barbed wire fence, three strands, 4 feet high, will be provided as a barricade around all temporary or active pit high walls. A boulder barrier and/or 6 feet high chain link fence will be provided as a permanent barricade. 9. Are acid producing minerals or soils present? Describe specific plans (including a schedule of implementation) for screening the operation from public view such as maintaining or planting trees, bushes or other vegetation, building berms or other measures. Show the locution of all visual screening on the mine map(s) and provide cross -sections through all proposed berms or proposed .~pacing, sizes and species for tree plantings. The quarry site is located in a rural area surrounded by broad forested areas. A minimum of 25 feet is to be left as buffer between the property line and any quarrying activity. With these provisions, no problems are foreseen with respect to screening quarry activities from public view. Vulcan Construction Materials, LP will implement any measures required in this area should they become necessary. b. Could the operation have a significantly adverse effect on the purposes of a publicly owned park, forest or recreation area? If so, how will such effects (i.e., noise, visibility, etc.) be mitigated? No. 11. Will explosives be used? Yes ® No ❑. If yes, specify the types of explosive(s) and describe what precaution(s) will be used to prevent physical hazard to persons or neighboring property from flying rocks or excessive air blasts or ground vibrations. Depending on the mine's location to nearby structures, more detailed technical information may be required on the blasting program (such as a third -party blasting study). Locate the nearest offsite occupied structure(s) to the proposed excavation(s) on the mine map and indicate its approximate distance to the proposed excavation. Emulsion -type explosives will be used. Drilling, loading, and blasting operations will be performed by qualified personnel who will follow the blasting techniques and procedures recommended by blasting specialists. Records for each blast will be maintained, and we will monitor all blasts with a seismograph and record the location, distances from the blasts, and identity of the property owner where the unit is located. • APPLICATION FOR A MINING PERMIT 12. Will fuel tanks, solvents, or other chemical reagents be stored on -site? Yes ® No R. If yes. describe these materials, how they will he stored and method of contaimrent in case of spill. Indicate the location(s) of all storage facilities on the mine map(s). Fuel and other essential petroleum products are stored in aboveground, approved tanks provided with secondary containment. A Spill Prevention, Control, and Countermeasure Plan will be prepared and implemented to ensure any spill is contained and not allowed to adversely impact adjoining properties or natural resources. In APPLICATION FOR A MINING PERMIT A. RECLAMATION PLAN Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate the sequence and general methods to be used in reclaiming this land. This must include the method of reclamation of settling ponds and/or sediment control basins and the method of restoration or establishment of any permanent drainage channels to a condition minimizing erosion, siltation and other pollution. This information must be illustrated on a reclamation map and mast correspond directly with the information provided on the mine map(s). In addition, design information, including typical cross -sections, of any permanent channels to be constructed as part of the reclamation plan and the location(s) of all permanent channels must be indicated on the reclamation map. Reclamation at Yadkin Quarry is an ongoing process. Through on -site inspections, Vulcan Construction Materials, LP monitors, on a periodic basis, the site for areas that may need maintenance or construction of additional erosion and sediment control measures. After the mining operation has ceased, all of the affected land will be sloped for drainage, contoured, graded, and vegetated per the approved seed mix. 2. Is an excavated or impounded body of water to be left as a part of the reclamation? Yes ® No ❑. If yes, illustrate the location of the body(s) of water on the reclamation map and provide a scaled cross-section(s) through the proposed body(s) of water. The minimum water depth must be at least 4 feet, measured from the normal low water table elevation, unless information is provided to indicate that a more shallow water body will be productive and beneficial at this site. Will the body(s) of water be stocked with fish? Yes ❑ No ®. If yes, specify species. The quarry will be allowed to fill with water creating a 10t acre reservoir with an average depth of 140 feet. 3. Describe provisions for safety to persons and to adjoining property in all completed excavations in rock including what kind of permanent barricade will be left. Acceptable permanent barricades are appropriate fencing, large boulders placed end -to -end, etc. Construction details and locations of all permanent barricades must be shown on the reclamation map. "No Trespassing - Open Pit" signs will be placed around the perimeter of the mined site. A fence, rock boulders, or a berm will be constructed around the pit area. Access to the mine via auto will be limited only to the front entrance. 4. Indicate the method(s) of reclamation of overburden, refuse, spoil banks or other such on -site mine waste areas, including specifications for benching and sloping. Final cross -sections and locations for such areas must be provided on the reclamation map. All overburden slopes are to be constructed with 2:1 slopes or flatter. The slopes are to be seeded with a prescribed seed mix and stabilized. w • APPLICATION FOR A MINING PERMIT a. Describe reclamation of processing facilities, stockpile areas, and on -site roadways. The area occupied by the processing facilities, stockpiles, and on -site roadways will be regraded and contoured to a stable condition. These areas will then be vegetated per approved seed mix. b. Will any on -site roadways be left as part of the reclamation? Yes ® No F. If'yes, identify such roadways on the reclamation map and provide details on permanent mad and ditch line stabilization. The main access road into the property is to be left intact. The ditches are to be lined with riprap and/or seeded to prevent erosion. The main haul road and service roads will remain for vehicular access to the lake formed by the pit. These roads shall be stabilized while the quarry is active. The roads and their need for maintenance will be determined by the future use of the site after the operation has ceased. 6. Describe the method of control of contaminants and disposal of scrap metal, junk machinery, cables, or other such waste products of mining. (Note definition of refuse in The Mining Act of 1971.) No off -site generated waste shall be disposed of on the mine site without prior written approval from the NC Department of Environment and Natural Resources, Land Quality Section and either the Division of Waste Management (DWM) or local governing body. If a disposal permit has been issued by DWM for the site, a copy of said permit must be attached to this application. All temporary and permanent refuse disposal areas must he clearly delineated on the mine maps) and reclamation map, along with a list of items to be disposed in said areas. No offsite or onsite generated waste will be disposed or left onsite. Vulcan operations seek to optimize both waste minimization and recycling to the degree possible. This includes but is not limited to all petroleum products, scrap metal, machinery, equipment, and other items and products. • APPLICATION FOR A MINING PERMIT 7. Describe your plan for revegetation or other surface treatment of the affected areas. This plan must include recommendations for year-round seeding, including the time of seeding and the amount and type of seed, fertilizer, lime and mulch per acre. MINING PERMIT EXPIRATION DATE: June 23 010 Page 2 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment and Natural Resources hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to -the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated' in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Modifications August 4. 1992: This permit has been modified to change the type of temporary highwall barrier allowed by the mining permit to a three strand barbed wire fence, four feet high, as, indicated on the construction detail submitted with the modification request. However, once a permanent, non -progressing face has been established, a more substantial, permanent highwall barrier, such as a chain link fence, will be required before the site can be released from its reclamation obligations. September 24, 1993: This permit has been modified to suspend the monitoring requirements in the permit until blasting and/or dewatering is reinitiated. January 1. 2000: This permit has been modified to change the name on the permit from Vulcan Materials Company to Vulcan Construction Materials, LP. Expiration Date This permit shall be effective from the date of its issuance until June 23, 2010. L' J Page 3 Conditions This Permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: OPERATING CONDITIONS: Wastewater and Quarry Dewatering A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Stormwater Section, Division of Water Quality, to secure any necessary stormwater permits or other approval documents. 2. Air Qualily and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. During quarry operation', water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. Buffer Zones A. Any mining activity affecting waters of the State, waters of the U.. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. B. Sufficient buffer shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. C. All buffer zones shall be maintained as indicated on the mine map last revised November 15, 1999. 4. Erosion and Sediment Control A. The operator shall notify the Winston-Salem Regional Office, Land Quality Section, at least 48 hours prior to reactivating this site. B. All mining activities, including the installation and maintenance of all erosion and sedimentation control measures, shall be conducted as indicated on the mine map last revised November 15, 1999. D. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the approved application for a mining permit'and any approved revisions to it. Such areas include, but are not limited to, expansion outside of the approved pit area, creek crossings, or expansion of overburden or waste disposal areas. 5. Groundwater Protection A. The observation wells 1 thru 3 shall be monitored at least 30 days prior to resuming blasting and/or dewatering activities at the site. B. The observation wells shall be monitored twice a month (bimonthly) at the same day and approximate time of day. The static water levels shall be measured with an - accuracy of plus or minus 0.1 foot and shall be referenced to a datum point and a record of the water levels maintained. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut'slopes along the perimeter of the quarry opening shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum 20 foot wide horizontal safety bench shall be provided at the tap of the rock and at the toe of any overburden slope and a 15 foot wide bench shall be incorporated with every 25 feet of elevation change in overburden cut slopes. 7. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. • Page 5 8. Bla stina The operator shall provide to the Department -a copy of the findings of any seismic studies conducted at this facility. The operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. The following blasting conditions shall be observed by the operator to prevent hazard to persons and adjacent property from thrown rock or vibrations: A. In all blasting operations, except as hereinafter otherwise provided, the maximum peak particle velocity of any component of ground motion shall not exceed 1 inch per second at the immediate location of any building outside of the permitted area regularly occupied by human beings such as dwelling house, church, school, public building, or commercial or institutional building outside of the permitted area. The operator shall monitor each blast with a seismograph. B. Airblast overpressure shall not exceed 128 decibels linear (DBL) as measured at the immediate location of any regularly occupied building outside of the permitted area such as any dwelling house, church, school,'public building, or commercial or institutional building. If vibrationlairblast limits are exceeded, the operator shall immediately report the event with causes and corrective actions to the Department. Use of explosives at the blast site that produced the excessive reading shall cease until corrective actions approved by the Department have been taken. However, blasting may occur in other approved areas, within the permitted boundary. Authorization to blast at the blast site may be granted at the time of the verbal reporting of the high airbiast reading if the circumstances justify verbal approval_ Failure to report will constitute a per - it violati n. C. The operator shall take all reasonable precautions to insure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Should flyrock occur beyond the permitted and guarded area, or the level in Item A. above is exceeded, the operator shall report the incident to the Department immediately and further use of explosive at the site shall be immediately suspended until the following actions have been taken: I. A thorough investigation as to the . cause(s) of the incident shall be conducted. 2. A satisfactory report detailing the investigation shall be provided to the Department within 10 days of the incident. Said report shall, at a minimum, document the cause(s) of the incident along with technical and management actions that will be taken to prevent further incidents. The report shall meet with the approval of the Department before blasting may resume at the site. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of this permit. • 0 Page 6 D. The operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole.; blast Inratinn; diRtance from blast to closest off -site occupied structure; and weather conditions at the time of the blast. Records shall be maintained at the permittee's mine office and copies shall be provided to the Department upon request. E. The operator shall, when requested by the Department, give 24 hour advance notice to the Land Quality Section prior to any blast during a period for which notice is requested. Q Nigh WWI Rnrriar A. A temporary highwall barrier consisting of a three strand barbed wire fence, four feet high shall be maintained until a permanent, non -progressing face has been established. A more permanent physical barrier consisting of a six foot high chain link fence with three strands of barbed wire shall be installed as soon as possible (after mining activities resume at the site) and maintained at all times around the perimeter of any highwall to prevent inadvertent public access. In addition, a minimum 20 foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of any overburden cut slope. B. Warning signs shall be posted around the perimeter of the operation at a minimum spacing of 100 yards. 10. Visual Screening A. Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be employed as deemed appropriate by the Department. B.' Vegetated earthen berms shall be located and constructed as shown on the mine map last revised November 15, 1999. In addition to grasses, loblolly and/or Virginia pines or other acceptable evergreen species shall be planted as deemed appropriate by the Department to improve visual and noise buffering. 11. Plan Modification The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on - site implementation of the revisions. 0 Page 7 12. Refuse Disposal A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the -purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1) on -site generated land clearing debris 2) conveyor belts 3) wire cables 4) v-belts 5) steel reinforced air hoses 6) drill steel D. If mining refuse is to be permanently disposed within the mining permit boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such .disposal: 1. the approximate boundaries and size of the refuse disposal area; 2. a list of refuse items to be disposed; 3. verification that a minimum of 4 feet of cover will be provided over the refuse; 4. verification that the refuse will be disposed at least 4 feet above the seasonally high water table; and 13. Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 14. Bonding The security which was posted pursuant to N.C.G.S. 74-54 in the form of a $500,000.00 blanket bond is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. Archaeological Resources Authorized representatives of the Division of Archives and History shall be granted access . LZto lle OM to determinethe presence of significant archaeological resources. 0 Page 8 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan; the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By_G.S. 74-53 The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent -use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, likely to become noxious, odious or foul. 5. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: 1. Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with water, provide a permanent barricade (fence) along the top of any highwall, and grade and revegetate any areas in. unconsolidated material. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. All areas of unconsolidated material such as overburden or waste piles shall be graded to a 2 horizontal to 1 vertical or flatter slope and terraced as necessary to insure slope stability. • Page 9 B. Any settling ponds and sediment control basins shall be backflled, graded, and stabilized or cleaned out and made into acceptable lake areas. C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be dlsced, subsoiled or otherwise prepared before revegetation. E. No contaminants shall be permanently disposed of at the. mine site. On -site disposal of waste shall be in accordance with Operating Conditions Nos. 12.A. through 0. F. The affected land shall be graded to prevent the collection of noxious or foul water.. 3. Revegetation Plan: Disturbed areas shall be permanently revegetated according to the Revegetation Plan prepared by Mr. Craig R. Wyant, RLA, dated November 10, 1999 with the exception that weeping love grass be replaced in the mixture by a more appropriate seed type. In addition, the permittee shall consult with a professional wildlife biologist with the N.C. Wildlife Resources Commission to enhance post -project wildlife habitat at the site. 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. As stated in the application, the site has been covered under state-NPDES general permit no. NCGD20D00, holding Certificate of Coverage NCG020103. The 020000 series permits technically expired on 08/31/97, but due to negotiations between DWQ and the N.C. Aggregates Association, the new General Permit did not become effective until 12/01/99. New Certificates of coverage have not yet been mailed to permittees, though this is expected to be accomplished in the near future. As Vulcan made application for Permit renewal on 06/18/97, prior to Permit expiration, we consider them to be legally operating under the terms of their old General Permit, until such time as their new c.O.c. is issued. It was also noted in the application cover letter that Vulcan is about to undergo a corporate name change, se an NPDES name change to= will be sent to Mike Poplin. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Expiration Date This permit shall be effective from the date of its issuance until December 6, 1999. VYCKHI 114U WHU111VtYJ 1. Wastewater and Quarry Dewatering Any wastewater processing or mine dewatering shall be in accordance with the requirements and rules promulgated by the N.C. Environmental Management Commission. 2. Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission. B. During quarry operation, water trucks or other means that may be necessary shall be utilized to prevent dust from.leaving the permitted area. 3. Buffer Zones A. Any mining activity affecting wetlands shall be in accordance with the renlliremertt and rPaulatinns promulgated by the U.S. Army Corps of Engineers. B. Sufficient buffer shall be maintained between any affected land and any adjoining ti.aterway to prevent sedimentation of that waterway from erosion of the affected land and to preserve the integrity of the natural watercourse. C. The buffer zones shown on the Sedimentation and Erosion Control Plan .4 U +er4 l nnllnr%, �� lggg And revised lane 2�1; 1989 shall be maintained .l , to prevent caving of any adjoining property and to allow grading of the side slopes to the required angle. These buffer zones, with the exception of the installation of required sediment control measures and earthen berms, shall remain undisturbed. 4. Erosion and Sediment Control A. The operator shall notify the Winston-Salem Regional Office, Land Quality Section, at least 48 hours prior to beginning any of the initial land disturbing activities indicated in the approved application for a mining permit. B. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, brush barriers, silt check dams, silt retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in proximity to the affected land. Page 4 of 9 C. The Erosion and Sedimentation Control Plan, dated January 23, 1989 and revised June 20, 1989 (received October 6, 1989) shall be followed. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the approved application for a mining permit. Such areas include, but are not limited to, expansion outside of the initial pit area (5 acres), creek crossings, or expansion of overburden disposal areas. 5. Groundwater Protection A. The observation wells denoted as 1 thru 3 on Figure 1 (attached) shall be monitored at least 30 days prior to initiating any excavations of consolidated material (rock) in the initial pit area to allow for the determination of pre-existing (static) groundwater levels. B. The observation wells shall be drilled wells cased into consolidated rock and grouted to the surface. The wells (boreholes) shall be extended at least 50 feet below static water level, or at least 50 feet into unweathered rock, whichever is deeper. The wells shall be secured against unauthorized entry with a lockable cap. The necessary permits to construct these wells shall be obtained from the N.C. Division of Environmental Management, Groundwater Section. C. The observation wells shall be monitored twice a month (bimonthly) at the same day and approximate time of day for twelve (12) consecutive months following the installation of the wells. The static water levels shall be measured with an accuracy of plus or minus 0.1 foot and shall be reT@reflf:eU to a uatUiii point and a record of the water levels maintained. The bimonthly precipitation and the volume of pit water discharge shall also be recorded. Copies of these records shall be provided to the Department on or about the end of each month. Static water level monitoring frequency may be increased or decreased following the initial twelve (12) month period as deemed appropriate by the Department. 6. Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause offsite damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. Furthermore, a minimum twenty (20) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of the overburden slope and a 15 foot wide bench shall be incorporated with every 25 feet of elevation change in overburden cut slopes. C. Hard rock slopes shall be, at a minimum, as indicated on the Pit Cross Sections dated Jaunary 20, 1989. 7. Surface Drainage The affected land shall be qraded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditchesorconduits shall be constructed or installed when required to prevent such conditions. 8. Blasting The operator shall provide to the Department a copy of the findings of any seismic studies conducted at this facility. The operator shall make every reasonable effort to incorporate the report's recommendations into the production blasting program. The following blasting conditions shall be observed by the operator to prevent hazard to persons and adjacent property from thrown rock or vibrations: A. in all blasting operations, except as hereinafter otherwise provided, the maximum peak particle velocity of any component of ground motion shall not exceed 1 inch per second at the immediate location of any building outside of the permitted area regularly occupied by human beings such as dwelling house, church, school, public building, or commercial or institutional building outside of the permitted area. The operator shall monitor each blast with a seismograph. B. Airblast overpressure shall not exceed 128 decibels linear (dBL) as measured at the immediate location of any regularly occupied building such as any dwelling house, church, school, public building, or commerclai or institutional building. C. The operator shall take all reasonable precautions to insure that flyrock i�s not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Should flyrock occur beyond the guarded area or the levels in Items A and B above are exceeded, the operator shall report the incident to the Department immediately and further use of explosive at the site shall be immediately suspended until the following actions have been taken: 1. A thorough investigation as to the cause(s) of the incident shall be conducted. 9 Page 6 of 9 2. A satisfactory report detailing the investigation shall be provided to the Department within 10 days of the incident. Said report shall, at a minimum, document the cause(s) of the incident along with technical and management actions that will be taken to prevent further incidents. The report shall meet with the approval of the Department before blasting may resume at the site. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of this permit. D. The operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; and blast location. Records shall be maintained at the permittee's mine office and copies shall �e provided to the Department upon request. E. The operator shall, when requested by the Department, give 24 hour advance notice to the Land Quality Section prior to any blast during a period for which notice is requested. High Wall_Barrier A. A physical barrier consisting of a six (6) feet high chainlink fence with three strands of barbed wire shall be maintained at all times around the perimeter of any highwall to prevent inadvertent public access. In addition, a minimum twenty (20) foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of the overburden cut slope. B. Warning signs shall be posted around the perimeter of the operation at a minimum of a 100 yard spacing. 10. Visual Screening A. Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be employed as deemed appropriate by the Department. B. Berms shall be located and constructed as shown on the Site Plan dated January 23, 1989 and revised June 20, 1989. Construction of all berms shall be completed within one (1) year of the start of quarrying activities. In addition to grasses, loblolly and/or Virginia pines shall be planted as deemed appropriate by the Department to improve visual and noise buffering. Page 7 of 9 11. Plan Modification The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit. Approval to implement such changes must be obtained from_. the Department prior to on -site implementation of the revisions. 12. Refuse Disposal A. No on -site disposal of refuse or other solid waste that are generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Solid Waste Management and the Land Quality Section, Department of Environment, Health and Natural Resources. The method of disposal shall be consistent with the approved reclamation.plan. B. Refuse generated en -site and directly associated with the mining activity such as drill steel, conveyor belting, screen cloth and cable may be disposed of in a designated refuse area. Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 14.. Bonding The security which was posted pursuant to N.C.G.S. 74-54 in the form of a $25,000.00 blanket bond is sufficient to cover the operation as indicated on the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. Archaeological Resources Authorized representatives of the Division of Archives and History shall be granted access - to the site to determine the presence of significant arrhaeologiral re,,nlirrac _ Page S of 9 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 I. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, likely to become noxious, odious or foul. S.
