The modification is to include the addition of 10.2 acres of adjacent land and the construction of a berm with associated erosion and sediment control measures as indicated on the Sediment and Erosion Control Plan, Reidsville - Berm Addition (11.X 17 inch 'sheet) dated October 6, 1993 and the Mine Map last revised October 7, 1993. A copy of the modified permit is enclosed. The conditions in the modified permit were based primarily upon the initial application. Modifications were made as indicated by the modification request and as required to insure compliance with The Mining Act of 1971. The expiration date, mine name and permit number shall remain the same as before the modification. I would like to draw your particular attention to Operating Conditions No. 4.F. of the modified permit. The issuance of a mining permit and/or any modification to it does not supersede local, zoning regulations. The responsibility of compliance with any applicable zoning regulations lies with you. As a reminder, your permitted acreage at this site is 192.2 acres and the amount of land you are allowed to disturb at any- one time is 135.2 acres. MINING PERMIT EXPIRATION DATE: December-142002 Page 2 of 11 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment, Health and Natural Resources hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation; by virtue of a sale, lease, assignment or otherwise,'the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to'the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is -not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may'give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context_ clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Modifications December 14, 1992: This permit has been modified to include and allow the construction of the berm and associated sediment and erosion control measures as indicated on.the Mine Map Erosion Control Inserts "A" & "B" dated October 29, 1991 and revised October b, 1992. This modification also increases the permitted acreage to 182 acres as indicated on the Mine Map dated February 3, 1987 and revised October 13, 1992. Page 3 of 11 December--3,- 1993: This permit has been modified to include 10.2 acres of adjacent land and to.allow the construction of a berm, with associated erosion and sediment control measures as indicated on the Sediment and Erosion Control Plan, Reidsville - Berm Addition (11 X 17 inch sheet) dated October 6, 1993 and the Mine Map last revised October 7, 1993. ExpirationDate This permit shall be effective from the date of its issuance until December 14, 2002. Conditions This Permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: OPERATING CONDITIONS: 1. Wastewater and Quarry „Dewatering A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Water Quality Section, Division of Environmental Management, to secure any necessary stormwater permits or other approval documents. 2. Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the.requirements and rules promulgated by the N.C. Environmental Management Commission.. B., During quarry operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area.' 3. Buffer Zones A. Any mining activity affecting wetlands shall be in accordance with the requirements and regulations promulgated by the U.S. Army Corps of Engineers. Page 4 of 11 M B. Sufficient buffer shall be maintained between any affected land and any adjoining waterway to prevent sedimentation of that waterway from erosion of the affected land and to preserve the integrity of the natural watercourse. C. The buffer zones shown on the Mine Map dated February 3, 1987 and last revised October 7, 1993 shall be maintained to prevent caving of any adjoining property and to allow grading of the side slopes to the required angle. These buffer zones,.with the exception of the installation of required sediment control measures and earthen berms, shall remain undisturbed: Erosion and Sediment Control A. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, brush barriers, silt check darns, silt retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in proximity to the affected land. B. The Mine Map, dated February 3, 1987 and revised October 13, 1992 and the Erosion Control Inserts "A" & "B" dated October 29, 1991 and revised October 6, 1992 shall be followed. C. The sediment basin'at the southern end of the proposed berm (insert "B") with the dimensions of 641L X 301W x 31© shall be located upgradient (northern side) of the outlet channel to the existing pond. A. The channel below the 36" culvert in insert "A" shall be provided with an appropriate temporary lining at time of final stabilization. E. Slope drains shall be added, as necessary, to safely convey surface water run-off down the side slopes of all proposed earthen berms. F. The Sediment and Erosion Control Plan, Reidsville - Berm Addition (11 X 17 inch sheet) dated October 6, 1993 shall be followed for the proposed berm addition indicated on the Mine Map last revised October 7, 1993. Page 5 of 11 G. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the approved application for renewal of this mining permit and any approved revisions to it. Such areas include, but are not limited to, expansion outside of the initial pit area, creek crossings, or expansion of overburden disposal areas. 5. Groundwater Protection A. Groundwater observation wells shall be installed as indicated on the Mine Map dated February 3, 1987 and revised October 13, 1992. B. The observation wells shall be drilled wells cased into consolidated rock and grouted to the surface. The wells (boreholes) shall be extended at least 50 feet below static water level, or at least 50 feet into unweathered rock, whichever is deeper. The wells shall be secured against unauthorized entry with a lockable cap. The necessary permits to construct these wells shall be obtained from the N.C. Division of Environmental Management, Groundwater Section. C. The observation wells shall be monitored twice a year (biannually). The static water level shall be measured with an accuracy of plus or minus 0.1 foot and shall be referenced to a datum point and a record of the water level maintained. The results of these observations shall be provided to the Winston-Salem Regional Office, Groundwater Section. D. Additional groundwater monitoring wells shall be installed and/or monitoring schedules may be changed as deemed appropriate by the department. 6. Graded Slopes and Fills The angle for graded slopes and fills shall be no greater than the angle which cah be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause offsite damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. 7. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. Page 6 of 11 8. Blasting The operator shall provide to the Department a copy of the .findings of any seismic studies conducted at this facility. The operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. The following blasting conditions shall be observed by the operator to prevent hazard to persons and adjacent property from thrown rock or vibrations: A. In all.blasting operations, except as hereinafter otherwise provided, the maximum peak particle velocity of any component of ground motion shall not exceed 1 inch per second at the immediate location of any building outside of the permitted-area'regularly occupied by human beings such as dwelling house, church, school, -public building, or commercial or institutional building outside of -the permitted area. The operator shall monitor each blast with a seismograph. B. - Airblast overpressure shall not exceed 128 decibels linear (DBL) as measured at the immediate location of any regularly occupied building such as any dwelling house, church, school, public building, or commercial or institutional building. C. The operator shall take all reasonable precautions to insure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Should flyrock occur beyond the guarded area or the levels in Items A and B above are exceeded, the operator shall report the incident to the Department immediately and further use of explosive at the site shall be immediately suspended until the following actions have been taken: 1. A thorough investigation'as to the cause(s) of the incident shall be conducted. 2. A satisfactory report detailing the investigation shall be provided to the Department within 10 days of the incident. Said report shall, at a minimum, document the cause(s) of the incident along with technical and management actions that will -be taken to prevent further incidents. The report shall meet with the approval of the Department before blasting may resume at the site. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of this permit. Page 7 of 11 D. The operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of•explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; and blast location. Records shall -be maintained at the permittee's mine office and copies shall be provided to the Department upon request. E. The operator shall, when requested by the Department, give 24 hour advance notice to the Land Quality Section prior to any blast during a period for which notice is requested. 9. High Wall Barrier A physical barrier consisting of large boulders placed end - to -end or fencing shall be maintained at all times around the perimeter of any highwall to prevent inadvertent -public access. In addition, a minimum 10 foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of the overburden cut slope. 10. Visual Screening A. Existing vegetation shall be maintained between the mine and,public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be employed as deemed appropriate by the Department. B. Berms shall be located and constructed as shown on the Mine Map dated February 3, 1987 and last revised October 7, 1993. In addition to grasses, loblolly pines and Leyland Cypress shall be planted as deemed appropriate by the Department to improve visual and noise buffering. 11. Plan -Modification The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part -•of the mining, reclamation, or erosion/sediment control plan contained in the approved application for renewal of this mining permit and any approved revisions to it. Approval to implement such changes must be obtained from.the Department prior to on -site implementation of the revisions. Page 8 of 11 12. 13. 14. Refuse Disoosal A. No on -site disposal of refuse or other solid waste that are generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization -to conduct said disposal has first been obtained from both the Division of Solid Waste Management and the Land Quality Section, Department of Environment, Health and Natural Resources. The method of disposal shall be..consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Solid Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that maybe considered hazardous shall be disposed of within the permitted area. Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. Bonding The security which was posted pursuant to N.C.G.S. 74-54 in the form of a $251'000.00 Blanket Bond is sufficient to cover the operation as indicated on the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. Archaeological Resources Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. Page 9 of 11 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum_ Standards As Provided By G_.S.74-53 1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as'to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations -in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, likely to become noxious, odiousor foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be'conducted according to the time schedule included in -the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations -and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: 1. Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with water, provide a permanent barricade (fence) along the top of any highwall, and grade and revegetate any areas in unconsolidated material. Page 10 of it 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. All areas of unconsolidated material such as overburden or waste piles shall be graded to a 2 horizontal to 1 vertical or flatter slope and terraced as necessary to insure slope stability. B. Any.settling ponds and sediment control basins shall be backfilled, graded,. and stabilized or cleaned out and made into acceptable lake areas. C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation. E. No contaminants shall be permanently disposed of at the mine site. On -site disposal of waste shall be in accordance with Operating Condition 12A and B. F. The affected land shall be graded to prevent the collection of noxious or foul water. 3. Revegetation Plan: Disturbed areas shall be permanently revegetated according to the Revegetation Plan prepared by Ms. Carole Cameron dated December 13, 1991 with the stipulation that Ladino clover shall be added to the seeding mixture at a rate of 5 pounds per acre and Virgina pines shall be deleted from the vegetation plan. Page. 11 of 11 Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. This permit, issued October 24, 1974, renewed May 18, 1982, and renewed and modified December 14, 1992, is hereby modified this 3rd day of December, 1993 pursuant to G.S_ 74- 52. By: /�(Z' Charles H. The spillway dimensions which we are using for our sediment traps are values taken directly from Table 6.60a in the North Carolina Sediment Control Planning and Design Manual. No additional calculations should he required. Additionally, the diversion ditches to each of the basins will be grass lined according to the previously submitted seeding schedule. 2) The north eastern. most corner of the proposed berm has been adjusted to allow for the drainage to flow through the diversion to trap number 4. Grading will be done as necessary to insure that runoff is not allowed to collect. 3) The Sediment Basin cross section has been revised to indicate that the core of the rock dam will be constructed of #1 rip rap and that the total top width is 6 feet. Furthermore, calculations for the diversion ditches have not been submitted to this office. How do you intend to stabilize the diversion ditches? 2) It appears that drainage will have to flow uphill around the berm at the north eastern -most corner of the proposed berm before flowing into the diversion draining to trap no. 4. Pools of stagnant water cannot be created by the construction of this berm. How do you intend to address the off -site drainage? 3) The cross-section through the sediment trap dam should be revised to indicate that the core of the rock dam is constructed of "#1 rip rap" and that the, total top width shall be 6 feet. 4 ) The proposed buffer around the berm is 30 feet. However, the width of trap no. 6 is 35 feet. It appears that installation of trap no. 6 as designed is not feasible. The following comments are offered: (1) Sediment trap detail needs to show a minimum rip rap outlet size of 5' thick at crest instead of 2' thick. (2) 30' buffer should be left undisturbed and then diversion ditch installed. (3) All sediment traps are sized for disturbed area, not total drainage.area. To attain adequate settling efficiency, measures should have a surface area of .01 + cfs to basin. This information has not been provided. Basins 4, 5 and 6 could be undersized using this criteria. (4) The diversion on the far end of the proposed berm has water running up hill 101 at the end of the berm before it drains to basin #4. The beret should be shortened at the end to avoid the valley or they need to pipe the water under the berm. Our comments are provided in accordance with provisions of the N.C. Mining Act of 1971,(G.S. 74-46 through 74-68, 15 NCAC 5; as amended, 1982). The area where the new berm is to be constructed is open pasture and fallow field. It appears that the berm area will have little if any impact on woodland. There is an old wetland area adjacent to this berm location site that could be impacted by construction or future mining. It is not clear from the plan if this area would be impacted. The old pond area is probably a former beaver pond. This should be checked as to use of this area under the current mining permit. We do not expect significant impacts to fisheries or wildlife resources from activities associated with mining at this site. We are concerned with the potential loss of wetlands. MINING PERMIT EXPIRATION DATE: December 14, 2002 Page 2 of 11 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment, Health and Natural Resources hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the.permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or, other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted -mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Modifications December 14, 1992: This permit has been modified to include and allow the construction of the berm and associated sediment and erosion control measures as indicated on the Mine Map Erosion Control Inserts "A" & "B" dated October 29, 1991 and revised October 5, 1992. This modification also increases the permitted acreage to 182 acres asindicated on the Mine Map dated February 3, 1987 and revised October 13, 1992. Page 3 of 11 Expiration Date This permit shall be effective from the date of its issuance until December 14, 2002. Conditions This Permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: OPERATING CONDITIONS: 1. Wastewater and Quarry Dewatering A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Water Quality Section, Division of Environmental Management, to secure any necessary stormwater permits or other approval documents. 2. Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission. B. During quarry operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. Buffer Zones A. Any mining activity affecting wetlands shall be in accordance with the requirements and regulations promulgated by the U.S. Army Corps of Engineers. B. Sufficient buffer shall be maintained between any affected land and any adjoining waterway to prevent sedimentation of that waterway from erosion of the affected land and to preserve the integrity of the natural watercourse. Page 4 of 11 C. The buffer zones shown on the Mine Map dated February 3, 1987 and revised October 13, 1992 shall be maintained to prevent caving of any adjoining property and to allow grading of the side slopes to the required angle. These buffer zones, with the exception of the installation of required sediment control measures and earthen berms, shall remain undisturbed. 4. Erosion and Sediment Control A. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, brush barriers, silt check dams, silt retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in"proximity to the affected land. B. The Mine Map, dated February 3, 1987 and revised October 13, 1992 and the Erosion Control In "A" & "B" dated October 29, 1991 and revised October 6, 1992 shall be followed. C. The sediment basin at the southern end of the proposed berm (insert "B") with the dimensions of 6011L X 30% X 31D shall be located upgradient (northern side) of the outlet channel to the existing pond. D. The channel below the 36" culvert in insert "A" shall be provided with an appropriate temporary lining at time of final stabilization. E. Slope drains shall be added, as necessary, to safely convey surface water run-off down the side slopes of the proposed earthen berm. F. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the approved application for renewal of this mining permit. Such areas include, but -are not limited to, expansion outside of the initial pit area, creek crossings, or expansion of overburden disposal areas. Page 5 of 11 5. Groundwater Protection A. Groundwater observation wells shall be installed as indicated on the Mine Map dated February 3, 1987 and revised October 13, 1992. B. The observation wells shall be drilled wells cased into consolidated rock and grouted to the surface. The wells (boreholes) shall be extended at least 50 feet below static water level, or at least 50 feet into unweathered rock, whichever is deeper. The wells shall be secured against unauthorized entry with a lockable cap. The necessary permits,to construct these wells shall be obtained from the N.C. Division of Environmental Management, Groundwater Section. C. The observation wells shall be mo-nitored twice a year (biannually). The static water level shall be measured with an accuracy of plus or minus 0.1 foot and shall be referenced to a datum point and a record of ,the water level maintained. The results of these observations shall be provided to the Winston-Salem Regional Office, Groundwater Section. D. Additional groundwater monitoring wells shall be installed and/or monitoring schedules may be changed as deemed appropriate by the department. 6. Graded Slopes and Fills The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause offsite damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. 7. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. Page 6 of 11 8. Blasting The operator shall provide to the Department a copy of the findings of any seismic studies conducted at this facility. The operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. The following blasting conditions shall be observed by the operator to prevent hazard to persons and adjacent property from thrown rock or vibrations: A. In all blasting operations, except as hereinafter otherwise provided, the maximum peak particle velocity of any component of ground motion shall not exceed-1 inch per second at the immediate location of any building outside of the permitted area regularly occupied by human beings such as dwelling house, church, school, public building, or commercial or institutional building outside of the permitted area. The operator shall monitor each blast with a seismograph. B. Airblast overpressure shall not exceed 128 decibels linear (DBL) as measured at the immediate location of any regularly occupied building such as any dwelling house, church, school, public building, or commercial or institutional building. C. The operator shall take all reasonable precautions to insure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Should flyrock occur beyond the guarded area or the levels in Items A and B above are exceeded, the operator shall report the incident to the Department immediately and further use of explosive at the site shall be immediately suspended until the following actions have been taken: 1. A thorough investigation as to the cause(s) of the incident shall be conducted. 2. A satisfactory report detailing the investigation shall be provided to the Department within 10 days of the incident. Said report shall, at a minimum, document the cause(s) of the incident along with technical and management actions that will be taken to prevent further incidents. The report shall meet with the approval of the Department before blasting may resume at the site. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of this permit. Page 7 of 11 D. The operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; and blast location. Records shall be maintained at the permittee's mine office and copies shall be provided to the Department upon request. E. The operator shall, when requested by the Department, give 24 hour advance notice to the Land Quality Section prior to any blast during a period for which notice is requested. 9. High Wall Barrier A physical barrier consisting of large boulders placed end - to -end or fencing shall be maintained at all times around the perimeter of any highwall to prevent inadvertent public access. In addition, a minimum 10 foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of the overburden cut slope. 10. Visual Screening A. Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be employed as deemed appropriate by the Department. B. Berms shall be located and constructed as shown on the Mine Map dated February 3, 1987 and revised October 13, 1992. In addition to grasses, loblolly pines and Leyland Cypress shall be planted as deemed appropriate by the Department to improve visual and noise buffering. 11. Plan Modification The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for renewal of this mining permit. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. Page 8 of 11 12. 13. 14. Refuse Disposal A. No on -site disposal of refuse or other solid waste that are generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Solid Waste Management and the Land Quality Section, Department of Environment, Health and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposak facility approved by the Division of Solid Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that maybe considered hazardous shall be disposed of within the permitted area. Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. Bonding The security which was posted pursuant to N.C.G.S. 74-54 in the form of a $25,000.00 Blanket Bond is sufficient to cover the operation as indicated on the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. Archaeological Resources Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. Page 9 of 11 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided_By_G._S_._ 74-53 1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as tofminimize the possibility of slides and be consistent with the Future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: 1. Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with water, provide a permanent barricade (fence) along the top of any highwall, and grade and revegetate any areas in unconsolidated material. Page 10 of 11 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. All areas of unconsolidated material such as overburden or waste piles shall be graded to a 2 horizontal to 1 vertical or flatter slope and terraced as necessary to insure slope stability. B. Any settling ponds and sediment control basins shall be backfilled, graded, and stabilized or cleaned out and made into acceptable lake areas. C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced,-subsoiled or otherwise prepared before revegetation. E. No contaminants shall be permanently disposed of at the - mine site. On -site disposal of waste shall be in accordance with Operating Condition 12A and B. F. The affected land shall be graded to prevent the collection of noxious or foul water. 3. Reveaetation Plan: Disturbed areas shall be permanently revegetated according to the Revegetation Plan prepared by Ms. Carole Cameron dated December 13, 1991 with the stipulation that Ladino clover shall be added to the seeding mixture at a rate of 5 pounds per acre and Virgina pines shall be deleted from the vegetation plan. Page 11 of 11 Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. The channel at the northeast corner of the pit was re-evaluated to ensure stability during the 2S-year storm. According to the revised Mine Map and Insert sheet, flow from the existing pond in the future reserve area north of the pit will be carried in a 36" diameter corrugated metal pipe and will outlet into a channel which will run along the eastern edge of the pit. The 36" pipe will carry approximately 70 cubic feet per second (cfs). Overflow from the pond will go into the pit. Once additional storage is available, water from the pit will be pumped into the make-up water pond and will leave the site via the 36" pipe and channel. This revision was discussed with you on October 1, 1992 by Lisa Beard of Wm. Daniel & Associates. Design Calculations are attached. • • 2. (1) The temporary diversions along the proposed berm southeast of the present pit have not been designed correctly. (a) Calculations indicate 1% grade when sections of the existing grade are steeper than that. Design should be for worst condition. (b) The division along the property line would need to run up hill or involve significant cut to be constructed as shown. (c) The division on the northeast side does not outlet into any sediment control device (2) How can an undisturbed buffer be disturbed (see note on top sheet)? 0 -2- (3) Calculations refer to sediment basin at addition to existing berm - which is it? If it is the large basin at the end of the channel, it needs to be designed for total drainage area contributing and not just the disturbed area. (4) Diversion ditches in cleared pit are again not designed for the lay of the land. It would appear that they picked numbers that work, not what exists. (5) It would seem that most of our comments from our January 10, 1992 memo still apply as do your comments in your letter of February 7, 1992 to MMA. This is not permitable as is presently presented. The following additional information is needed to complete our review: 1) Additional sediment and erosion control information is needed for the construction of the proposed berms. It appears that some of..the temporary diversion ditches are outletting into areas that do not have sediment and erosion control measures proposed. 'All diversion ditches must outlet into a sediment control measure until final stabilization of the diversion has been accomplished. Design computations for the diversions and sediment basins must be offered. Diversions and basin spillways must be designed for the 10 year storm if they are to remain in place and functioning for one year or less. If they are to function for more than one year, they must be designed based upon.the 25 year storm event. Also, silt fencing is an unacceptable sediment control in areas of concentrated flow such as creeks. Please provide some other sediment control'for the creek below the existing sediment basin and rock check dam. Is there any disturbance below the outlet of the existing sediment basin?, Furthermore, the design of the permanent diversion channel is # F questionable. This section checked the design and -found that the channels may be too steep to be stable even with rip rap. Please reevaluate the channel design, focussing on reducing the depth of flow and the channel gradient. Also, what do the dashed lines with 'ri-'s" and "F's" mean? Reidsville Quarry Mining Permit No. 79-06 - Rockingham County, North Carolina The subject document was reviewed by biologists on our staff and a site visit was made to the Reidsville Quarry on January 17, 1992 for the purpose of assessing mining impacts of granite on fish and wildlife resources on the site. Our comments are provided in accordance with certain provisions of the Mining Act of 1971 as amended. Martin Marietta proposes to expand the open pit area of their granite mine operation in order to reach more mineable material. The proposed expansion will involve the removal of surface vegetation and soils, but will not prove detrimental to wildlife species currently utilizing the area. Mining buffer areas, including haul road borders, sediment basin edges and erosion controlling berms are well vegetated and provide some habitat for white-tailed deer, fox, rabbits and songbirds. Raptors are also likely to use the area for foraging. Virginia Pine was well established on the site, and was encroaching (due to land disturbance) into areas formerly dominated by hardwood species. The North Carolina Wildlife Resources Commission (NCWRC) does not object to the issuing of a mining permit renewal for Martin Marietta Aggregates Reidsville Quarry, but does offer the following recommendations: r1 1) The seeding mixture submitted as part of the revegetation plan should be amended to include Ladino or White clover. This seed can be incorporated into the mix and planted successfully at the rate of 5 lbs/acre. The seed should be sown from August 25 to September 15 or from March 1 to 31. 2) Due to the extensive and invasive stands of Virginia Pine observed on this site, NCWRC recommends that this species be dropped from the revegetation plan. Given the Virginia Pine seed source located on this site, any land disturbing activity will result in their sprouting. An alternative species which offers wildlife some food and cover and is likely to perform well on the observed poor soils is red -cedar (Juniperus virginiana). We recommend that this species be considered for revegetation efforts. Lastly, NCWRC is greatly interested in working with the mining community to examine and evaluate the success of different reclamation and revegetation efforts. Ms. Carole Cameron, Landscape Specialist with Martin Marietta has indicated a desire to work with NCWRC on different reclamation efforts (eq., hardwood plantings, erosion control seeding mixes). If yes, briefly describe the nature of the discharge and locate all proposed discharge points on your mine map. The mine discharge is made up of stormwater that collects in the pit area. Most of this water falls directly into the pit; the remainder comes from area drainage and some ground- water seepage. All of these waters flow into a pit sump for clarification. This water is then pumped out of the pit as required. The discharge is covered by an NPDES permit which requires sampling. c. If you answered yes to either la or lb, provide evidence that you have applied for or obtained a water quality permit from the Division of Environmental Management, Water Quality Section. How wide a buffer will be maintained between any mining activity and any adjoining property or highway right-of-way? Show all buffers on mine map(s). Buffers between the mining operation and adjacent properties will be sufficient to provide adequate screening consisting of trees, existing topoggraphy and earthen berms. Buffers are shown on the attached mine map dated April 9, 141. b. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling house, public road, public, commercial or industrial building from any mine excavation. Locate all such structures on the mine map if they are within 300 feet of any proposed excavation. The mine excavation will not extend close enough to the property boundaries to cause any physical damage. AN quarry shots are designed to prevent excessive vibrations. Seis- mograph recordings are made when deemed necessary. The quarry shots are scheduled normally about mid -day and will be observed by our neighbors as distant thunder lasting less than a second. This minor event normally occurs one to three times a week, depending upon production requirements. The structures are on the mine map. -5- APPLICATION FOR A MINING PERMIT 5. Describe specific erosion control measures to be taken during mining to prevent offsite sedimentation (include specific plans for erosion control for mine excavation(s), waste piles, access/mine roads and process areas), and give a detailed sequence of installation. Locate and label all erosion and sediment control measures on the mine map. Engineering designs and calculations shall be required when needed to justify the adequacy of any proposed measures. Location of erosion control structures are included on the mine map. 6. a. Describe methods to prevent landslide or slope instability adjacent to adjoining properties during mining. The mine excavation will not extend close enough to the property boundaries to cause any landslides or slope instability. b. In excavations of unconsolidated (non -rock) materials, specify the angle of all slopes including specifications for benching and sloping. Final excavation slopes of unconsolidated materials will be 2:1. Where the height of a cut face warrants, a bench will be cut to slope toward the face of cut and draining to the pit excavation. c. In hardrock excavations, specify proposed bench widths and heights in feet. Bench widths vary from 20' - 100'. The average height is 40'. APPLICATION FOR A MINING PERMIT 7. Describe specific plans (including a schedule of implementation) for screening the operation from public view such as maintaining or planting trees, bushes or other vegetation, building berms or other measures. Show the location of all visual screening on the mine map and provide cross -sections through all proposed berms. Existing trees, terrain, and berms will effectively screen our operations from nearby roads or homes. Trees and vegetation will be planted on the berms and in such areas as will promote future long-term screening and soil stability. 9. Will explosives be used? Yes X No . The principal explosive material is ammonium nitrate, commonly used as fertilizer. A shot pattern is used that minimizes the air and ground vibrations and provides the best rock breakage. Energy expended in excessair blast or ground vibration is wasted energy and it is our intent to develop the most efficient blasting procedures possible. Shots will normally occur from one to three times a week and will be observed as distant thunder lasting less than a second. Permanent records are maintained on each shot which indicate the shot pattern, loading, delays, time, weather and all other pertinent data. -7- APPLICATION FOR A MINING PERMIT 10. a. The close proximity of the rock to the surface of the ground and the low level of permeability of the rock in the quarry area indicate that quarry development will have no detrimental impact on any wells in the area. Experience over the years has shown that wells bordering many granite pit excavations have not been impacted. 11. Will fuel tanks, solvents, or other chemical reagents be stored on -site? Fuel oil, waste oil and gasoline are stored inside an approved containment structure that meets all required fire protection codes. Solvents are handled by an approved dealer such as Safety Kleen Corp. 5:2 APPLICATION FOR A MINING PERMIT D. RECLAMATION PLAN 1. Describe your intended plan for the reclamation and subsequent use of all affected lands and indicate the general methods to be used in reclaiming this land. This information must be illustrated on a reclamation map. Disturbed areas, berms, etc., will be revegetated in accordance with the seeding schedule as provided. The excavation itself will be allowed to fill with groundwater and could be utilized £or water storage, recreation, wildlife sanctuary or other uses. 2. a. Is an excavated or impounded body of water to be left as a part of the reclamation? Yes X No . If yes, illustrate the location of the body(s) of water on the reclamation map and provide a scaled cross-section(s) through the proposed body(s) of water. Will the body(s) of water be stocked with fish?Yes No X . If yes, specify species. The pit and supply lake will remain as permanent water storage use. The average depth of water in the pit will be determined by the ultimate depth of the pit at the time operations are terminated. The average depth of the supply lake will be approximately 12 feet. The stocking of fish will be left to the discretion of the landowner. b. Describe provisions for prevention of noxious, odious or foul water collecting or remaining in mined areas. Provide details on any permanent water outlets. Pit water is constantly "rolling over" due to temperature inversions between water layers. In APPLICATION FOR A MINING PERMIT RECLAMATION PLAN 3. Describe provisions for safety to persons and to adajoining property in all completed excavations in rock including what kind of permanent barricade will be left. The location of the barricade must be shown on the reclamation map. A perimeter fence will be placed around all excavations upon completion of the mining operation. 4. a. Indicate the method(s) of reclamation of overburden, refuse, spoil banks or other such on -site mine waste areas, including specifications for benching and sloping. Overburden will be utilized to construct screening berms. The berms will be vegetated and placed as reclaimed areas as soon as reclamation is completed. Overburden piles, refuse, spoil banks, or other mine waste areas existing at final reclamation will be graded and compacted to slopes of 2:1 or flatter and will be vegetated in accord with the attached seeding schedule. The areas will be graded to prevent pooling and stagnation of water and to control storm water runoff. Old or existing overburden piles that are adequately stabilized and vegetated will remain in their current configuration. b. Describe reclamation of processing facilities, stockpile areas, and on -site roadways. The plant and stockpiles will be removed from the site. The plant and stockpile area will be graded, scarified and revegetated in accord with the attached schedule. Further, on -site roadways not needed for future development of the site will also be graded, scarified and revegetated. Erosion control structures necessary to final reclamation will be cleaned out and placed in good working order. b. Will any on -site roadways be left as part of the reclamation? Yes X No If yes, identify these on the reclamation map and provide details on permanent ditch line stabilization. The main haul road and service roads will remain for vehicular access to the lake formed by the pit. These roads shall be stabilized while the quarry is active. The roads and their need for maintenance will be determined by the future use of the site after the operation has ceased. 6. State the method of reclamation of settling ponds and/or sediment control basins. The sediment control basin and the settling ponds will be drained, filled, graded and revegetated in accordance with the final reclamation plan as approved by the Division of Land Resources. -11- APPLICATION FOR A MINING PERMIT RECLAMATION PLAN 7. No off -site generated waste shall be disposed of on the mine site without prior written approval from the NC Department of Natural Resources and Community Development, Land Quality Section and either the NC Department of Human Resources or local governing body. Items such as drill steel, conveyor belting, screen cloth, cable, etc., will be covered by landfill. 8. Indicate the method of restoration or establishment of any permanent drainage channels to a condition minimizing erosion, siltation and other pollution. Give design details including typical cross -sections of any permanent channels to be constructed as part of the reclamation plan. Show the location(s) of all permanent channels on the reclamation map. Periodic overflow of pit will flow through existing vegetation prior to entering any adjacent waterway. -12- APPLICATION FOR A MINING PERMIT RECLAMATION PLAN 9. S. 74-46 through 68, "The Mining Act of 1971", Mining Permitting Regulation 15 N.C.A.C. 5B,.and other applicable laws, rules and regulations 0 Permission is hereby granted to: MARTIN MARIETTA ACGREGATES , permittee for the operation of a Cruolied Stone Quarry entitled, REIDSVILLE QUARRY , permit no. 79-6 and located in Rockingham County, which shall provide that the usefulness, productivity and scenic values of all lands and waters affected by this mining operation will receive the greatest practical degree of protection and restoration. 2 4f 6 In accordance with the application for this mining permit, which is hereby approved by the Department of Natural Resources & Community Development, here- inafter referred to as the Department, and in conformity with the approved Recla- mation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclmation Phan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise,the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and con- ditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Tlafinirinnc Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. r..nneii ri rims The permitted mining operation shall not violate standards of air quality, surface water quality, or ground water quality promulgated by the Environmental Management Commission. This permit shall be effective from the date of its issuance until May 18, 1992 and shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the following conditions and limitations: 3 of 6 1. Any wastewater processing or mine dewatering shall be in accordance with permit requirements and regulations promulgated by the Division of Environ- mental Management. 2. Any mining process producing air contaminant emissions shall be subject to the permitting requirements and regulations promulgated by the Division of Environmental Management. 3. Sufficient buffer shall, be maintained between any affected land and any adjoining waterway to prevent sedimentation of that waterway from erosion of the affected land and to preserve the integrity of the natural water- course. 4. Adequate mechanical barriers including but not limited to diversions, earthen dikes, brush barriers, silt check dams, silt retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in proximity to the affected land. 5. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetat:lve cover or other adequate erosion control measure, structure or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause offsite damage due to siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. 6. The affected land shall be graded so as to prevent collection of pools of water that are, or are likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 1. The following blasting conditions shall be observed by the operator to prevent hazard to persons and adjacent property from thrown rock or vibrationst A. In all blasting operations, except as hereinafter otherwise provided, the maximum peak particle velocity of any component of ground motion shall not exceed one inch per second at the immediate location of any building regularly occupied by human beings such as dwelling house, church, school, public building, or commercial or institutional building. B. Airblast overpressure shall not exceed 12B decibels linear (dBL)- warning, 132 dBL caution, and 135 dBL maximum as measured at the immediate location of any regularly occupied building such as any dwelling house, church, school, public building, or commercial or institutional building. 4 of 6 C. The aperaror shall take all reasonable precautions to insure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Should flyrock occur beyond the guarded area, it shall be reported to the Department immediately, who will conduct a thorough investigation to determine the cause. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of the permit. D. Operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes; depth of holes; total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; and blast location. Records shall be maintained at the per.mittee's mine office and copies shall be provided to the Department upon request. E. Operator shall, when requested by the Department, give 24 hour advance notice to the Land Quality Section prior to any blast during a period for which notice is requested. 8. Sufficient buffer shall be maintained 1;f-tween any excavation and any adjoining property line to prevent caving of that property and to allow grading of the sideslopes to the required angle. 9. A physical barrier consisting of a fence or boulder barriers, etc., shall be maintained around the perimeter of any quarry highwall. 10. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public throughfares whenever practical to screen the operati^n from public view. 11. An Annual Reclamation Report shall be submitted on a form supplied by the Department on February 1 of each year until reclamation is completed and approved. 12. The security which was posted pursuant to N.C.G.S. 74-54 in the form of $25,000.00 Blanket Bond is sufficient to cover the quarry operation as indicated on the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 5 of 6 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of -that Mining Permit. Additionally, the Reclamation Plan'is a separable obligation of the permittee, which continues beyond the term of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 1. The final slopes in all excavations in soil, sand, gravel and other uncon- solidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the lai,4. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or are likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the N.C. Agricultural Experiment Station and the N.C. Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, initiation of reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS 1. Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with ground water, barricade along the top of any highwall, and grade and revegetate any areas in unconsolidated material. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. A physical barrier consisting of a fence or boulder barriers, etc., shall be maintained around the perimeter of any quarry highwall. B. Any cut or fill slopes in overburden or other unconsolidated material shall be graded to a 2 horizontal to 1 vertical grade or flatter and terraced as necessary to insure slope stability. 6of 6 C. The stockpile, office and process plant areas shall be graded and smoothed. D. Any settling ponds or sediment basins shall either be backfilled and stabilized or cleaned out and made into lake areas. E. No contaminants shall be dumped at the mine site. Scrap metal, trash or other such waste shall be removed from the site and properly disposed. F. The affected land shall be graded to prevent the collection of noxious or foul water. G. Any excavated, diverted, or disturbed natural channels shall be stabilized. 3. Revegetation Plan A ground cover of grasses or legumes shall be established on affected areas such as earth berms, dikes, dams, and abandoned stripped areas, processing areas, and spoil piles, using Sericea lespedeza; Love grass, fescue, rye or a combination of several of the above. Lime and fertilizer will be applied as indicated by soil test results. Virginia or Loblolly pines will be planted on affected areas along with the grasses and legumes. Nursery grown seedlings will be planted at a spacing to yield approximately 1000 trees per acre. As an alternative to the above revegetation plan, a revised plan consistent with current technology may be submittedto the Department for approval. 4. Reclamation Schedule Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. We are bounded on the north, east, and south by land owned by our lessors. The perimeter of the excavation is protedted by dense woods, an earth berm, and fences. We have been in.operation here for many years with no damage to adjacent properties. 3. Other mining refuge, including waste rock, is incorporated in spoils piles or in the construction of protective berms. 8. Indicate the method of restoration or establishment of stream channels and stream beds to a condition minimizing erosion, siltation and other pollution: Any ditch required to divert a stream for pit expansion will be constructed according to sound engineering practices so as to minimize erosion, siltation and other pollution during the quarry- ing operation and after the operation has been abandoned. 9. Describe provisions for prevention of noxious, odious or foul water collecting or remaining in mined areas. The nature of our alining operation produces an excavation well below the natural stream elevations, thus our abandoned pits will become fresh water ponds discharging clean water do�.T.stream. 10. Describe how the surface gradient in unconsolidated materials will be re- stored to a condition suitable for the proposed subsequent use of the land after reclamation is completed and proposed method of accomplishment: This mining operation disturbs a relatively small portion of the total land owned or leased. Any unconsolidated materials removed to start an excavation on to expand an existing one will be left at a final slope angle consistent with the material. Describe your plan for revegetation or other surface treatment of the affected areas. Note requirement of Regulation Number 1. The affected land as outlined in this ermit and shown on the attached map is expected to be in use Beyond the maximum permissible permit period. In the past it has been our policy to establish ground cover of grasses and/or trees on earth _ berms, dikes, and dams as soon as practical after construction; and on spoils piles no longerinuse. For the purposes of this mining permit we plan to use the following methods to establish vegetation on affected lands subject to erosion: 1. Slopes in unconsolidated material will be kept at an angle consistent with the nature of the material so that the possibility of erosion is minimized and so "that"revegetation is feasible. 2. A ground cover of grasses or legumes will be established on affected areas such as earth berms, dikes, dams, and abandoned stripped areas and spoils piles. We expect to use sericea lespedeza, love grass, %r fescue, rye, or a combination of several of the above. - Lime and fertilizer will be applied as indicated by soil test results. I j. Virginia or Loblolly pines will be planted where necessary on affected areas along with the grasses and legumes. Nursery groom seedlings will be planted at a spacing to yield approximately 1000 trees per acre. 4. It has been our practice in the past to employ pro- fessional landscape contractors and tree planting contractors to establish a suitable ground cover on land subject to erosion and to improve the looks of the operation as a whole; this practice will continue.. Reidsville Quarry (i79-6) - This quarry in Rockingham County was inspected on May 13, 1982 and appeared to be in compliance with the provisions of your mining permit. 2. Jamestown quarry (p41-4) - This quarry in Guilford County was inspected on May 12, 1982. Except for the need for additional atone in the rock filter below the soil borrow site on the south aide, the mine appeared to be in compliance with the provisions of your mining permit. 3. Pomona Quarry (BS1-4) - On May 12, 1982 this quarry in Guilford County was inspected. Other than the need for additional atone in the dam breach the mine appeared to be in compliance with the provisions of your mining permit, 4. Hicone Quarry (R41-6) - This quarry was inspected on May 18, 1982. This inspection found that the problems noted in previous let�:!rs and meetings with Martin Marietta personnel have 'sen corrected. There were a few cables, rubber and other scrap metal showing on the ground which will have to be removed before the mine is considered reclaimed.
