The Dunn Mine located in Jones County does not appear to have an unduly adverse effect on ground water supplies since there is no dewatering proposed on site. However, if the mine starts to withdraw 10,000 gpd to 100,000 grind of water, they will need to register their water withdrawals and if this mine starts to withdraw 100,000 gpd or more of water, they will need to obtain a CCPCUA permit. . A Central Coastal Plain Capacity Use Area (CCPCUA) permit must be obtained from the Division of Water Resources if the withdrawal exceeds 100.000 gallons per day and occurs in Beaufort, Carteret, Craven, Duplin, Edgecombe, Greene, Jones, Lenoir, Martin, Onslow, Pamlico, Pitt, Washington, Wayne, or Wilson County. Box 13381 New Bern, North Carolina 28561 Re. Dunn Mine Jones County Neuse River Basin Dear Mr. Dunn: Your application for a mining permit for the above referenced mine site has been reviewed. Enclosed is a draft of the mining permit proposed by the Department. The conditions in the draft permit were based primarily upon information supplied in your application with conditions added if necessary to ensure compliance with The Mining Act of 1971. The reclamation bond calculation worksheet submitted with the application has been verified. The bond amount for this site is $17,400.00 For your convenience, I have enclosed a bond form, an assignment of a savings account form and an irrevocable standby letter of credit form. The name on the security form must be the ' same as the name appearing on the enclosed draft permit, i.e., Gene Dunn Construction Company of New Bern, Inc. In addition to one of these alternatives you may, upon request, substitute a cash deposit. Please review the draft permit and the reclamation bond worksheet and contact this office should you have any objection or question concerning the permit conditions. G.S. 74-51 provides the operator 60 days following the mailing of application approval notice in which to file the required surety. The permit will be issued when the required security has been received. No mining may be conducted until the permit is issued. G.S. 74-65 states that the issuance of a mining permit does not supersede local zoning regulations. The responsibility of compliance with any applicable zoning regulations lies with you. A. GENERAL CHARACTERISTICS OF THE MINE B. Maps 1. (a.) On the application the second part of the question, of the total acreage, how much is owned and how much is leased ? is left blank. On the mine map it is indicated that Mr. Robert E. Dunn now or formerly owns the land on which the proposed mine is located on. 2. The application does not include the name of the appropriate quadrangle. Trenton, N.C. is the appropriate quadrangle name. 2. (n) No 100 year floodplain limit or wetland boundaries are indicated on the map. 0 o Floyd Williams July 7, 1998 Page 2 C. PROTECTION OF NATURAL RESOURCES 5. (a.) The question of how wide a buffer will be maintained between any mining activity and any adjoining permit boundary or right-of-way ?, was not properly answered. Just describing how far a property or right -of way is from the mine area does not state how wide a buffer will be maintained between them. 1). RECLAMATION PLAN 2. (a.) No answer was given as to if an excavated or impounded body of water is to be left as a part of the reclamation, even though it is indicated that it will be stocked with bass and bream, 10, SEED TYPES Rye grass is listed on the proposed mine application as a recommended seed type for revegetation Rye grass is not accepted as an appropriate seed type by the Land Quality Section. OTHER VEGETATIVE COVERS Rye grass is listed on the proposed mine application as a recommended seed type for revegetation . Rye grass is not accepted as an appropriate seed type by the Land Quality Section. I inspected the site on July 2, 1998. The site is a woodland of small pine trees on very sandy soil. The mine site is about 1,000 feet from the Trent River at its nearest point and it appears no ditches or active tributaries to the river or other areas are within the proposed mine site. The land owner indicated that he has had no problem with erosion in the past because the sandy soil adsorbs so much water there is little or no surface flow above ground. I observed no wells or dwellings within 1,000 feet of the proposed mine site. The entrance to the mine site is on an existing farm path which already has a gravel entrance and a locking gate. .. :.. ., t 1. • ' • ' ' , . i f e State of North Carolina Department of Environment and Natural Resources Division of Water Quality Washington Regional Office James B. Ross, Jr., Secretary DIVISION OF LAND RESOURCES LAND QUALITY SECTION January 3, 2008 According to our records your mining permit for the above referenced mine will expire on August 21, 2008. G.S. 74-52 provides that the permit may be renewed at any fime during the two years prior to its expiration. The procedure to be followed and the standards to be applied in renewing a permit shall be the same as those for issuing a permit. To apply for permit renewal, you must complete items 14 on the enclosed Renewal of Mining Permit Checklist (revised 11101). Also enclosed are two copies of the mining pert application form for your use. Please be sure to indicate any changes in the mining andfor reclamation plan.
