Pursuant to G.S. 74-52 of the Mining Act of 1971, attached for review and approval, please find a Permit
Modification Application for Mining Permit 61-19 (modification application), the Steel Gray Mine, located near
Spruce Pine, North Carolina. The mine is owned and operated by Buechel Stone Corporation (BSC). Arcadis US,
Inc. (Arcadis) is submitting this application and supporting materials on behalf of BSC.
The attached application is a revision to the November 3, 2021 application prepared for the Steel Gray Mine.
BSC received comments on that application from then North Carolina Department of Environmental Quality
(NCDEQ) on December 21, 2021. This revised application has been prepared based on that letter and
subsequent discussions with you. The comments from your letter are provided below with the response to your
comments and the applicable reference in the application.
In summary, the major changes to the permit application include the revision to the total permitted acreage from
12.74 acres to 60.90 acres. This enables BSC to include the section of Washburn Road that is considered a
private road as part of the access road to the mine. The easement for use of that road is attached to the
application. The proposed mine area remains approximately 0.70-acre area with an estimated site life of 10
years. Under separate cover and as indicated in the modification application, adjacent landowners are being
notified.
NCDEQ Comments/Response
1. This permit is currently issued to Blue Ridge Quarries Inc. Please clarify if the intent of this modification
is to also transfer the permit to Buechel Stone Corporation. Part of the transfer process requires that:
a. The proposed new permittee must request in writing that the existing permit be transferred and
clearly state the new operator's name (company or individual). The proposed new permittee
must also indicate that he accepts any and all responsibilities and liabilities with respect to the
Mining Act of 1971.
b. A letter from the existing permittee must be submitted requesting that the mining permit be
transferred to the proposed new permittee. The existing mine name and permit number must
be identified in the letter.

Response: BSC has provided as Attachment 5 a letter requesting a transfer of the permit to BSC. A letter
from the existing permittee is also included as requested.
2. Please provide the required application fee of $750.00 for this modification. See the enclosed request
dated November 18, 2021.
Response: An application fee of $250 is enclosed, as the revised permitted area is greater than 26 acres,
and BSC has already submitted $750 for the original permit modification application.
3. Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining
landowners and chief administrative officerof each county and municipality have been properly notified.
Response: A copy of the return receipts from adjoining landowners will be forwarded to NCDEQ when
received by BSC.
4. Please clarify the intent to dewater the mine. Question C.3C of the mining permit application was left
blank.
Response: The first part of Item C.3.0 was answered NO (Will any part of the mine excavation extend
below the water table?), therefore the second question was not answered. This question has been
answered NO on the revised application.
5. Please provide proof of application for an NPDES permit as indicated in the mining permit application
question C.3D.
Response: As we discussed, the NOI package was sent to the NCDEQ Stormwater Division in October
2021. 1 also forwarded the package to you on January 14, 2022. Furthermore, it is included as Attachment
6 to this application.
6. Mining has been indicated in the floodplain. Please provide proof of notice and approval from the
jurisdictional floodplain manager.
Response: Documentation of approval for placement of the sedimentation and stormwater basins within
the floodplain of the North Toe River from the jurisdictional floodplain manager for Mitchell County, Mr.
Kolby Silver, is included as Attachment 7 to this application.
Please clarify the activity that appears to have caused disturbed area outside the mining permit north
of the western mining area and on either side of the haul road.
Response: As discussed with you, these disturbances are caused by cattle and are not a result of any
activity related to mining.
8. Please clarify the activity that appears to have caused disturbed area outside the mining permit east of
the easter mining area. Drilling associated with this mining operation would be considered affected
area.

Response: This area you referenced has been designated as "Other Disturbed Areas Requiring
Reclamation" on the application figures. This 1.14-acre area has been included in the reclamation
calculations for the mine.
9. Please clarify the difference between proposed final grade and proposed limits of mining shown in the
cross sections on sheet 7 and sheet 8.
Response: As we discussed, rill will be placed in this area, as indicated on Figures 7 and 8 of the
application.
10. N.C.G.S. §7449 defines "affected land" as the surface are of land that is mined, the surface area of land
associated with a mining activity so that soil is exposed to accelerated erosion, the surface area of land
on which overburden and waste is deposited, and the surface area of land used for processing or
treatment plant, stockpiles, nonpublic roads, and settling ponds. Please clearly indicate and label on the
mine map that the haul road to the nearest public road is included in the Mine permit boundary.
Response: The proposed permit boundary has been extended to accommodate the section of Washburn
Road that is considered a private road, as shown on Figure 3 of the application. The easement for use of
that section of road by BSC for purposes of mining is included as Attachment 8.
11. Please clarify the statement on question C.6C of the mine permit application. There is a blank for the
maximum bench height.
Response: As indicated on Item C.6. C of the application, the maximum bench height will be 20 feet.
12. Please clarify the Year 3 and Year 10 sequence of mining. Statements were provided that haul road
will need to be rerouted. Please clearly indicate and label on the mine map the location of any proposed
roads.
Response: The haul road from the proposed mine area will remain as shown on the attached figures to the
application. If the haul road is rerouted, BSC will apply for a permit modification at that time.
13. Please clearly identify and label on the mine map the location of any explosive storage as stated in the
blasting plan.
Response: No explosives will be stored on site. The reference to on -site blasting storage has been
removed.
14. Please clearly identify and label on the mine map the location and acreage of any waste pile area and
stockpile areas.
Response: There will be no stockpiles or waste piles that remain on site.

15. Please clarify the acreages provided in the acreage table on page 4 of the mine permit application.
Acreage for tailing/sediment ponds and waste piles are negative. Acreage for the sediment ponds have
not been clearly identified in the total affected acreage totals.
Response: Acreages for the revised permit application have been revised as indicated on Item 2 of the
application. The revised sedimentation pond area is 0.06 acres and the waste pile area is 0 acres. As
such, the proposed change to the affected area is a negative number.
16. Please clarify how sediment basins located in the 1 % annual chance flood plain are protected against
washout in the event of a storm event which could cause sediment loss into surface waters.
Response: the sedimentation basins will be frequently cleaned out to ensure that sediment loss does not
occur. They will be inspected at least once per month for sediment build up.
17. Please provide Operation and maintenance details for the sediment ponds and any other erosion and
sediment control (E&SC) Measures.
Response: ES&C measures for the sedimentation ponds are provided in Item C.2.0 of the application.
18. NC Wildlife Resources Commission (NCWRC) and US Fish and Wildlife Service (USFWS) have raised
concerns with the invasive exotic species included in the seeding mixture, specifically Korean
lespedeza, fescue, common Bermuda, and crown vetch. Please review the recommendations for year-
round seeding provided on page 13 of the mine permit application to mitigate the use of invasive exotic
species.
Response: As discussed with you, BSC will review the recommendations of the USFWS and will modify
the seed mix as needed during reclamation. NCDEQ will be notified of nay changes to the currently
proposed seed mix.
19. USFWS has identified the potential for threatened and endangered species in the project area. Please
provide a biological assessment and/or biological evaluation (BA/BE) for the Gray bat (Myotis
grisescens) and Appalachian elktoe (Alasmidonta raveneliana). Comments from USFWS have been
included for your reference.
Response: A biological assessment of the two referenced species at the proposed mine site is included
as Attachment 9. The assessment concluded that there is no suitable habitat for the gray bat or the
Appalachian elktoe within the proposed mine area, therefore the mine will have no effect on these species.
Additional Comments
As we discussed, the calculator in Section E of the permit application form is not working correctly. As such, we
agreed that NCDEQ would calculate the reclamation bond costs for BSC.
The attached package includes one original and five copies of the modification application, attachments, and
figures.

3. Mine maps must be accurate and appropriately scaled drawings, aerial photographs, or enlarged topographic maps of
the entire mine site. All aspects of the mine site must be clearly labeled on the maps along with their
corresponding (approximate) acreage. Thus, all mine and reclamation maps must denote those activities that
are intended to be conducted during the life of the mining permit. All maps must be of a scale sufficient to clearly
illustrate the following, at a minimum:
a) Property lines of the tract or tracts of land on which the proposed mining activity is to be located including
easements and rights -of -way.
b) Existing or proposed permit boundaries with geographic controls (e.g. metes and bounds, coordinates) labeled
c) Initial and ultimate limits of clearing and grading
d) Outline and width of all buffer zones (both undisturbed and unexcavated)
e) Outline and acreage of all pits/excavations
f) Outline and acreage of all stockpile areas
g) Outline and acreage of all temporary and/or permanent overburden disposal areas
h) Location and acreage of all processing plants (may be described as to location and distance from mine if
sufficiently far removed)
i) Locations and names of all streams, rivers, and lakes
j) Outline and acreage of all settling and/or processing wastewater ponds
k) Outline and acreage of all planned and existing access roads and on -site haul roads
1) Location of planned and existing on -site buildings
m) Location and dimensions of all proposed sediment and erosion control measures

C. PROTECTION OF NATURAL RESOURCES
1. Describe in detail the sequence of events for the development and operation of the mine and reference the sequence
to the mine map(s). Attach additional sheets as needed.
Figure 1 is a mine location map: also showing roads. Figure 2 shows the
existing permitted area at the mine. Figure 3 shows the proposed modifications
to the mine ,plan.Figure 4 shows the area to be mined and the progression of
mining. Mining will proceed from west to east as shown. Attachment 1 describes
in detail the mining progression. Mine development will begin with the
installation of the soil and erosion controls as provided in Attachment 2.
2. Describe speck erosion control measures to be installed prior to land disturbing activities and during mining to
prevent offsite sedimentation (include specific plans for sediment and erosion control for mine excavation(s), waste
piles, access/mine roads, and process areas), and give a detailed sequence of installation and schedule for
maintenance of the measures. Locate and label all sediment and erosion control measures on the mine map(s) and
provide typical cross-sections/construction details of each measure. Engineering designs and calculations are required
to justify the adequacy of any proposed measures.
Soil and erosion control details are provided in Attachment 2. Stormwater
calculations, which were approved as part of the 2010 permit, are also included in
Attachment 2. Locations of previously installed stormwater and erosion control
features are shown on Figure 4. The stormwater/sedimentation ponds and associated
ditches will be inspected at least once per month for buildup of excess sediment and
cleaned out as needed to prevent discharge of sediemnt to the North Toe River in the
event of a flood. the excess sediemnt will be placed on the formerly mined area to the
east (see Figure 3)) and incorporated into the planned reclamation for this area.
Erosion in the ditches will be mitigated by placement of rock rip rap as needed.

5. A) A buffer will be required between any mining activity and any mining permit boundary or right-of-way. It may be an
unexcavated buffer (no excavation, but roadways, berms, and erosion & sedimentation control measures may be
installed within it), an undisturbed buffer (no disturbance within the buffer whatsoever), or a combination of the two,
depending upon the site conditions. Note that all buffers must be located within the mining permit boundaries.
How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at
this site? A minimum buffer of 25 feet is recommended, although a wider buffer may be needed depending on site
conditions. Show all buffer locations and widths on the mine map s).

6. A) Describe methods to prevent landslide or slope instability adjacent to adjoining permit boundaries during mining.
Minimum 2 horizontal to 1 vertical slopes or flatter for clayey material and minimum 3 horizontal to 1 vertical slopes or
flatter for sandy material are generally required unless technical justification can be provided to allow steeper slopes.
Mining will beperformed using the bench method for safety, access, and to
reduce slope instability thus preventing slides and the associated dangers.
Proper sloping of all waste rock material will be observed. Final slopes in
reclaimed areas will be 31-1:1 V or less. Reclamation topography for the
previously mined area is shown on Figure 5 and reclamation topgraphy for the
area to be mined is shown on Figure 6.
B) Provide a cross-section on the mine map(s) for all fill slopes (berms, waste piles, overburden disposal areas, etc.),
clearly indicating the intended side slope gradient, installation of any benches and/or slope drains (with supporting
design information) if needed, and the method of final stabilization.

for benching and sloping. Cross -sections for all cut slopes must be provided on the mine map(s).
Final cross -sections for reclaimed areas are shown on Figures 7 and 8 and
Attachment 2.
D) In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -sections of the mine
excavation clearly noting the angles of the cut slopes, widths of all safety benches and mine benches, and the
expected maximum depth of the excavation.
The expected maximum depth of the mine is 80 feet. During mining, the rock
will be benched to a maximum height of 20 feet. Figures 7 and 8 show the final
cross-section of mined out area. Note that fill material remaining form the mining
will be used to develop the post -mine topography.
7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling, house,
public road, or public, commercial or industrial building from any mine excavation. Locate all such structures on the
mine map if they are within 300 feet of any proposed excavation.
The Blasting Plan (see Item 11) is designed to prevent fly rock from leaving the
property.
8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area and when it
will be implemented. Vegetated earthen berms, appropriate fencing and adequate boulder barriers may be acceptable
high wall barricades. A construction detaftross-section and location of each type of barricade to be used must be
indicated on the mine map(s).
Attachment 2 presents the details of barricades used to prevent entry to the
mine site.

1. Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate the
sequence and general methods to be used in reclaiming this land. This must include the method of reclamation of
settling ponds and/or sediment control basins and the method of restoration or establishment of any permanent
drainage channels to a condition minimizing erosion, siltation and other pollution. This information must be illustrated
on a reclamation map and must correspond directly with the information provided on the mine map(s). In addition,
design information, including typical cross -sections, of any permanent channels to be constructed as part of the
reclamation plan and the locations) of all permanent channels must be indicated on the reclamation map.
There are no buildings or permanent structures on the mine property. The
entrance road for access and any roads needed to access adjoining farm
property will remain. All soil and erosion control measures will be left in place
(as feasibile) until all areas are stable. When areas are stable, the controls will
be removed or converted to armored ditches. Any highwall left will be protected
by a permanent fence or other barriers to prevent access and warn of danger.
2. Is an excavated or impounded body of water to be left as part of the reclamation?

The reclamation and revegetation plan is provided in Attachment 4. Any waste
rock materials that remain will be regraded and on site soils placed over this
material. Final slope cross -sections of reclaimed areas are shown on Figure 7,
Figure 8, and Attachment 2.
5. A) Describe reclamation of processing facilities, stockpile areas, and on -site roadways.
There are no processing facilities on the property. Any remaining stockpile
areas will be incorporated into the regraded final slopes. The on -site access
roads will remain. Approximately 8.17 acres will be reclaimed. The 3.3 acres of
undisturbed buffer area (see Figure 3) does not require reclamation.
B) Will any on -site roadways be left as part of the reclamation?

No off -site generated waste shall be disposed of on the mine site without prior written approval from the NC
Department of Environmental Quality, Division of Energy, Mineral, and Land Resources and either the Division
of Waste Management (DWM) or local governing body. If a disposal permit has been issued by DWM for the
site, a copy of said permit must be attached to this application. All temporary and permanent refuse disposal
areas must be clearly delineated on the mine map(s) and reclamation map, along with a list of items to be disposed in
said areas.
Solid waste, if generated by the mining activities, will be shipped off -site for
proper disposal. Scrap metal and other usable materials will be recycled on a
regular and as -needed basis. Any lay down yard for used equipment and spare
parts will be maintained in a neat and orderly fashion.

In accordance with G.S. 74-50(b1), the mine operator is required to make a reasonable effort, satisfactory to the Department, to notify all
owners of record, both public and private, of all tracts of land that are adjoining the mining permit boundary; if an adjoining tract is owned or
leased by the applicant or is owned by the lessor of the mine tract, all owners of record of tracts adjoining these tracts must be notified (that are
within 1,000 feet of the mining permit boundary). In addition, the mine operator must also notify the chief administrative officer of the county or
municipality in which any part of the permitted area is located. Any person may file written comment(s) to the Department at the above address
within thirty (30) days of the issuance of this Notice or the filing of the application for a permit, whichever is later. Should the Department
determine that a significant public interest exists relative to G.S. 74-51, a public hearing will be held within 60 days of the end of the 30-day
comment period specified above.
A copy of the permit application materials is on file and available for public review during normal business hours at the above listed address as
well as at the appropriate regional office. For information regarding the specifics of the proposed mining activity, please contact the
