Per NCDEQ review comments dated March 24, 2022 for the subject project, CEC is providing the
following responses. Each comment is listed below and responses are in Italic.
The additional information letter dated December 21, 2021, item 15, requested that
additional details including testing and reporting procedures be provided to achieve a
minimum 90% standard proctor. In your February 11, 2022, response to the December 21,
2021, additional information letter it was stated that since this activity is not for
construction purposes as a structural fill, engineered compaction of the fill was not
warranted. On Sheet C302, item I of the Phase 3 Construction Sequence, states that "Fill
material shall be compacted to a min. 90% standard proctor." Please clarify your intent for
compaction. Please provide details on how a 90% standard proctor will be achieved over
the entire fill as stated on the mine maps. .
Res onse: Phase 3 Construction Sequence on Sheet 302 has been revised. The 90%
compaction specification has been removed from note #1. The fill material will be placea
in controlled lifts and compacted with reasonable effort and equipment to provide a stable,
firm surface. No testing, reporting, or specification is required for the fill placement.
2. The February 11, 2022, response to item 15 states that "differential settlement should not
be a concern." Please provide proof through engineering calculations that differential
settlement will not occur to cause small pools as referenced in N.C.G.S. §74-53 (4).
Response: Any partial or final fill placement activity will ensure that the fill area has a
crown elevation with positive drainage away from the crown at a minimum of 3%slope, to
avoid ponding or pooling occurring because of settlement of the fill material. In addition,
the Owner shall conduct periodic inspection as needed and, if needed, repair of the surface
of thefill placement to maintain positive drainage and prevent ponding/pooling. Following

reaching final fill elevations, Owner shall conduct an inspection of the surface annually
for three years or until an inspection concludes that repair of the surface to prevent
ponding/pooling is not needed, whichever is less.
