In order for this office to complete its review of the referenced project in accordance with G.S. §74-50 and §74-51 of the Mining Act of 1971, please provide the additional or revised information in accordance with the following comments: Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining landowners and chief administrative officer of each county and municipality have been properly notified. Certified mail receipts for JTG Holdings, LLC were not included in the April 26, 2021, response. Please rescan the receipts so that all certified mail number are clearly visible or provide the signed returned cards. 2. Please clearly indicate and label on the mine map the Parker Cemetery and any proposed buffers. 3. Please provide proof of Notice of Intent (NOI) for NPDES Stormwater permit. 4. Please provide details for the sequence of events for the development and operation of "Phase 1" and "Phase 2" as described in your November 24, 2021, letter that addresses 401/404 impacts. Please clearly indicate and label on the mine map the areas of "Phase 1" and "Phase 2". 5. Please refer to Section D of the mine permit application and provide a reclamation map that clearly illustrates the reclamation plan for the entire site. The map should clearly illustrate the post mining use of the entire site. It should also include all italicized items listed in the application. 6. Please refer to section B.2 of the mine permit application and provide a mine map or set of maps that convey the requested detail in section B.2. The map submitted on December 6, 2021, is insufficient. Please clearly identify and label on the mine map the mine permit boundary, existing roads, planned roads to reach all affected areas, wetlands and streams, existing and planned structures, permanent outfalls, the location of fuel tanks, solvents, or other chemical storage facilities and neighboring structures. In addition, the map submitted on December 6, 2021, was missing the name of the applicant/permittee and had a scale that appeared to be incorrect, please provide a properly scaled map. Scale and North Arrow are missing from the "Key" sheet of the Erosion and Sediment Control (ESC) Maps. The permit boundary is not visible on any of the ESC maps. Please provide a scale and north arrow as well as the mine permit boundary on the ESC maps. 8. Please clarify which outfalls shown are temporary and which are permanent. 9. Please clearly show skimmers and outlet pipes on the ESC maps. 10. Please clarify basin calculations. Acreages for drainage areas shown on the map sheets don't match acreages in the table. 11. Basins and calculations should be sized for initial existing site conditions and disturbances and future conditions in a phased approach as site as conditions change. 12. Please clearly indicate and label on the mine map the drainage area for each ESC measure. 13. Please provide proof that the stream to the east of the property will be protected from offsite sedimentation. Indicate drainage areas on the map, show diversion ditches and basin calculations, to show there are adequate measures. The stream on the east side of the property flows to an off -site pond, which is impounded by a low hazard dam on the State inventory (STANL-043) 14. Please confirm that ESC measures are sized for the 25-year storm. 15. Please provide construction and maintenance details for all permanent outfalls. This includes silt fence outlets, skimmers, etc. 16. Please clearly identify and label on the ESC maps all wetlands and streams. 17. Please provide details on basins including dimensions and locations of baffles. 18. Silt fence should not be used by itself for areas larger than '/4 acre. Please provide details on how diversion ditches will be extended to divert stormwater to basins. 19. Please clarify the difference between the 145.7 acres denuded area on the ESC maps and the 182.7 disturbed acres on the Site Plan Maps. 20. Please indicate and label on the maps the existing storm drainage pipes underneath haul roads. 21. NC Wildlife Resources Commission (NCWRC) has recommended native species replace non- native/invasive species on the seeding schedule. Please see the attached list of recommended seeding mixtures. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. In order to complete the processing of your application, please forward two (2) copies of the requested information to my attention at the following address: Division of Energy, Mineral and Land Resources Department of Environmental Quality 1612 Mail Service Center Raleigh, NC 27699-1612 Certified Mail Mr. Schad Page 3 As required by 15A NCAC 5B.0113, you are hereby advised that you have 180 days from the date of your receipt of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request additional time, you must submit information, in writing, to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response, we encourage you to provide the additional information requested by this letter as soon as possible.
