Dear Mr. Parr,
Please find attached the response to your request for information dated October 6, 2021. This response
replied to your questions and comments in the numerical order of your letter as follows:
1. Toms Creek Tributary No. 4 is shown on the map to the east north east of the proposed mine site
about 200 feet from the permit boundary.
2. All know wells are shown on the maps and McDowell County Health Department was also
contacted with only one adjoining property being listed but that dwelling has a spring for water.
See attached operation permit for Timothy Bumette, all others were older and no records were
found.
3. Please see attached reclamation map for the mine showing the expected final grades at the end of
mining and also a cross section profile.
4. Find attached a biological assessment for concerns from the US Fish and Wildlife Service
(USF&WL). The site has been an active mine for over 25 years and there is no habitat the
concerns the USF&WL listed. After research of the data provided by USF&WL there has never
been any of the species they listed found anywhere near the site.
5. Please see the mine map for clarification and labeling of the 25-foot undisturbed buffer and the 50-
foot unexcavated buffer.
6. Please see map for Mine permit boundary line around the mine with reference in the notesBegend.
7. There are no buildings planned for the mine. Mining of dimension stone is by campaign and there
are no buildings required as stone is removed in large boulders and hauled out of the mine as is.
8. See Mine maps for location of structures within 300 feet of the mine boundary. Structures will be
protected during blasting by using the blasting plan in the original submittal, an entrance gate,
posting the property against entrance and highwall fencing.
9. The disturbed acreage table has been added to the map per your request. Please find attached
the summary for the Sediment Ponds (skimmer basins) showing the 5,592 square feet of surface
area which calculates to 0.1284 acres of surface area. The basins showed on the previous

submittal showed the basin for location only and were not drawn to scale. The ones shown now are
scaled.
10. The maps topographically show by elevation lines the areas that were mined in the past including
the highwall areas. The Previously mined areas are shown on sheet 3 of 3 and the highwalls
identified and there is also a cross sectional profile. An 11 X14 GIS printout (from 2018) showing
the mine is also included with the highwalls identified.
The area of the mine has changed from 26.3 acres down to 18.63 acres by removal of portions of the
original mine site on the east and west sides. These areas were eliminated due to your comments about
the stream to the west and the comments from USF&WL, although no endangered species are believed to
be on any of the site. The less areas we are mining the less impact we have on the area. Because the
area to be mined is smaller the application fee will be different. The original fee was $5,000 and now the
fee would be $3,750 and we request a refund because the permit has not been approved and is still in
process.

COMPLETION OF THIS OPERATION PERMIT ALLOWS THE SYSTEM TO BE PLACED INTO USE. PROPER CARE OF YOUR SEPTIC SYSTEM REQUIRES
MANAGEMENT AS WELL AS PERIODIC MAINTENANCE. OPERATION AND MAINTENANCE RECOMMENDATIONS ARE AS FOLLOWS:
1. The drain Sold does not have unlimited capacity. Try to limit the volume of your wastewater and repair any dripping faucets or toners. Be sure that the water from roof gutters,
foundation drains, and ground surface does not flow over the system.
2. Do not Sash materials such as hygieno products, dgarette butts, coffee grinds, disposable diapers. cooking oils or grease to the septic tank system.
Restrict the use of garbage disposals.
I Mslntaln o grass vegetative cover over the drain field to prevent soil erosion.
S. Avoid driveway or other construction over the system and repair area. Keep vehicular traffic and equipment off of the system. oo not cover with fill dirt.
6. Don't waft until your drain Sold falls to have your tank pumped, ft may be ruined. Have solids pumped out of the tank as needed, usually every 3-5; years.
