We offer the following responses for your consideration: 1. Please clarify/correct the mine name listed in question 1, page 1 of the mine permit application. The name is listed as "Ganey Road Mine", where all other documentation lists "Gainey Road Mine." RESPONSE: There was a typographical error in the mine name on Page 1 of the original mining permit application. The correct name is Gainey Road Mine. A corrected page 1 is attached for your files. 2. Please provide maintenance requirements for permanent vegetative and perimeter berms, sediment filter bags, and the class A riprop for the rock entrance utilized in the basin. RESPONSE: Additional maintenance requirements have been added to the construction details on Sheet C10 for the vegetated earthen berms and sediment filter bags and on Sheet C9 for the rip rap lined temporary/permanent diversion ditches that enter the sediment basin. 3. Please clarify if an onsite wetland delineation was conducted and by whom. It appears that the wetlands on the map are sourced from the National Wetlands Inventory (NWI). Field verification is often required to determine accuracy of NWI maps. RESPONSE: We solicited the wetland expertise of Mr. Adam Carter of Wetland Solutions, LLC to address this concern. Mr. Carter visited the site on October 14, 2021 to conduct a wetland delineation of the property. He found two identifying features shown as wetland 1(W1) and wetland 2 (W2) —see attached Wetland Solutions, LLC's November 2, 2021 Report. While W1 Mr. Parr Page 2 matched very closely to the National Wetlands Inventory (NWI) boundary shown on the mine maps, W2 was found to be larger than the wetland boundary shown on the NWI. Thus, we have made adjustments to the mine layout plans to provide a 50-foot vegetated buffer with a SO - foot -wide berm (for 100 feet total) along this updated, field verified delineated wetland. Sheets C2, C4 and C5 have been revised to show adjustments made to the buffer and berms, mine pit configuration, erosion and sediment control measures, and topsoil stockpile areas in order to continue our efforts to avoid impacts to any nearby wetlands. The revised affected acreage limits and associated acreage charts have been updated to accurately reflect these changes.
