RE: Application for a New Mining Permit
Indiantown Farm, LLC- Proposed Cherry Island Mine
Martin County - Roanoke River Basin
Dear Mr. Parr:
RECEIVED
AUG 3 0 2021
LAND DUALITY
MINING PROGRAM
As a consultant working on behalf of my client, Indiantown Farm, L-C, we hereby submit
the attached mining permit application for a new mining permit to mine sand and gravel on 70.9
acres of agricultural land located off NC 125 in Martin County. The proposed affected acreage
will be 50.5 acres and will consist of a site access road, temporary stockpile areas, perimeter
screening berms, three mine excavation areas, and temporary erosion and sedimentation
control measures that will be installed and maintained until all site runoff is directed internal to
the mine excavations. There will be no mine dewatering of the mine excavations and no
processing plant located onsite. The proposed reclamation plan is to restore the mine
excavations to viable lakes, remove all mining equipment from the site, grade all remaining
affected areas, and establish permanent groundcover throughout the site.
The detailed responses provided within the attached mining permit application form
along with the comprehensive mining plan set support our contention that we have addressed
all of the environmental and public safety aspects of the NC Mining Act and corresponding
administrative rules, and that none of the permit denial criteria listed under GS 74-51(d) (1)-(7)
will be triggered by the proposed mining operation. Lastly, we have attached the $5,000 mining
permit application processing fee to initiate the review of this mining permit application.
Thank you for your consideration in this matter. If you should have any questions
regarding this mining permit application package, please contact me at (919) 368-0246 or Mr.
Skip Valentine, Owner of Indiantown Farm, LLC, at (919) 395-4592.

C. PROTECTION OF NATURAL RESOURCES
1. Describe in detail the sequence of events for the development and operation ofthe mine and reference the
sequence to the mine map(s). Attach additional sheets as needed.
The proposed operation will involve the removal of sand and gravel by dragline or long reach
excavator from three mine excavation areas without dewatering the mine excavations. Any excess
overburden will be placed back into the mine excavations as the mine progresses. Mined material
will be placed adjacent to the excavations to allow drainage back into the excavations. Material will
then be placed into trucks and hauled directly offsite without further processing. No mining activities
will commence until all erosion and sedimentation control measures have been installed and
maintained. In addition to the erosion and sedimentation control measures, the mine excavations,
temporary stockpile areas, and visual screening berms will be located as shown on the attached
mining plan set.
A detailed construction sequence has been provided on Sheet C4 of the attached mining plan set.
Once all mining activities are completed, final reclamation of the entire site will be completed as
indicated in the Reclamation Plan (see Sheet C7).
2. Describe specific erosion control measures to be installed prior to land disturbing activities and during
mining to prevent offsite sedimentation (include specific plans for sediment and erosion control for mine
excavation(s), waste piles, access/mine roads and process areas), and give a detailed sequence of
installation and schedule for maintenance of the measures. Locate and label all sediment and erosion
control measures on the mine map(s) and provide typical cross-sections/construction details of each
measure. Engineering designs and calculations are required to justify the adequacy of any proposed
measures.
Erosion and sedimentation control measures have been proposed throughout the project area to protect
surrounding properties. These include a paved construction entrance, buffer zones, perimeter silt fence
with silt fence outlets, temporary diversions, earthen berms for screening as well as sediment
containment, and temporary skimmer basins for each of the three mine excavation areas that will be
maintained until they have been incorporated into the mine excavations at which time all runoff will be
directed into the mine excavations.
All erosion and sedimentation control measures are shown on Sheet C4. The installation and removal of
all erosion and sedimentation control measures are specified within the construction sequence also
provided on Sheet C4.
The skimmer basins and all diversions have been designed using a 25-year design storm event, the design
calculations of which are provided on Sheets C 13 and C 14.
The construction and maintenance notes and details for each erosion and sedimentation measure are
provided on Sheets C8—C12.
APPLICATION FOR A MINING PERMIT
3. a. Will the operation involve washing the material mined, recycling process water, or other waste water
handling? Yes ❑ No Z. Ifyes, briefly describe all such processes including any chemicals to be used.
Sand and gravel will be removed from the mine excavations without pit dewatering, temporarily
stockpiled adjacent to the mine excavations, and allowed to gravity flow back into the mine excavations.
No processing plant is proposed as moist mined material will be loaded from the temporary stockpiles
into trucks and hauled directly offsite.
b. Will the operation involve discharging fresh or waste water from the mine or plant as a point discharge to
the waters of the State? Yes ® No ❑. Ifyes, briefly describe the nature of the discharge and locate
all proposed discharge points (along with their method of stabilization) on your mine map(s).
During the initial preparation of each of the three excavation areas within the overall project area,
skimmer basins with temporary diversions will be used to capture stormwater runoff. After the sediment
contained in the water has had a chance to settle to the bottom of the basins, water from the surface of the
basins will be removed by the skimmer and discharged via the basin outlet dissipator as shown on Sheet
C4. This process is further described in the construction sequence and on the construction detail sheets.
NOTE: Once each of the three mine excavations is enlarged to incorporate its corresponding skimmer
basin, all drainage from the site will be directed into and held within the three mine excavations —which
will eliminate any further discharge from the site.
c. Will any part of the proposed mine excavation(s) extend below the water table? Yes ® No ❑.
If yes, do you intend to dewater the excavation(s)? Yes ❑ No E.
Ifyes, what impact, if any, will mine dewatering have on neighboring wells? Estimated withdrawal rate
in gallons per day: . Locate all existing wells on the mine map(s) that lie within
500 feet of the proposed excavation area. Provide data to support any conclusions or statements made,
including any monitoring well data, well construction data and current water withdrawal rates. Indicate
whether the proposed mine locale is served by a public water system or private wells.
The estimated maximum depth of the mine will be around 30 feet with the water table depth estimated to
be around 12 feet below the natural ground surface. As the material to be mined will be removed
without dewatering the excavations, no impacts to surrounding properties are anticipated.
d. If you answered yes to any of the above questions, provide evidence that you have applied for or
obtained the appropriate water quality permit(s) (i.e., non -discharge, NPDES, Stormwater, etc.) from the
Stormwater Program. In addition, the applicant is required to register water use with the Division of
Water Resources, Ground Water Management Branch, if the operation withdraws more than 10,000
gallons per day and needs a capacity use permit from the Division of Water Resources, Ground Water
Management Branch, if the operation lies in a capacity use area and withdraws more than 100,000
gallons per day.
No mine dewatering is proposed for this operation. See response provided in Item 3c. above.
In addition, a Notice of Intent (NOI) form for coverage under the NPDES NCG02 General Stormwater
Permit for Mining, including the required processing fee and attachments, has been submitted to
DEMLR's Stormwater Program for review and approval to cover the temporary discharge from the six
temporary skimmer basins until internal drainage to the mine excavations can be achieved. A copy of
the NO1 and its attachments are attached to this mining permit application. Once the Certificate of
Coverage is issued by the Stormwater Program, a copy will be provided to your office.
—7—
APPLICATION FOR A MINING PERMIT
4. a. Will the operation involve crushing or any other air contaminant emissions? Yes ❑ No Z.
If yes, indicate evidence that you have applied for or obtained an air quality permit issued by the
Division of Air Quality or local governing body.
No processing of sand and gravel removed from the three proposed mine excavations will take place at
the site. Mined material will be removed from impounded mine excavations (no pit dewatering will
take place), so the temporarily stockpiled material will be moist when loaded onto trucks and hauled
directly offsite.
b. How will dust from stockpiles, haul roads, etc., be controlled?
The access road, temporary stockpiles, and internal haul roads will be sprayed with water from the
mine excavation several times a day, as needed, to control fugitive dust.
5. a. A buffer will be required between any mining activity and any mining permit boundary or right-of-
way. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion &
sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance
within the buffer whatsoever), or a combination of the two, depending upon the site conditions.
Note that all buffers must be located within the mining permit boundaries.
How wide a buffer will be maintained between any mining activity and any mining permit boundary
or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer
may be needed depending on site conditions. Show all buffer locations and widths on the mine
map(s).
A proposed 50-foot minimum undisturbed buffer with an additional 50 foot wide by 6.25-foot-high
vegetated earthen berm will provide an overall minimum vegetated buffer of 100 feet between
mining related activities and any mining permit boundary.
b. A minimum 50-foot-wide undisturbed buffer will be required between any land disturbing activities
within the mining permit boundaries and any natural watercourses and wetlands unless smaller
undisturbed buffers can be justified. Depending on site conditions, a buffer widerthan 50 feet may
be needed.
How wide an undisturbed buffer will be maintained between any land disturbing activities within the
mining permit boundaries and any natural watercourses and wetlands at this site? Show all buffer
locations and widths on the mine map(s).
A proposed 50-foot minimum undisturbed buffer with an additional 50 foot wide by 6.25-foot-high
vegetated earthen berm will provide an overall minimum vegetated buffer of 100 feet between
mining related activities and any neighboring stream or wetland.
APPLICATION FOR A MINING PERMIT
6. a. Describe methods to prevent landslide or slope instability adjacent to adjoining permit boundaries
during mining. Minimum 2 horizontal to 1 vertical slopes or flatter for clayey material and
minimum 3 horizontal to 1 vertical slopes or flatter for sandy material are generally required, unless
technical justification can be provided to allow steeper slopes.
Removal of sand and gravel from below the water table within the mine excavations will result in the
side slopes reaching their natural angle of repose in water. However, any excavation that occurs
above the water table will be conducted at a 3 horizontal to I vertical or flatter slope.
b. Provide a cross-section on the mine maps) for all fill slopes (berms, wastepiles, overburden
disposal areas, etc.), clearly indicating the intended side slope gradient, installation of any benches
and/or slope drains (with supporting design information) if needed, and the method of final
stabilization.
Cross -sections and labels defining a minimum slope of horizontal to 1 vertical or flatter for all fill
slopes have been provided in the mining plan set. The method of final stabilization for all fill slopes
and other areas affected by the mining operation are provided on Sheet C8 to protect their integrity
and promote slope stability.
c. In excavation(s) of unconsolidated (non -rock) materials, specify the angle of all cut slopes including
specifications for benching and sloping. Cross -sections for all cut slopes must be provided on the
mine map(s).
The cut slopes of all excavated diversion ditches and walls of the skimmer basin will be maintained
at a minimum of 2 horizontal to 1 vertical or flatter. The cut slopes around the perimeter ofthe mine
excavations will be maintained at a minimum of 3 horizontal to I vertical or flatter. All cut slopes
and other areas affected by the mining operation will be stabilized with vegetation as indicated on
Sheet C8 to protect their integrity and promote slope stability.
d. In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -sections
of the mine excavation clearly noting the angles ofthe cut slopes, widths of all safety benches and
mine benches, and the expected maximum depth of the excavation.
There are no hard -rock excavations planned for this mining operation.
7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling
house, public road, public, commercial or industrial building from any mine excavation. Locate all such
structures on the mine map if they are within 300 feet of any proposed excavation.
A lockable gate will be maintained at the site's entrance to prevent access by others outside of normal
business hours. Vegetated earthen berms are also provided around the entire perimeter of the mining
operation to prevent inadvertent entry. Lastly, at the completion of final reclamation ofthe site, barbed wire
fencing will be installed for safety purposes.
8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area
and when it will be implemented. Vegetated earthen berms, appropriate fencing and adequate boulder
barriers may be acceptable high wall barricades. A construction detail/cross-section and location of each
type of barricade to be used must be indicated on the mine map(s).
A lockable gate will be maintained at the site's entrance to prevent access by others outside of normal
business hours. Vegetated earthen berms are also provided around the entire perimeter of the mining
operation to prevent inadvertent entry. Lastly, at the completion of final reclamation of the site, barbed wire
fencing will be installed for safety purposes.
ME
APPLICATION FOR A MINING PERMIT

If yes, how will acid water pollution from the excavation, stockpiles and waste areas be controlled?
10. a. Describe specific plans (including a schedule of implementation) for screening the operation from
public view such as maintaining or planting trees, bushes or other vegetation, building berms or
other measures. Show the location of all visual screening on the mine map(s) and provide cross -
sections through all proposed berms or proposed spacing, sizes and species for tree plantings.
Vegetated earthen berms will be constructed and stabilized with vegetation around the entire
perimeter of the mining operation to screen the operation from view of the public.
b. Could the operation have a significantly adverse effect on the purposes of a publicly owned park,
forest or recreation area? If so, how will such effects (i.e., noise, visibility, etc.) be mitigated?
There are no known publicly owned parks, forests, or recreation areas in close proximity to this
proposed mining operation.
11. Will explosives be used? Yes ❑ No N.
If yes, specify the types of explosive(s) and describe what precaution(s) will be used to prevent physical
hazard to persons or neighboring property from flying rocks or excessive air blasts or ground vibrations.
Depending on the mine's location to nearby structures, more detailed technical information may be
required on the blasting program (such as a third -party blasting study). Locate the nearest offsite occupied
structures) to the proposed excavations) on the mine map and indicate its approximate distance to the
proposed excavation.
12. Will fuel tanks, solvents, or other chemical reagents be stored on -site? Yes ❑ No ®.

RE: Adjoining Property Owner Notification Pursuant to NCGS 74-50(bI) of The Mining Act of 1971
Indiantown Farm, LLC — Proposed Cherry Island Mine
23721 NC Highway 125
Williamston, North Carolina 27892
Martin County
Dear Adjoining Landowner and Local Government Official
The purpose of this letter is to notify you of Indiantown Farm, LLC's intent to apply for a Mining Permit
from the NC Department of Environmental Quality to mine sand and gravel from the above referenced
property.
The sand and gravel will be removed from the mine excavations by dragline or long reach excavator
without pumping any water to avoid any impacts to public water supply wells in the area and neighboring
wetlands. Dust will be controlled by wetting onsite haul roads and sand stockpiles as necessary. A gate
at the entrance and berms and buffers around the perimeter of the mine will be maintained at all times to
screen the operation from public view and prevent inadvertent entry. Lastly, erosion and sedimentation
control measures will capture any sediment runoff during the operation and the site will be reclaimed as
viable lake areas once mining activities are completed. The State of North Carolina requires us to notify
adjoining owners of record and the chief administrative officer of the town or county with local
jurisdiction over the site based upon the provisions N.C.G.S. 74-50(b1) of the Mining Act of 1971.
Attached to this letter is the completed official State of North Carolina Public Notice form. For your
information, we have also included a copy of our overall site plan showing our proposed mining permit
boundaries as well as our proposed mining operation layout.
If you would like any further information or have any questions pertaining to this application, please feel
free to contact our environmental consultant, Mr. Tracy E. Davis, PE of ATS Environmental Solutions,
PLLC at (919) 368-0246 or email at tract'davis(catsenvirosolutions.com OR me at (919) 395-4592 or
email at skiomeWaNamail.com
Sincerely,
Melton E. "Skip" Valentine, III, Owner

Martin County— Roanoke River Basin
Dear Ms. Lucas:
On behalf of Indiantown Farm, LLC, I hereby submit the attached NPDES Application for
Coverage under General Permit NCG02 for a proposed sand and gravel mine at 23721 NC
Highway 125 in Martin County. While the permitted acreage at the site will be 70.9 acres, only
50.5 acres will be affected as part of the proposed mining operation. No pit dewatering is
proposed and, as there will be no processing plant onsite, no washing of material or plant
process water will be generated. Our methods for capture and treatment of surface water
runoff during the initial and ongoing site development are described in detail in the attached
NPDES application and the attached mine plan sheets. We have also attached our $100
stormwater permit application processing fee to Initiate the review of our application.
Copies of the detailed mining permit application form and its attachments have been
filed separately with DEMLR's Mining Program for its review in issuing the mining permit. Your
staff may want to review this information as well as it provides additional details regarding the
proposed mining operation.
Thank you for your consideration. If you should have any questions regarding this
NPDES application package, please contact me at (919) 368-0246.
Ancerely,
