HomeMy WebLinkAbout20211206_8_404_Impact_responseNovember 24, 2021 Division of Energy, Mineral and Land Resources Department of Environmental Quality Attn: Mr. Adam Parr 1612 Mail Service Center Raleigh, North Carolina 27699-1612 Re: Parker Mine Mining Application No. 84-06 Stanly County Yadkin River Basin Adam: Item 8 of your additional information request letter dated April 21, 2021 states: "Please provide proof of 401/404 permits for any proposed impact to wetlands onsite." The waters on site were delineated by Atlas staff in May 2021. All waters were flagged with pink survey tape to clearly mark the limits of jurisdiction. A CAD file of the delineated waters was created to aid in the planning process. The Corps issued the Jurisdictional Determination on September 24, 2021. The waters on site are included on the mine permit application maps. A Corps/DWR individual permit will be necessary for project impacts in Phase 2. It is anticipated that the individual permit will be submitted in early 2022. Phase 1 mining operations will not require impacts to waters. It is anticipated that six to twelve months of mining can occur before impacts to waters are necessary. The project team understands that no impacts to waters can occur without Corps 404 and DWR 401 approval. Thank you for your attention to the environmental documents that my office has provided.
