Bratton 6821 Knightdale Boulevard Knightdale, NC 27545-9651 (Delivered via email to samuelbratton@wakestonecorp.com ) Subject: REQUEST FOR ADDITIONAL INFORMATION Wake Stone Corporation - Bridge over Crabtree Creek Dear Mr. Bratton: On October 13, 2021, the Division of Water Resources ("Division" or "DWR") received your application requesting a Riparian Buffer Authorization pursuant to the Neuse River Riparian Buffer Protection Rules (15A NCAC 02B .0714) from the Division for your project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until the following information is received: 1. Is any portion of the project on "public lands" of is any funding of the project a "significant expenditure of public moneys" as those terms are defined in the State Environmental Policy Act (SEPA)? [G.S. § 113A-9] 2. The Division understands that poured -in -place concrete guardrails are incorporated into the proposed bridge design to separate traffic and provide protection against spillage into Crabtree Creek. Please provide specifics of the guardrails (and updated design diagrams, as appropriate): a. What is the width and height of the guardrails? b. How will the guard rails protect from spillage given truck height relative to curb height? 3. Please explain how the bridge runoff will be captured/treated. Will any stormwater from the bridge discharge into the buffer? If so, how will dispersed flow be maintained? The Division needs to understand the projected volume of traffic that will use the bridge in relationship to the bridge design. How many estimated trips will highway -legal trucks and/or other machinery (i.e. vehicles other than mine haul trucks) take per day over the proposed bridge during: 1.) initial site development and 2.) mining operations (active removal of mined aggregate reserve from the Odd Fellows tract)? 5. Please explain why a narrower bridge with traffic controls (e.g. the use of a flagger or remote light to control traffic) are not a practical alternative to the proposed bridge design with two 27'-wide travel lanes. 6. The Division has reviewed the Erosion and Sediment Control (ESC) Plan for the proposed bridge and compared it to the Erosion and Sedimentation Control (ESC) documents provided to the Division of Energy Mineral and Land Resources ("DEMLR") and has concerns regarding the how the two plans align. To ensure the plans align, please address the following, including any plan and exhibit updates, as necessary: a. The Limits of Disturbance (LOD) shown on the DEMLR ESC documents and the ESC for the proposed bridge provided to DWR do not appear to match. Please update the plans to show they are consistent. b. DEMLR ESC documents and the overall site plan submitted to DWR both include sediment basins #3 and #7 and associated diversion ditches and culvert but these are not shown on the DWR impact exhibits or ESC. These ESC measures are also included in the Bridge Construction Sequence in DEMLR documents. Further, access to the bridge construction area is also not clearly specified or depicted in the DWR bridge exhibits. On the DEMLR ESC documents access is shown by way of a perimeter access road constructed prior to wholesale clearing of the Odd Fellows tract. Please update the exhibits and plans for the bridge construction area to be consistent with the approved DEMLR ESC documents that have already been permitted through the Mining Program. c. Please confirm that sediment basin 3 and the corresponding diversion ditch/culvert will be installed prior to bridge construction to divert upgradient clean water into the basin and away from work area consistent with the construction sequencing approved under Mining Program. d. The concrete washout, stockpile/laydown area, and construction entrance were not shown on the ESC plans submitted to DEMLR. There is concern that these three elements all occupy the same space when these areas should be separated and silt fencing should be installed on the low side of stockpile/staging area. The Division has concerns with the Vegetative Planting Plan narrative provided as part of the proposed bridge's ESC Plan for site stabilization in disturbed buffer areas. Please address the following and update the vegetative plan in the bridge's ESC plan accordingly: a. The Division believes that the chiseling depth of 2-3 inches for seed bed preparation in the compacted areas may not be deep enough to allow for proper bed preparation, and believes 4-6 inches is more appropriate. Please confirm that a depth or 2-3 inches will be adequate with supporting documentation or update the plans to reflect a 4-6-inch depth. b. Please confirm that the use of mulch is recommended by DEMLR. The use of ESC matting such as coir mats/blankets or jute mesh netting may be needed in place of anchor mulch due to the steep topography. c. The Division has concerns over the planned use of fescue, lespedeza, and Bermuda grass species. We suggest using a riparian seed mix. Appropriate species in the planting mix may include: Virginia or riverbank wildrye, switch grass, blue stem, deer tongue, river oats, Indian grass, broomsedge, black-eyed susan, partridge pea, panicgrass or cane flower. Clover may be appropriate as a temporary cover if planting and site stabilization must occur outside of the recommended planting window for these species. Pursuant to Title 15A NCAC 02B .0714, the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 and Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR # requested on the link above). If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Neuse River Riparian Buffer Protection Rules or the Neuse River Riparian Buffer Rules for this activity and any work done within waters of the state or regulated Riparian Buffers may be a violation of North Carolina General Statutes and Administrative Code.
