Hi Adam,
After looking at the attachments I think DWR is satisfied that they can work off of the original JD they got from
USACE, keeping in mind that their goal is to protect the wetlands that are on site.
If they could include a subsection in their O&M plan that states that there are wetlands on site, and if it could
give more detail about how the pumping will be done, that would be great.

The applicant has responded to our ADI where we requested a JD (based on comments provided). It appears that there
was a JD done for this site back in 2005 for the original application. This JD expired in 2010.
I am fine asking them to go through the process again if it is required, however if this original (expired) JD will suffice to
give a location of the wetlands that is then buffered on the mine map please let me know and I will let the applicant
know that they do not need to go through the JD process with the USACE again at this time. If this is not adequate I will
let them know that an updated JD is required.

Adam,
We have received your request for additional information and are working on our responses.
In reference to item #1 of your letter, you are requesting that we obtain a Jurisdictional Determination from the US
Army Corps of Engineers to confirm that the wetland boundary surveyed at the site and provided on the pending mining
permit modification maps is accurate/been verified by the COE. Would you accept the attached JD that was issued
when the site was first permitted verifying that this wetland boundary has already been reviewed by and verified by the
COE? I have also provided a copy of the original approved mine map to help orient you on how the current mine
footprint fits within the COE verified wetland boundary.
Otherwise, my client would have to hire a wetland consultant to compile and process the JD paperwork, and incur
several months of delays due to the COE project backlog, just to get the same verification. We are hopeful that the
attached information provides confidence in the wetland boundary so that DEMLR can continue its review of the
pending mining permit modification once the other items listed in your letter are addressed.
