Adam, We have received your request for additional information and are working on our responses. In reference to item #1 of your letter, you are requesting that we obtain a Jurisdictional Determination from the US Army Corps of Engineers to confirm that the wetland boundary surveyed at the site and provided on the pending mining permit modification maps is accurate/been verified by the COE. Would you accept the attached JD that was issued when the site was first permitted verifying that this wetland boundary has already been reviewed by and verified by the COE? I have also provided a copy of the original approved mine map to help orient you on how the current mine footprint fits within the COE verified wetland boundary. Otherwise, my client would have to hire a wetland consultant to compile and process the JD paperwork, and incur several months of delays due to the COE project backlog, just to get the same verification. We are hopeful that the attached information provides confidence in the wetland boundary so that DEMLR can continue its review of the pending mining permit modification once the other items listed in your letter are addressed. Thanks for your consideration. Tracy Tracy E.
