I spoke to Robert Fryar about his mine on Friday, September le. He said he wants to reclaim the mine and close out
the mining permit. According to Mr. Fryar, there is no more marketable material within the mining permit boundary. I
told him if he still wants to operate the landfill, he would need to contact Guilford County about getting a sedimentation
and erosion control plan approved by the County. Mr. Fryar said he would contact Earl Davis with the Guilford County
Local Program regarding a permit forthe landfill.

Good to meet you yesterday. I attached a copy of the mining inspection report. Our central office should contact you
about the permit renewal application. What we need to do right now is get the plan revised to show erosion control
measures around your current and proposed mining areas. These will need to be installed per the approved plan detail.
Measures will not be needed in areas that are currently stable. I did make a note that Rock Dam #5 will need to be
installed perthe approved plan with all associated diversion berms prior to any mining around that area. Nothing needs
to be done with that area right now.

SUBJECT: Mining Permit Renewal for Fryer Grading & Hauling, lne, Fryer Mine— Permit No. 41-
19, Guilford County, North Carolina
Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject
document and we are familiar with habitat values of the project area. Our comments ere provided in
accordance with provisions of the Mining Act of 1971 (as amended, 1982) (G.S. 74-46 through 74-68 15
NCAC 5).
The applicant is requesting a renewal of their permit to mine sandrock. The total permitted area
is 122 acres. The applicant indicates the operation does not discharge water from the site and the area to
be mined does not have natural watercourse or wetlands. Reclamation includes planting grasses and
Impedes. Form uses for this site will include an LCID landfill area. Other areas will be allowed to re -
vegetate with native trees and plants. The site drains to and borders South Buffalo Crack. South Buffalo
Creek is a tributary to Buffalo Creek in the Cape Fear River basin.
Should the permit be issued, we offer the following recommendations to reduce impacts to
aquatic and terrestrial wildlife resources.
1. Maintain a minimum 100-foot undisturbed native, forested buffer along Perennial streams, and a
minimum 50-fom buffer along intermittent streams and wetlands. Maintaining undisturbed,
forested buffers along these areas will reduce impacts to aquatic and terrestrial wildlife resources,
water quality, aquatic habitat both within and downstream of the project area. In addition, these
buffers will provide an adequate travel corridor for wildlife species. Whereas, a grassed buffer,
particularly fescue, is a vegetated buffer but will not provide the necessary and highly valuable
functions as discussed for forested buffers. We request that sediment and erosion control
structures be located outside of these butters.
2. We encourage the applicant to consider using seed mixtures that are beneficial to wildlife in their
reclamation plan, such as native, warm season grasses. An exact seeding mixture would need to
take into account soil types, moisture, pH, and degree of slope of areas to be stabilized.

SUBJECT: Mining Permit Renewal for Fryar Grading & Having, Inc., Fryar Mine — Permit No. 41-
19, Guilford County, North Carolina
Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject
document and we are familiar with habitat values of the project area. Our comments are provided in
accordance with provisions of the Mining Act of 1971'(as amended, 1982) (G.S. 7446 through 74-68 15
NCAC 5).
The applicant is requesting a renewal of their permit to mine sandrock. The total permitted area
is 122 acres. The applicant indicates the operation does not discharge water from the site and the area to
be mined does not have mutual watercourse" wetlands. Reclamation includes planting grasses and
lespedera. Future uses for this site will include an LCID landfill was. Other mess will be allowed to re -
vegetate with native trees and plants. The site drains to and borders South Buffalo Crack. South Buffalo
Creek is a tributary to Buffalo Creek in the Cape Fem River basin.
Should the permit be issued, we off" the following recommendations to reduce impacts to
aquatic and terrestrial wildlife resources.
1. Maintain a minimum 100-foot undisturbed native, forested buffer along perennial streams, and a
minimum 50•fom buffer along intermittent atrmms end wetlands. Maintaining undisturbed,
forested buffos along these areas will reduce impacts to aquatic and terrestrial wildlife mrourms,
water quality, aquatic habitat both within and downstream of the project area. In addition, these
buffers will provide an adequate travel corridor for wildlife species. Whereas, a grassed buffer,
particularly fescue, is a vegetated buffer but will not provide the necessary and highly valuable
functions as discussed for forested buffers. We request that sediment and erosion control
structurm be located outside of there buffers.
We encourage the applicant to consider using seed mixtures that are beneficial to wildlife in their
reclamation plan, such as native, warn season grasses. An exact seeding mixture would need to
take into account soil types, moisture, pH, and degree of slope of arms to be stabilized.

The Fryar Mine located in Guilford County does not appear to have an unduly adverse effect on ground water
supplies since there is no dewatering proposed on site. If it becomes necessary to begin pumping water from
the mine to stabilize mining activities, the Division of Water Resources would like to be contacted so that $
may further investigate any potential effects on potable ground water supplies.
Facilities not in the fifteen county Central Coastal Plain Capacity Use Area are required to register their water
withdrawals in accordance with the North Carolina General Statute G.S. 1.43 ? 15.72H. This statue requires any
non-agriculmml water user who withdraws 100,000 gallons or more in any one day of ground water or surface
water to register and update withdrawals. This statue also requires transfers of 100,000 gallons or more in any
one day of surface water from one river basin to another river basin to register and update their water transfers.

B. Any settling ponds or sediment basins shall be backfilled and stabilized.
C. The processing, stockpile, and other disturbed areas neighboring the mine
excavation shall be leveled and smoothed.
D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before
revegetation.
E. No contaminants shall be permanently disposed of at the mine site. On -site
disposal of waste shall be in accordance with Operating Condition 11.A through
E.
F. The affected land shall be graded to prevent the collection of noxious or foul
water.
3. Revecetation Plan:
Aker site preparation, all disturbed land areas shall be revegetated as per the
Revegetation Plan approved by Mr. Robert Grill, Landscape Architect.
Whenever possible, disturbed areas should be vegetated with native warm season
grasses such as switch grass, Indian grass, bluestem and gamma grass.
In addition, the permiree shall consult with a professional wildlife biologist with the N.C.
Wildlife Resources Commission to enhance post -project wildlife habitat at the site.
4. Reclamation Plan:
Reclamation shall be conducted simultaneously with mining to the extent feasible. In
any event, reclamation shall be initiated as soon as feasible after completion or
termination of mining of any mine segment under permit. Final reclamation, including
revegetation, shall be completed within two years of completion or termination of mining.
This permit, issued August 14, 1990, modified and renewed April 27, 1999, is hereby
modified this 7" day of November, 2003.

Reference is made to my letter to you of February 25, 1994. concerning
your mining of sand, gravel.or other similar materials at the Fzyar Grading
and Hauling Mine located off Of McLeanaville Road (S.R. 2819), adjacent to
South Buffalo Creek, McLeansville, Guilford County, North Carolina: Reference
is also made to the site inspection of November 2, 1294, conducted by Mr. John
T'bomas of the Raleigh Regulatory Field Office staff at the site of your
referenced operations. The purpose of this inspection was to review your
ongoing mining operations in relation to impacts to waters and wetlands
subject to Department of the Army permitting authority.
The inspections revealed that impacts associated with yovr mining
operations are located entirely on high ground (non -jurisdictional to Section
404 of the Clean Water Act), Accordingly, Department of the Army permit
authorization will not be required for existing mining operation. This
determination does not relieve you of the responsibility to obtain any other
required State or local approval,
Please be reminded that no excavated or fill materials may be placed in
any waters or wetland areas without prior Federal permit authorization.

On behalf of the owner of Fryar Sandrock, Joyce Engineering, Inc. (JEI) is writing in response to
your comments from the Mine Modification review letter of June 16, 2003, . We hope that this
response and the actions taken at the facility will address and satisfy the items from your letter. For
clarity, we have typed your comments in bold, with our response immediately below.
1. According to the mine permit, permitted acreage is 122 acres with only 21.8 acres
allowed for disturbance. Please revise the mine map to indicate the property boundary,
the mine permit boundary, and the affected area boundary.
The mine map has been updated so that the affected areas and permit boundaries are more
clearly visible. The Affected areas total 21.8 acres and are clearly outlined in ahold line and
hatched which is also displayed in the legend.
2. Please be aware that the buffers along the stream must be measured from the top of
bank landward and not from the centerline of the stream. Please correct the legend on
the revised map.
The mine map has been updated with correct stream buffers; the legend has also been
corrected.

SUBJECT: Mining Permit Modification Request for Fryar Grading & Hauling, Inc., Fryar
Mine - Permit No. 41-19, Guilford County, North Carolina
Biologists with the North Carolina Wildlife Resources Commission have reviewed the
subject permit renewal and modification and are familiar with the habitat value of the area. Our
comments are provided in accordance with provisions of the Mining Act of 1971 (as amended,
1982)(G.S. 74-76 through 74-68 15 NCAC 5).
Fryar Grading & Hauling, Inc. is requesting a modification of its current mining permit to
mine sandstone. The requested modification is to add an additional 21.8 acres to the total
permitted area of 122 acres. The applicant has indicated that them are no natural watercourses or
wetlands running through the area to be mined and that there are no discharges to waters of the
State. South Buffalo Creek, Cape Fear River basin, borders the site. South Buffalo Creek is on
the North. Carolina 2000 303d list as an impaired water body. Protecting water quality is
essential and proper erosion and sediment control should be strictly adhered to.
We recommend that the following conditions be incorporated into the permit to reduce
impacts to fish and wildlife resources.
1. In order to reduce stream impacts, while retaining some measure of wildlife habitat, we
recommend a 100-foot undisturbed, native, forested buffer along perennial streams, and a
50-foot buffer along intermittent streams and wetlands for the present operation and any
future expansions. Adequate nparian habitat and watershed protection is essential to the
continued survival ofrarc aquatic species. Maintaining undisturbed, forested buffm.
along these mass will reduce impacts to fish and wildlife resources, water quality, aquatic
habitat both within and downstream of the project area, and help prevent the extirpation
of endangered and threatened species. In addition, these buffers will provide an adequate
travel corridor for wildlife species. Whereas, a grassed buffer, particularly fescue, is a
vegetated bu tTer but will not provide the necessary and highly valuable functions as

discussed for forested buffers. We request that sediment and control measures be located
outside of these buffers.
Any future water discharges from the project site should be proportional to the size of the
receiving stream, and all discharges should comply with NPDES permit requirements. In
particular, turbidity of the discharge should be maintained at or below the permit
requirement. High water discharge rates and turbidity can negatively impact aquatic and
fisheries resources within and downstream of the protect area. Excessive silt and
sediment loads can have numerous detrimental effects on aquatic resources including
destruction of spawning habitat, suffocation of eggs, and clogging of gills of aquatic
species. Implementation of these conditions should minimize impacts to aquatic and
fisheries resources at and downstream of the project site.
We encourage the applicant to consider using seed mixtures that are beneficiat to wildlife
in their reclamation plan, such as native, wane season greases. An exact seeding mixture
would need to talcs into account soil types, moisture, pH, and degree of slope of areas to
be stabilized. Additionally, for relatively shallow sediment basin reclamaton, we
recommend these areas be reclaimed as wetlands where practicable. We refer the
applicant to George Strader, District Wildlife Biologist at [phone] for additional
information and ideas on reclamation for wildlife.

Your application for renewal and modification of the above
referenced mining permit has been approved. The modification is to
update the mining plan and to add the Future LCID Area as indicated on
the Mine Map dated November 13, 1998. A copy of the renewed and
modified permit is enclosed.
The conditions in the renewed and modified permit were based
primarily upon the initial application. Modifications were made as
indicated by the renewal and modification requests and as required to
insure compliance with The Mining Act of 1971. The new expiration
date is April 27, 2009.
The issuance of a mining permit and/or any modification to it does
not supersede local zoning regulations. The responsibility of compliance
with any applicable zoning regulations lies with you.
As a reminder, your permitted acreage at this site is 122 acres and

A. Any wastewater processing or mine dewatering shall be in accordance with the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission.
B. Any stormwater runoff from the affected areas at the site shall be in accordance with
any applicable permit requirements and regulations promulgated by the
Environmental Protection Agency and enforced by the N.C. Environmental
Management Commission. It shall be the permittee's responsibility to contact the
Stomnwater Section, Division of Water Quality, to secure any necessary stormwater
permits or other approval documents.
2. A. Any mining process producing air contamination emissions shall be subject to the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission and enforced by the Division of Air Quality.
B. During mining operations, water trucks or other means that maybe necessary shall
be utilized to prevent dust from leaving the permitted area.
3. A. Sufficient buffer (minimum 50 foot undisturbed along the northern side and a
minimum of 150 feet undisturbed along the western side of the site) shall be
maintained between any affected land and any adjoining waterway or wetland to
prevent sedimentation of that waterway or wetland from erosion of the affected land
and to preserve the integrity of the natural watercourse or wetland.
B. Any mining activity affecting waters of the State, waters of the U. S., or wetlands
shall be in accordance with the requirements and regulations promulgated and
enforced by the N. C. Environmental Management Commission.
C. All setbacks and buffers related to the approved LCID Landfill Permit shall be
maintained.
4. A. Adequate mechanical barriers including but not limited to diversions, earthen dikes,
silt check dams, silt retarding structures, rip rap pits, or ditches shall be provided in
the initial stages of any land disturbance and maintained to prevent sediment from
discharging onto adjacent surface areas or into any lake, wetland or natural
watercourse in proximity to the affected land.
OAll erosion and sedimentation control measures shall be constructed and
maintained as indicated on the Mine Map dated November 13, 1998 to prevent off -
site sedimentation.
C. A minimum 100 foot long gravel construction entrance shall be constructed and
maintained from its junction with SR 2950.

C. The processing, stockpile, and other disturbed areas neighboring the mine
excavation shall be leveled and smoothed.
D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before
revegetation.
E. No contaminants shall be permanently disposed of at the mine site. On -site
disposal of waste shall be in accordance with Operating Condition Nos. 11.A.
through E.
F. The affected land shall be graded to prevent the collection of noxious or foul water.
I1 3. / Revegetation Plan:
/ After site preparation, all disturbed land areas shall be revegetated as per the
Revegetation Plan approved by Mr. Robert Grill, Landscape Architect.
In addition, the permittee shall consult with a professional wildlife biologist with the N.C.
Wildlife Resources Commission to enhance post -project wildlife habitat at the site.
Reclamation shall be conducted simultaneously with mining to the extent feasible. In any
event, reclamation shall be initiated as soon as feasible after completion or termination of
mining of any mine segment under permit. Final reclamation, including revegetation, shall
be completed within two years of completion or termination of mining.
This permit, issued August 14, 1990, is contemporaneously modified and renewed this
27th day of April, 1999 pursuant to G.S. 74-52.N -dr./

The opponents draw
parallels to a
construction landfill on
Groometown Road, owned by
D.H. Griffin, that was
closed after state
inspectors found it was
leaking chemicals into

"(Fryar) will tell you
that he'll do the best job
he can, and I believe
he'll do that, but you
can't keep contaminants
out," said Kirk Perkins,
one of the opponents.
"These sites have been
problems all over the
country."

request your company submitted for the above referenced mine site.
However, the following is needed to continue processing your

The reclamation bond was calculated for this site using the
information submitted on the Mine Map dated November 13, 1998 and
the Annual Reclamation Map received February 1, 1999. The
reclamation bond for this site has been calculated to be $60,200.00.
The calculation worksheet is enclosed for your review. Your company
currently has a $12,500.00 bond on this site, the new bond amount
will be required prior to approval of this modification and renewal. This
may be done by replacing the existing bond with one for the higher
amount or by increasing the existing bond to the required amount.

SUBJECT: Mining Permit Renewal & Modification Request for Fryar Grading and Hauling,
Inc., Fryar Mine — Permit No. 41-19.
Biologists with the North Carolina Wildlife Resources Commission have reviewed the
subject permit renewal and modification request. An on -site investigation was conducted on
March 31, 1999 for the purpose of assessing project impacts to fisheries and wildlife resources.
Our comments are provided in accordance with provisions of the Mining Act of 1971 (as -
amended, 1982) (G.S. 74-76 through 74-68 15 NCAC 5).
Fryar Grading and Hauling, Inc. is requesting a renewal and modification of its current
mining permit. The top soil, clay, and sandrock mine is approximately 122 acres in size and
located southwest of McLeansville in Guilford County. South Buffalo Creek flows along the
northern and western property lines.
Although there appears to be a significant wooded buffer of approximately 150 fi. along
most of South Buffalo Creek, we are concerned about the minimum buffer width of 30 ft. stated
in the permit application and found along the northern section of the mine property. We
recommend that an undisturbed buffer of at least 50 ft. be maintained between any land
disturbing activities and South Buffalo Creek. Maintaining a minimum 50-ft. undisturbed buffer

I inspected the site March 30, 1999. A copy of my
inspection report is attached. The only problem on the site
was an eroding ditch below existing Rock Dam 83. Sediment
from the erosion was settling in a large fan in the flood
plain of South Buffalo Creek. The existing rock dams need
to be shaped and #57 stone placed on the upstream face. The
operator has seeded much of the interior of the site, and
little sediment is generated. The plan submitted with the
renewal appears adequate.

The owner intends to add an LCID landfill area to the site as part of the reclamation of the old -
pit. The application also includes a renewal for the next ten years of operation. The proposed
pit limits have been modified to reflect the pit expansion.
Please note that the permitted acreage in the application has been modified to reflect updated
survey data. The original acreage came from the deed which did not list all of the property
bearings and stated that the property line followed Muddy Creek. This acreage has been
updated based on the current aerial photography.

information supplied in the application with conditions added as necessary to
insure compliance with The Mining Act of 1971. This permit expires on
August 14, 2000. G, S. 74-65 states that the issuance of a mining permit

areas. This plan must include recommendations for time of seeding and the amount
and type of seed, fertilizer, lime and mulch per acre and general seeding

Your application for a mining permit for the Fryar Mine in Guilford
County has been reviewed. Enclosed is a draft of the mining permit proposed
by the Department. The conditions in the draft permit were based primarily
upon information supplied in your application with conditions added if
necessary to ensure compliance with The Mining Act of 1971.
Also enclosed is a form for your use in securing the required $12,500.00
surety bond. For your convenience, I have enclosed a bond form and an
assignment of a savings account form. The name on the bond or assignment
form must be the same as the name appearing on thg epplicatiurl fur a mining
permit. 1n addition to one of these alternatives you may, upon request,
substitute a cash deposit, mortgage of real property or negotiable
securities.
Please review the draft permit and contact this office should you have
any objection or question concerning the permit conditions. G.S. 74-51
provides the operator 60 days following the mailing of application approval
notice in which to file the required surety.
The permit will be issued when the required surety has been received.
No mining may be conducted until the permit is issued. G.S. 74-65 states
that the issuance of a mining permit does not supercede local zoning
regulations. The responsibility of compliance with the applicable zoning
regulations lies with you.

Guilford County
Staff of the WSRO have reviewed the application submitted by
Fryar Grading and Hauling, Inc. for the sand rock mine located
near McLeansville. This site had been mined under a county
permit, but was cited for mining without a state permit by our
letter of April 23, 1990. The following comments are made:
Is permit to be issued to Robert R. Fryar, Sr. or to
Fryar Grading & Hauling, Inc.
Existing haul road appears to be upgraded farm road.
Grade on the road iS probably 2% or slightly more.
Some rip rap is needed at a new culvert just north of
the railroad crossing.
L3� A graveled construction entrance is probably needed at
entrance of SR 2950 to prevent mud tracking offsite.
The entrance should be 100' long.
The rock dam for Phase 1 is in place and working. Maps
appear occurate.

Dear Mr. Fryar:
This is to inform you that you are violating the Mining
Act of 1971 by operating a mine without a permit as
required by North Carolina General statutes 74-46, et seq.,
as amended (herein after referred to as NCGS 74-46). You
are hereby directed to cease mining until a mining permit
is obtained.
On April 11, 1990, personnel of this office inspected a
mining operation being undertaken off McLeansville Road. It
has also been determined that you are the operator of this
mine.
Under the Mining Act, no person may operate a mine
without first obtaining a mining permit and also posting a
bond to ensure that the site is reclaimed. Mining is
defined by NCGS 74-49 as:
The breaking of the surface soil in order to facilitate
or accomplish the extraction or removal of minerals,
ores or other solid natter;
Any activity or process constituting all or part of a
process for the extraction or removal of minerals,
