He said he wants to reclaim the mine and close out the mining permit. According to Mr. Fryar, there is no more marketable material within the mining permit boundary. I told him if he still wants to operate the landfill, he would need to contact Guilford County about getting a sedimentation and erosion control plan approved by the County. Mr. Fryar said he would contact Earl Davis with the Guilford County Local Program regarding a permit forthe landfill. Mr. Fryar will be contactingyou or Ashley regarding a release request. I attached a copy of the mining inspection report. Our central office should contact you about the permit renewal application. What we need to do right now is get the plan revised to show erosion control measures around your current and proposed mining areas. These will need to be installed per the approved plan detail. Measures will not be needed in areas that are currently stable. I did make a note that Rock Dam #5 will need to be installed perthe approved plan with all associated diversion berms prior to any mining around that area. Nothing needs to be done with that area right now. Bryant, Piedmont Region Coordinator ulna,., 1 j I1 GECTIQN - Habitat Conservation Program DATE: 23 April 2009 SUBJECT: Mining Permit Renewal for Fryer Grading & Hauling, lne, Fryer Mine— Permit No. 41- 19, Guilford County, North Carolina Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject document and we are familiar with habitat values of the project area. Our comments ere provided in accordance with provisions of the Mining Act of 1971 (as amended, 1982) (G.S. 74-46 through 74-68 15 NCAC 5). The applicant is requesting a renewal of their permit to mine sandrock. The total permitted area is 122 acres. The applicant indicates the operation does not discharge water from the site and the area to be mined does not have natural watercourse or wetlands. Reclamation includes planting grasses and Impedes. Form uses for this site will include an LCID landfill area. Other areas will be allowed to re - vegetate with native trees and plants. The site drains to and borders South Buffalo Crack. South Buffalo Creek is a tributary to Buffalo Creek in the Cape Fear River basin. Should the permit be issued, we offer the following recommendations to reduce impacts to aquatic and terrestrial wildlife resources. 1. Maintain a minimum 100-foot undisturbed native, forested buffer along Perennial streams, and a minimum 50-fom buffer along intermittent streams and wetlands. Maintaining undisturbed, forested buffers along these areas will reduce impacts to aquatic and terrestrial wildlife resources, water quality, aquatic habitat both within and downstream of the project area. In addition, these buffers will provide an adequate travel corridor for wildlife species. Whereas, a grassed buffer, particularly fescue, is a vegetated buffer but will not provide the necessary and highly valuable functions as discussed for forested buffers. We request that sediment and erosion control structures be located outside of these butters. 2. We encourage the applicant to consider using seed mixtures that are beneficial to wildlife in their reclamation plan, such as native, warm season grasses. An exact seeding mixture would need to take into account soil types, moisture, pH, and degree of slope of areas to be stabilized. Bryant, Piedmont Region Coordinator Habitat Conservation Program DATE: 23 April 2009 SUBJECT: Mining Permit Renewal for Fryar Grading & Having, Inc., Fryar Mine — Permit No. 41- 19, Guilford County, North Carolina Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject document and we are familiar with habitat values of the project area. Our comments are provided in accordance with provisions of the Mining Act of 1971'(as amended, 1982) (G.S. 7446 through 74-68 15 NCAC 5). The applicant is requesting a renewal of their permit to mine sandrock. The total permitted area is 122 acres. The applicant indicates the operation does not discharge water from the site and the area to be mined does not have mutual watercourse" wetlands. Reclamation includes planting grasses and lespedera. Future uses for this site will include an LCID landfill was. Other mess will be allowed to re - vegetate with native trees and plants. The site drains to and borders South Buffalo Crack. South Buffalo Creek is a tributary to Buffalo Creek in the Cape Fem River basin. Should the permit be issued, we off" the following recommendations to reduce impacts to aquatic and terrestrial wildlife resources. 1. Maintain a minimum 100-foot undisturbed native, forested buffer along perennial streams, and a minimum 50•fom buffer along intermittent atrmms end wetlands. Maintaining undisturbed, forested buffos along these areas will reduce impacts to aquatic and terrestrial wildlife mrourms, water quality, aquatic habitat both within and downstream of the project area. In addition, these buffers will provide an adequate travel corridor for wildlife species. Whereas, a grassed buffer, particularly fescue, is a vegetated buffer but will not provide the necessary and highly valuable functions as discussed for forested buffers. We request that sediment and erosion control structurm be located outside of there buffers. We encourage the applicant to consider using seed mixtures that are beneficial to wildlife in their reclamation plan, such as native, warn season grasses. An exact seeding mixture would need to take into account soil types, moisture, pH, and degree of slope of arms to be stabilized. Any settling ponds or sediment basins shall be backfilled and stabilized. C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation. E. No contaminants shall be permanently disposed of at the mine site. On -site disposal of waste shall be in accordance with Operating Condition 11.A through E. F. The affected land shall be graded to prevent the collection of noxious or foul water. 3. Revecetation Plan: Aker site preparation, all disturbed land areas shall be revegetated as per the Revegetation Plan approved by Mr. Robert Grill, Landscape Architect. Whenever possible, disturbed areas should be vegetated with native warm season grasses such as switch grass, Indian grass, bluestem and gamma grass. In addition, the permiree shall consult with a professional wildlife biologist with the N.C. Wildlife Resources Commission to enhance post -project wildlife habitat at the site. 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. Our comments are provided in accordance with provisions of the Mining Act of 1971 (as amended, 1982)(G.S. 74-76 through 74-68 15 NCAC 5). Fryar Grading & Hauling, Inc. is requesting a modification of its current mining permit to mine sandstone. The requested modification is to add an additional 21.8 acres to the total permitted area of 122 acres. The applicant has indicated that them are no natural watercourses or wetlands running through the area to be mined and that there are no discharges to waters of the State. South Buffalo Creek, Cape Fear River basin, borders the site. South Buffalo Creek is on the North. Carolina 2000 303d list as an impaired water body. Protecting water quality is essential and proper erosion and sediment control should be strictly adhered to. We recommend that the following conditions be incorporated into the permit to reduce impacts to fish and wildlife resources. 1. In order to reduce stream impacts, while retaining some measure of wildlife habitat, we recommend a 100-foot undisturbed, native, forested buffer along perennial streams, and a 50-foot buffer along intermittent streams and wetlands for the present operation and any future expansions. Adequate nparian habitat and watershed protection is essential to the continued survival ofrarc aquatic species. Maintaining undisturbed, forested buffm. along these mass will reduce impacts to fish and wildlife resources, water quality, aquatic habitat both within and downstream of the project area, and help prevent the extirpation of endangered and threatened species. In addition, these buffers will provide an adequate travel corridor for wildlife species. Any future water discharges from the project site should be proportional to the size of the receiving stream, and all discharges should comply with NPDES permit requirements. In particular, turbidity of the discharge should be maintained at or below the permit requirement. High water discharge rates and turbidity can negatively impact aquatic and fisheries resources within and downstream of the protect area. Excessive silt and sediment loads can have numerous detrimental effects on aquatic resources including destruction of spawning habitat, suffocation of eggs, and clogging of gills of aquatic species. Implementation of these conditions should minimize impacts to aquatic and fisheries resources at and downstream of the project site. We encourage the applicant to consider using seed mixtures that are beneficiat to wildlife in their reclamation plan, such as native, wane season greases. An exact seeding mixture would need to talcs into account soil types, moisture, pH, and degree of slope of areas to be stabilized. Additionally, for relatively shallow sediment basin reclamaton, we recommend these areas be reclaimed as wetlands where practicable. Robert Fryar Or., the company owner, could not be reached Friday. If Guilford County commissioners approve it May 24, Fryar's landfill would take trash from local construction and demolition sites and bury it in two quarries. More than 22,000 tons of trash a year would be piled up to 24 feet above McLeansville Road. At odds: people concerned about truck traffic, pollution and an unsightly landfill near their homes, and builders who need places to dump the trash their conat - V-' projects create. Landfill space is at a premium in Guilford County. Hundreds of homes and businesses are built here every year, but Greensboro's White Street landfill is the only place builders can dump their trash. Fryar is one of at least two companies looking to build new landfills strictly for construction trash. Residents of McLeansville and northeast Guilford have long complained that their area is treated as a [Image] South Buffalo Creek winds its way along the back of the landfill property; anything that leaks out of the landfill might find its way to the creek. Five monitoring wells will be drilled between the landfill and the creek. Fryar plane random inspections of at least one truck per week that comes to the landfill. H expects 80 trucks per day, 5-1/2 days per week; inspecting one won't be enough, opponents say. The opponents draw parallels to a construction landfill on Groometown Road, owned by D.H. Griffin, that was closed after state inspectors found it was leaking chemicals into local wells. A copy of my inspection report is attached. The only problem on the site was an eroding ditch below existing Rock Dam 83. Sediment from the erosion was settling in a large fan in the flood plain of South Buffalo Creek. The existing rock dams need to be shaped and #57 stone placed on the upstream face. The operator has seeded much of the interior of the site, and little sediment is generated. This site had been mined under a county permit, but was cited for mining without a state permit by our letter of April 23, 1990. The following comments are made: Is permit to be issued to Robert R. Fryar, Sr. or to Fryar Grading & Hauling, Inc. Existing haul road appears to be upgraded farm road. Grade on the road iS probably 2% or slightly more. Some rip rap is needed at a new culvert just north of the railroad crossing. L3� A graveled construction entrance is probably needed at entrance of SR 2950 to prevent mud tracking offsite.
