This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Modifications July 10 2001: This permit has been modified to add 0.8 acres of affected land within the permitted area for the construction of a 30 foot gravel drive paralleling the existing drive, including the removal and reseeding of the existing drive, as indicated on Sheet 4 last revised May 18, 2001 and Sheet C-1A dated May 17, 2001. July 3, 2002: This permit has been modified to increase the affected area from 40 acres to 52.1 acres and to correct the permitted acreage (in light of better mapping) as indicated on the Mining Permit Renewal Maps, Sheets C-1, C-3, C-5, C-6, and C-9 last revised May 2, 2002 and Sheets C-2, C-4, C-7, and C-8 dated March 21, 2002. The modification includes increasing the depth of the mine to 275 feet and expanding the mine excavation area and processing area/haul roads to reflect the current site conditions. Mulch: All seeded areas shall be mulched using small grain straw at a rate of 2000 Ibs/acre and anchored appropriately. Whenever possible, disturbed areas should be vegetated with native warm season grasses such as switch grass, Indian grass, bluestem and gamma grass. In addition, the permittee shall consult with a professional wildlife biologist with the N.C. Wildlife Resources Commission to enhance post -project wildlife habitat at the site. 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Prior to final reclamation, a detailed reclamation plan clarifying how Miller Creek will be diverted into the quarry excavation shall be submitted to and approved by the Department. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. This permit, issued September 12, 1972, renewed September 27, 1982 and January 29, 1993, modified July 10, 2001, and renewed and modified July 3, 2002, is hereby renewed this 8th day of May 2012 pursuant to G.S. 74-52. It was found that Thompson Contractors was in compliance with the blasting requirements of its mining permit during the period in question. None of the blasts triggered the seismograph for ground vibration or airblast. The seismograph was set up at a distance closer than the closest offsite occupied structure (the location where compliance with the permit limits is determined). According to extensive research by the U.S. Bureau of Mines and others, particle velocities below 0.5 ips effectively eliminate the possibility of any structural damage. Airblast readings are a measurement of the atmospheric pressure wave (overpressure) with units in psi or dBL. The US Bureau of Mines recognized the level of 164 dBL for prevention of glass breakage. A key point worth noting is that glass breakage occurs at much lower levels of overpressure than structural damage, such as cracking plaster. Thank you for your interest and patience in this matter. This quarry is located 2.5 miles west of Rutherfordmn off Highway 108 in Rutherford County, N.C. This submittal is part of the required 10-year permit renewal process. The scope of work covered by this permit renewal includes expansion of the existing mine pit in order m pmvide 30 more years worth of active quarrying at the projected rate as well as further mining of the existing mine floor. Overburden removed as a result of the pit expansion will be spread and graded in selected areas and then seeded and re -vegetated with native hardwoods and pines as part of the reclamation process. For added stability, the existing grade to receive the fill material will be benched with 50 ft. wide x 10 ft. high benches. Overburden to be left in place will be sloped to the top of the rock (leaving a 10' wide safety bench) at the natural angle of repose (2:1) or flatter and then seeded with a mixture of permanent grass seed. Approximately 25.5 acres of land will be disturbed as a result of this work. Site Description: The existing quarry pit, located west of the proposed pit expansion has very steep cuts where the stone is mined. The floor of the existing mine pit where a portion of the work associated with this project will be conducted is relatively flat. Water collected in this pit is pumped out and routed through existing sill traps for treatment. The area designated to receive the overburden material generated from the mine pit expansion work is heavily to very heavily wooded and has a moderate to steep grade (approx. 17-23%) and slopes toward the east. In this same direction, an existing unnamed tributary flows along the eastern property line toward the southwest where it eventually discharges into Mountain Creek. A 50 foot undisturbed buffer will be maintained on each side of the creek to protect it from disturbance as a result of construction activities. Planned Erosion Control Silt fence will be provided down slope of all fill slopes. At the top of the fill slopes, diversion berms and slope drains will be provided to collect and transport stormwater to stabilized out falls at the base of the slope. Diversion ditches below will then collect and direct this sediment -laden runoff from the fill slopes into sediment basins (with risen and barrels) and silt pits for treatment which are easily accessible for routine maintenance by equipment available on -site. All erosion control devices are sized for a 25-year storm return frequency. Along the creek buffer, silt fence will provide an additional filtering mechanism for runoff which passes through the silt pits and sediment basins. Fill slopes will he tracked perpendicular to the slope with a bulldozer and then three-dimensional wood fiber erosion Control blankets will be provided on the fill slopes that face the stream.
