On behalf of HOM Development, LLC, Manteo, NC, this letter is in response to comments received
on May 6, 2021 from Ms. Renee Gledhill -Earley regarding the proposed Foster Forbes Mine in
Currituck County. After speaking with Ms. Gledhill -Earley today it was determined that further
information was needed by your office to clarify a couple of items. HOM Development is requesting
that the environmental review be looked at again regarding the following details:
• The only part of the 41-acre Foster Forbes parcel that will be excavated will be a 6.23-acre
portion in the back of a field. This field has been in cultivation for a minimum 35 years. The
entire parcel will not be excavated.
• As part of the mining permit application process, DEMLR advises the applicant to show
wetlands inside the permit area to determine correct wetland buffers. In addition, Currituck
County Planning requires an entire parcel to be permitted to determine the maximum
allowed acreage that can be mined, usually 30% of the parcel acreage remaining after
subtracting wetlands. These are the reasons that the whole Foster Forbes parcel was
permitted but only a small portion is being affected or mined.
• Of the 41-acre parcel, there are 9.47 acres of wetlands delineated by the US Army Corps of
Engineers. In addition, there are 3.50 acres of undisturbed buffers around the wetlands and
11.57 acres of undisturbed residential and property line setbacks. This gives a total of 24.54
acres of undisturbed lands out of the 41 acres in the parcel. Regarding mining, undisturbed
lands are defined as having no mining activity of any kind on the lands, including excavation,
stockpiles, processing, or haul roads. Those lands will not be entered by HOM Development
during the project.
• Outside of the 6.23 acres of excavation in the remaining 16.46 acres of usable land, the
remaining 10.23 acres will not be affected by mining activity beyond what was previously
affected by farming activities. All land affected during the mining project by vehicle usage or
stockpiles will be reclaimed to its original cultivated field status at the end of the project, as
required by NCDEQ regulation. There will be no excavation outside of the 6.23-acre
excavation area.
• There are no plans at this time to excavate beyond the proposed 6.23-acre excavation area in
the future.
HOM Development understands the importance of the history of our area and will always cooperate
fully with the requirements of the Department of Natural and Cultural Resources, and the State
Historic Preservation Office. We are asking for another review of the property considering the
information above. Attached to this email are a detailed site map of the proposed mine area, a
reclamation map showing the area after completion of the project, a higher overview map, and
aerial photography showing location of the proposed mine in relation to the area.
