REGAN sxmmrr TRACY DAVIS &rP[Mr This letter is to advise you of recent amendments to the North Carolina Mining Act of 1971 which impact the permit term of your existing mining permit. Pursuant to the passage of House Bill 56, which became law on October 4, 2017 as SL 2017-209, all existing mining permits and any newly issued mining permits are to be issued for the life of site or for the duration of the lease term. The "life of site" means the period from the initial receipt of a permit for the operation until the mining operation terminates and the required reclamation is completed. Considering the above, this letter hereby modifies your existing mining permit to remove all references to the prior expiration date to convert your permit to a life of site or lease permit effective immediately. No action is required on your part for this modification to be effective. Please attach this letter to your existing mining permit for future reference. The mine name and permit number on the permit document, and all existing operating and reclamation conditions contained therein, shall remain in full force and effect. Furthermore, all provisions of GS §74-51 and GS §74-52 still apply to all new, transferred and modified mining permits. In addition to the life of site or lease mining permit provision, St. 2017-209 also enacted a new annual mining permit operating fee of S400 per mining permit number. By statute, the initial payment of this annual S400 fee must be submitted to this office by December 31, 2017 — see the attached Invoice to remit the initial annual fee payment by this deadline. Beginning in 2018, the $400 annual operating fee must be submitted by July 1 of each year with the required Annual Reclamation Report as required by GS §74-55. Failure to submit the fee by the required deadline will result in a $50/month late fee and could result in the denial of future permit actions and/or revocation of your mining permit. Lastly, pursuant to GS §74-54, the cap on reclamation bonds has been raised from $500,000 to $1 million. Any adjustments needed in existing bonds will be initiated by this office or addressed during your next requested permit action unless you contact this office with a written request to have your bond reevaluated. The issuance of a mining permit and/or any modification to it does not supersede local zoning regulations. The responsibility of compliance with any applicable zoning regulations remains with you. As we discussed, the company name that has been listed on our mining permit applications in the space for "Name of Applicant' for many years has been Martin Marietta Materials, Inc., though the mining permits have been issued under the name of Martin Marietta Aggregates which is an operating division of Martin Marietta Materials, Inc., but not a separate legal entity or subsidiary. In review of the permits issued for Martin Marietta's quarries, we have determined that all of the previous mining permit renewal applications and the most recent mining permit modification submittals have been requested using the corporate legal name of Martin Marietta Materials, Inc., along with all of the associated Land Entry Agreements that are currently on file with your Department. Therefore, it is our understanding that the documents currently on file with your office are correct, and it is not necessary to submit additional documentation. The attached Surety Rider reflects a correction to the more of the Principal of the existing Reclamation Blanket Bond from "Martin Marietta Aggregates, a Division of Martin Marietta Materials, Inc., a Subsidiary of Marron Marietta Corporation" to "Martin Marietta Materials, Inc." It is our desire that all existing and future mining permits that are issued by your Department to Martin Marietta be listed with the legal corporate name of Marlin Marietta Materials, Inc. Pormit No. 35-08 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject permit renewal. Our comments are provided in accordance with provisions of the Mining Act of 1971 (as amended, 1982) (G.S. 74-76 through 74-68 15 NCAC 5). The applicant is requesting a renewal of their mining permit to mine granite. The total permitted area is 236.09 acres. The operation involves discharging fresh or waste water from the site as a point discharge. A 50-foot undisturbed buffer is required between land disturbing activities and any natural watercourses and wetlands. Final reclamation includes grading and re -vegetating the site. An unnamed tributary to Cedar Creek in the Tar -Pamlico River basin flows through the site. There are records for the federal and state endangered dwarf wedgemussel (Alosmidonra heferodon) and the state threatened triangle floater (Alosmidonta undulata) in Cedar Creek. We offer the following recommendations to reduce impacts to aquatic and terrestrial wildlife resources. Due to the presence of the dwarf wedgemussel downstream of the site, we recommend a minimum 200-fool undisturbed, native, forested buffer along perennial streams, and a 100-foot buffer along intermittent streams and wetlands for the present operation and any future expansions. Maintaining undisturbed, forested buffers along these areas will reduce impacts to aquatic and terrestrial wildlife resources, water quality, aquatic habitat both within and downstream of the project area. In addition, these buffers will provide an adequate travel corridor for wildlife species. Whereas, a grassed buffer, particularly fescue, is a vegetated buffer but will not provide the necessary and highly valuable functions as discussed for forested buffers. We request that sediment and erosion control structures be located outside of these buffers. Overburden cut slopes along the perimeter of the quarry opening shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Our comments are provided in accordance with provisions of the Mining Act of 1971 (as amended, 1982XG.S. 74-76 through 74-68 15 NCAC 5). Martin Mariana Materials, Inc. is requesting a modification of their permit for mining granite. The modification involves increasing the acreage permitted for disturbance by 4.8 acres for Tailings/Sediment Ponds and 0.6 acres for Wastepiles. The total permitted acreage is 237 acres. Tributaries to Buckhorn Crack flow through the site. Buckhorn Crack is a tributary to Shearon -Harris Reservoir in the Cape Fear River basin According to the map provided it appears that a 50 fool buffer is maintained on streams that Row through the site. However, the future pit is shown to expand and directly impact a segment of one of these tributaries. We recommend that these plans be modified so the stream and its buffer will not be directly impacted by mining activities. We recommend that the following conditions be incorporated into the permit to reduce impacts to fish and wildlife resources. In order to reduce stream impacts, while retaining some measure of wildlife habitat, we recommend a minimum 100-foot undisturbed, native, forested buffer along perennial streams, and a 50-foot buffer along intermittent streams and wetlands for the present operation and any future expansions. Adequate riparian habitat and watershed protection is essential to the continued survival of rare aquatic species. Maintaining undisturbed, forested buffers along these areas will reduce impacts to fish and wildlife resources, water quality, aquatic habitat both within and downstream of the project area, and help prevent the extirpation of endangered and threatened species. According to the site map provided with the application a 50-foot undisturbed buffer is maintained along the stream. it appears that the current limit of disturbance for the pit is approximately 150-feet from the stream bank; the proposed modification would extend the limit of disturbancc to within 80 feet of the stream bank. In previous correspondence (Fender, 4 November 2002) regarding a proposed modification for this site, we recommended the applicant maintain a 100-foot undisturbed, native, forested buffer along perennial streams, and a 50-foot buffer along intermittent streams and wetlands for the present operation and any future expansions. According to the Franklinton Quadrangle topographical map, it appears Iliac the stream that (lows betwcen the pit and stockpile area is a perennial stream. Due to the presence of the federal and state endangered dwarf wedgemussel downstream of the site, we are concerned about the pit expansion since it appears it will result in a stream buffer of less than 100-feet. Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. The permanent access (plant entrance) road shall be paved for a minimum of 200 linear feet from its junction with the adjoining property boundary, C. During quarry operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3. Buffer Zones A. Any mining activity affecting waters of the State, waters of the D. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. B. Sufficient buffer (minimum 50 foot undisturbed except in those areas where the buffer has been previously disturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland. DAll buffer zones shown on the Mine Map last revised October 7, 2002 shall be maintained to protect adjoining property. These buffer zones, with the exception of the installation of required sediment control measures and approved earthen berms, shall remain undisturbed. 4. Erosion and Sediment Control A. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, silt check dams, silt retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. B. The erosion and sedimentation control measures shall be installed and maintained as indicated on the mine map last revised May 19, 1997 with the following stipulations: 1. The minimum thickness for dissipater pads using Class B and Class A riprap is 22 inches and 9 inches, respectively. 2. The roadside ditches associated with the entrance road construction, not proposed to be armored with riprap, shall be provided with a temporary liner. C. All mining activities, including the installation and maintenance of all erosion and sedimentation control measures, shall be conducted as indicated on the Mine/Stcrmwater Map last revised October 27, 1998 to prevent off -site sedimentation. • • Page 5 D. The erosion and sedimentation measures associated with the reconfiguration of the future berm, closed loop settling cell system and freshwater pond shall be constructed and maintained as indicated on the 8 'h x 11 inch mine map dated March 29, 1999. E. The erosion and sedimentation control measures for the stockpile expansion shall be constructed and maintained as indicated on the 8 Y: x 11 inch mine map faxed to the Land Quality Section on September 9, 1999. F. Any land -disturbing activities indicated as "Future Berm' and "Future Fresh Water Pond" on the MinelStormwater Map last revised July 20, 1999 shall not be initiated until each activity's associated erosion and sedimentation control measures have been approved by the Department. G. The sediment and erosion control measures for the stockpile expansion shall be constructed and maintained as indicated on the mine map received by the Land Quality Section on January 24, 2000 and the supplemental information dated January 17, 2000. The rock check dam shall be constructed entirely of rock. H. Mining activities, including the installation and maintenance of all erosion and sediment control measures, shall be conducted as indicated on the Mine Map last revised October 7, 2002. nAn erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised \ erosion control plan or mine maps submitted with the approved application for a mining,permit and any approved revisions to it. Such areas include, but are not limited to, expansion outside of the approved pit area, creek crossings, or expansion of overburden or waste disposal areas. 5. Groundwater Protection OThe observation wells denoted on the Mine Map last revised October 7, 2002 shall be monitored at least 30 days prior to initiating any excavations of consolidated material (rock) in the initial pit area to allowfor the determination of pre-existing (static) groundwater levels. B. The observation wells shall be drilled wells cased into consolidated rack and grouted to the surface. The wells (boreholes) shall be extended at least 50 feet below static water level, or at least 50 feet into unweathered rock, whichever is deeper. The wells shall be secured against unauthorized entry with a lockable cap. The necessary permits or approvals to construct these wells shall be obtained from the N.C. Division of Water Quality, Groundwater Section. C. The observation wells shall be monitored quarterly at the same day and approximate time of day. The static water levels shall be measured with an accuracy of plus or minus 0.1 foot and shall be referenced to a datum point and a record of the water levels maintained. The quarterly precipitation and the volume of pit water discharge shall also be recorded. Copies of these records shall be provided to the Department on or about the end of each quarter. The operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. J. Notice: The operator shall, when requested by the Department, give 24 hour advance notice to the Land Quality Section Regional Office prior to any blast during a period for which notice is requested. 9. Hiah Wall Barrier A physical barrier consisting of large boulders placed end -to -end or fencing shall be maintained at all times along the perimeter of any highwall to prevent inadvertent public access. In addition, a minimum 10 foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of any overburden cut slope. 10. Visual Screening A. Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be employed as deemed �\ appropriate by the Department. Vegetated earthen berms, including the installation and maintenance of all associated erosion and sedimentation control measures, shall be located and constructed as shown on the Mine Map last revised October 7, 2002. In addition to grasses, long leaf and/or Virginia pines or other acceptable evergreen species shall be planted asdeemed appropriate by the Department to improve visual and noise buffering. 11. Plan Modification The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in theapproved application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. 12. Refuse Disposal A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. Pender, Piedmont Region Coordinator Habitat Conservation Program DATE: 4 November 2002 SUBJECT: Mining Permit Modification Rcquest for Martin Marietta Aggregates, Franklin Quarry- Permit No. 35-08, Franklin County, North Carolina Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject permit renewal Our comments are provided in accordance with provisions of the Mining Act of 1971 (as amended, 1982) (G.S. 74-76 through 74.68 15 NCAC 5). The applicant is requesting a modification of its current mining permit to mine granite. The total permitted acreage is 236.09 acres, and the modification will result in an additional 5.4 acres of affected area. The modification involves expanding a stockpile area. A tributary of Cedar Creek in the Tar -Pamlico River basin flows through the site. According to the map provided, a 50-foot buffer is provided for the stream on the property. There are records for the existence of the federal and state endangered dwarf wedgemussel (Alasmidowa heterodon) and edar the state threatened triangle floater (Alasmidonra undulata) in CCreek downstream of the project site. In addition, many listed species have been found to occur in the Tar River, including the federal and state endangered Tar River spinymussel (Ellipiio steinsransana) and the federal species of concern and state threatened yellow lance (Elllptio lanceolam), Atlantic pigtoe (Fusconaia masoni), and yellow lampmussel (fampsilis mriasa). We recommend that the following conditions be incorporated into the permit to reduce impacts to fish and wildlife resources. In order to reduce stream impacts, while retaining some measure of wildlife habitat, we recommend a 100-foot undisturbed, native, forested buffer along perennial streams, and a 50-foot buffer along intermittent streams and wetlands for the present operation and airy future expansions. Adequate riparian habitat and watershed protection is essential to the continued survival of rare aquatic species.
