We have reviewed the transfer request your company submitted for the referenced mine site. In order for this office
to complete its review of the referenced project in accordance with G.S. §74-50 and §74-51 of the Mining Act of
1971, please provide the additional or revised information in accordance with the following comments:
1. Please provide a current mine map that reflects current site conditions. The mine map must include the
items listed in section B.2 of the mining permit application.
2. Please maintain Erosion and Sediment Control (E&SC) measures as noted in the mine inspection report.
Please clearly mark the mine permit boundaries as specified in Condition 5 of the mining permit. All
affected area boundaries (30.22 acres) shall be permanently marked at the site on 100-foot intervals
unless the line of sight allows for larger spacing intervals.
4. Please provide an estimated life of the mine on pg. 3 or pg. 14 of the mine permit application. This
value is used to determine the inflation factor on the bond reclamation worksheet.
Your current permit does not allow dewatering. Please cease dewatering immediately. If you would
like to continue to dewater you must submit a modification application along with a modification fee
of $650.00. ($750.00 Modification fee less $100.00 already submitted transfer fee.)
6. Please clarify how sediment will be maintained when mining through the ditch in the in the middle of
the property that runs from the northwest to the southeast and terminates on Seville rd.
Please note, this office may request additional information, not included in this letter, as the mining application
review progresses. Be advised that our review cannot be completed until all of the items listed above have been
fully addressed.

As required by 15A NCAC 513.0113, you are hereby advised that you have 180 days from the date of your receipt
of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request
additional time, you must submit information, in writing, to the Director clearly indicating why the deadline cannot
be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be
made to grant or deny the mining permit based upon the information currently in the Department's files at the end
of the 180-day period.
Though the preceding statement cites the maximum time limit for your response, we encourage you to provide the
additional information requested by this letter as soon as possible. Your prompt response will help us to complete
processing your application sooner.

If no, explain: They were using a dewatering system that was not on the mine map and had not
yet been approved. A large sediment trap had been built since the previous inspection with a new pum //pipe
configuration and a portable generator.

The rock check dam is right on the 50 ft border of the buffer.

their permit, no markers were noticed during inspection, but they were at least stayingon n the property.
