Subject: NLR Mine, Carteret County, Mining Permit Application
Dear Mr. Parr;
I am writing in response to your July 15, 2021 letter to Donald Bryant Jr in which you
requested additional information on the proposed NLR Mine in Carteret County. I will respond
to each item in your letter in the same order for clarity;
1. There are no jurisdictional wetlands within the permitted area. The delineation was approved
by Thomas Charles with the US Army Corps of Engineers. The attached report contains the
findings of the approved JD as well as copies of email correspondence confirming the US Army
Corps of Engineers approval of the JD.
2. The silt fence and perimeter berm will be installed prior to any other land disturbance. The
perimeter berm and silt fence will be located around the perimeter of the mining area, as shown
on the Mine Map.
3. It is important to understand that this is a very simple "mine plan", which is actually a simple
excavation of a "farm pond", with the soil / sand that is excavated being removed from the site
and used in various construction projects. Mining will occur below the water table by utilizing a
backhoe to excavate the sand from the water. No dewatering is necessary, as the excavation
will only extend to the depth that can be obtained by the backhoe. Mining will begin in the back
of the pond (east side), and gradually move west. Stormwater will be controlled by the silt fence
and perimeter berm. Since the site is essentially flat, any stormwater will be retained within the
site (pond).
4. The affected acreage is essentially only the pond. The acreage chart was replaced by the
standard chart from the Mining Permit application for clarity.
5. Please see attached letter from Mr. Bryan Chadwick, Town Manager for the City of Newport.
6. The 50 foot undisturbed buffer along the creek on the east side has been labeled.
7. The buffer has been clarified as "undisturbed" and "unexcavated"
8. The 100 year floodplain and floodway have been added to the Mine Map.

INTRODUCTION & SITE DESCRIPTION
Ground Truth Soil Consulting, PLLC (Ground Truth) was employed to complete a
Jurisdictional Feature Determination within the study area located on the east side of
Newport Loop Road in Newport, Carteret County, NC. The study area consists of two lots
totaling 22.86-acres (PIN: 634901255600000 and 634901253099000) (Figures 1 - 3).
INVESTIGATION METHODOLOGY
The field survey was conducted in April 2021, by John C. Roberts, LSS. The jurisdictional
delineation was performed using the three -parameter approach as prescribed in the 1987 US
Army Corps of Engineers (USACE) Wetlands Delineation Manual (Environmental
Laboratory 1987). The Regional Supplement to the Corps of Engineers Wetland Delineation
Manual: Atlantic and Gulf Coastal Plain Region (Version 2.0) was also utilized. Hydric soil
determinations were made using Field Indicators of the Hydric Soils in the United States,
Version 8.2 (2018).
FINDINGS
Two jurisdictional ditches were identified on the property (Figures 1 - 3). A site visit with
Army Corp of Engineers (ACOE) representative Thomas Charles was completed on May 11,
2021. The two jurisdictional features included Deep Creek, a ditch located on the northeast
border of the northern tract, and a portion of the ditch perpendicular to Deep Creek. The
jurisdictional portion is 16-ft and extends from the ordinary high water mark for Deep Creek
16-ft upslope within the ditch. A blue flag was tied at the upslope limit of the jurisdictional
ditch. It is highly recommended that development of this property is completed without any
impacts to the jurisdictional features.
CONCLUSIONS
Three jurisdictional features were identified within the project study area and were verified
by the ACOE. Extreme care should be taken to not impact or disturb these features.

discussed at the site, a 16-ft section at the confluence of the ditch and Deep Creek was marked and is considered
jurisdictional. The remainder of that ditch and the other ditch (parallel to Deep Creek) lacked adequate hydrology to be
declared jurisdictional. The operation will comply with the required 50-ft setback to all other jurisdictional ditches and
Deep Creek. I have attached the updated site maps that include an aerial, soils, and LiDAR. Please let me know if you
have any questions or need any additional information.
