While I realize the state is mine friendly. Please also consider this is a very diverse,
economically disadvantaged community with a significant portion of our community being
African American. The optics of an approval could be viewed as targeting an area that's
already down on their luck, so what does it matter. Also, we have a landfill 2 miles away that
has been open for 25 years. The landfill alone is enough for the local residents to deal with.
We have adopted the local roads in an effort to reduce trash spilled out from trucks and cars.
This attempt for a mine could be deemed as inconsiderate at this point in time. I think the
landfill is enough for the community to deal with. While I realize the state may not consider
these issues, just wanted to make you aware. Thanks Mark

A thorough review of the application includes routing the application to other State agencies
as stated in G.S. §74-50 (b3), so that they may provide comments as necessary.
The Department has a 60-day review clock to review the application and any comments
provided. Should the Department request additional information from the applicant, the
applicant would have 180 days to respond to the letter requesting additional information.
The Department's 60-day clock would start over upon the Department's receipt of all of the
requested information. Such a process would continue until all of the Department's
questions have been answered and a decision is made on the application.
I have copied Jenna Spencer, another member of the Mining Program, who will be
reviewing this applicant as well as the comments provided by the other State agencies. Any
questions related directly to the details in the application can be directed to her.

Thanks for the time on the phone today. As we discussed I do not currently have an
application in for a mining permit in Caldwell County. I will keep my eyes open and
try to remember to let you know if I see one.
I will also reach our to the Regional Office, where our field inspectors are located to see

Hello Adam,
How can I find out if Hoods Creek Soil Company has filed a request / application to

mine near my property? This would be very recent, most likely in the last week. This
is located in Caldwell County, Lenoir, NC 28645. Mining would occur on Hoods
Creek Road.
