In regards to the correspondence below, I have submitted a mining application for this property, which I believe is being reviewed. In the mining regulations, it says that mining does not include the following: 1. a single off -site construction project; 2. does not exceed 5 acres; 3. excavation completed within 1-year; 4. does not involve blasting; 5. does not violate a local ordinance; 6. An E&S plan has been approved. My original application was for 25 acres and therefore required the mining application. If I were to back this down to 5 acres, could I resubmit for an E&S permit or does the entirety of the site, including the previous borrow permit, prevent this option? This may be what the County Planning Board was trying to direct me towards before with my original submittal. I've got upset neighbors due to the mining aspect. I recommend not updating the E&S Plans for resubmission to this Regional Office (as a borrow pit). Depending on your client's timeline, I would wait until after checking with the Mining Office in Raleigh for direction (as soon as you can). However, I would immediately begin the process of assembling the Mining Permit Application. The E&S plans you have already completed will be part of the mining permit submittal to the Mining Office in Raleigh. If this site is determined to be a mine, then the permitting will be handled through Raleigh. If this site is determined to be a mine, I think you can simply request to withdraw the original E&S submittal here at the Regional Office. If this site is not a mine then the E&S plans would be resubmitted to this office for review and permitting. I hope I have given you accurate guidance. Mr. Hoffinan, I think your original assumption was correct, the site should be permitted as a mine. Here is a copy/paste of the wording from our erosion control plan design checklist "If the affected area associated with excavation, processing, stockpiles and transport of such materials will comprise 1 or more acres, and materials will be leaving the development tract, a mining permit will be required." The Regional Office does not permit mines. Before submitting the plans, and for further information or clarification, please contact the State Mining Engineer, Mr. David Miller, P.E. at 877-623-6748. I'm currently updating the plans, calculations and report along with preparing a response letter to identify the changes. Comment #12, suggests the need for applying for a mining permit if more than 1 acre is to be disturbed and soils or materials are transported offsite. This is our intention. Should I only be applying for the mining permit or will the E&S permit also be required, or is one part of the other? My original request to the County Planning Board was to apply for a mining permit and their recommendation was to apply for the E&S permit as a borrow permit.
