From CADD, the area to be excavated is approximately 2.91 acres. The entrance and road leading to
this area is approximately 0.86 acres. The pre-existing road off of Bryant Road, disturbed to gain
entry into the site with equipment is approximately 0.77 acres for a total of 4.54 acres. These areas
will be surveyed and staked in the field to remain below the 5 acre limit.
I will submit an E&S permit application this week to the Regional office in Swannanoa.

Ray,
As we discussed on the phone, the option to operate as a 5 acre single use borrow pit versus a
mining operation largely depends on the current conditions of the. Shawna Riddle, from the
Asheville Regional office, is scheduled to visit the site later this week for an inspection.
• If there are already more than 5 acres disturbed, then you will have to continue with the mine
permit application, as this would be considered mining under N.C.G.S. §74-49.
• If there are less than 5 acres disturbed and the other conditions under G.S. §74-49 (7)(f) are
met, then this activity would not be considered mining. You could withdraw your mine permit
application and re -submit your Erosion and Sediment Control (E&SC) plan to the regional
office for approval.
Please keep in mind that until there is an approved mine permit or an approved E&SC Plan, there
can be no activity on site.
If the site is operated as a 5 acre single use borrow pit and the disturbed acreage increases over 5
acres or the other conditions under G.S. §74-49(7)(f) are not met, then this would be considered
mining without a permit.
If the mine permit application is withdrawn and resubmitted at a later date, there can be no activity
while the application is under review with the Department.

Thanks Adam for this response. Due to the timing of this project, to supply clay liner materials to the
landfill, which is currently under construction, we would like to apply for the single use borrow pit
permit (if possible). The County's Planning Board had directed me towards this route, which I
followed, however with more than 5 acres. I believe this would be the shortest duration to obtain
permit coverage for the project.
We would then follow up with the mining application after this project is complete and stabilized or
possibly decide on another use for the property.
If this is not possible, I will let the contractor know that they will have to go elsewhere for their clay
on this project. I do appreciate your help on this.

Raymond,
The intent of the 5 acre threshold (along with the other stipulations) for a single use borrow pit, is
for single use. Since you have stated that your intent is to use the property when ever the landfill
needs clay liner (roughly 2-3 year schedule) you would be disturbing more than 5 acres and
intending to use the property for "mining" and therefore need a mining permit.
Also, the disturbed area includes any non-public roads. It appears from aerial imagery that there has
already been over 5 acres disturbed.

Good morning Adam,
Following up on our conversation yesterday and making sure you have my e-mail contact. Were you
able to determine if I could apply for a borrow permit, staying under the 5 acre disturbance limit and
also meeting the other requirements, to not be considered mining? I will need a few days to update
drawings and calculations to be able to resubmit for the E&S permit.
I spoke with the contractor this morning, they are installing silt fence, a sediment trap or two and
will be seeding and covering disturbed areas today. They did complete the driveway entrance onto
Hoods Creek Road and will be installing a lockable gate to prevent access into the site. All other
work has stopped.
I will stop by the site over the weekend to check on site conditions. Thank you.
