REGAN secmrury TRACY DAVIS aurvror This letter is to advise you of recent amendments to the North Carolina Mining Act of 1971 which impact the permit term of your existing mining permit. Pursuant to the passage of House Bill 56, which became law on October 4, 2017 as SL 2017-209, all existing mining permits and any newly issued mining permits are to be issued for the life of site or for the duration of the lease term. The"life of site" means the period from the initial receipt of a permit for the operation until the mining operation terminates and the required reclamation is completed. Considering the above, this fetter hereby modifies your existing mining permit to remove all references to the prior expiration date to convert your permit to a life of site or lease permit effective immediately. No action is required on your part for this modification to be effective. Please attach this letter to your existing minino permit for future reference. The mine name and permit number on the permit document, and all existing operating and reclamation conditions contained therein, shall remain in full force and effect. Furthermore, all provisions of GS §74-51 and GS §74-52 still apply to all new, transferred and modified mining permits. In addition to the life of site or lease mining permit provision., SL 2017-209 also enacted a new annual mining permit operating fee of $400 per mining permit number By statule, the initial payment of this annual $400 fee must be submitted to this office by December 31, 2017 — see the attached Invoice to remit the initial annual fee payment by this deadline. Beginning in 2018, the $400 annual operating fee must be submitted by July 1 of each year with the required Annual Reclamation. Report as required by GS §74-55. Failure to submit the fee by the required deadline will result in a $50/month late fee and could result in the denial of future permit actions and/or revocation of your mining permit. Lastly, pursuant to GS §74-54, the cap on reclamation bonds has been raised from $500,000 to $1 million. Any adjustments needed in existing bonds will be initiated by this office or addressed during your next requested permit action unless you contact this office with a written request to have your bond reevaluated. The issuance of a mining permit and/or any modification to it does not supersede local zoning regulations. The responsibility of compliance with any applicable zoning regulations remains with you. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut slopes along the perimeter of the quarry opening shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum ten (10) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of any overburden slope. 7. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. S. Blastin The operator shall monitor each blast with a seismograph located at a distance no farther than the closest off site regularly occupied structure not owned or leased by the operator. A seismographic record including peak particle velocity, air overpressure, and vibration frequency levels shall be kept for each blast (except as provided under Operating Condition Nos. 88 and 8D of this permit). The following blasting conditions shall be observed by the mine operator to prevent hazard to persons and adjacent property from surface blasting: A. Ground Vibration With Monitoring: In all blasting operations, the maximum peak particle velocity of any component of ground motion shall not exceed Figure 1 (below) at the immediate location of any regularly occupied building outside of the permitted area such as a dwelling house, church, school, or public, commercial or institutional building. Mining activities shall not occur within 100 feet of the existing SR 1104 (Bethel -Hickory Grove Church Road) until said road is permanently closed to public traffic. All mining activities, including the installation and maintenance of all sediment `-\ and erosion control devices, shall be conducted as indicated on the Mine Map last revised August 23, 2004. E. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the approved application for a mining permit and any approved revisions to it. Such areas include, but are not limited to, expansion outside of the approved pit area, creek crossings, or expansion of overburden or waste disposal areas. 5. Groundwater Protection Groundwater monitoring wells shall be installed and monitored as deemed appropriate by the Department. 6. Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut slopes along the perimeter of 'any pit expansion conducted after 'the quarry opening shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum ten (10) foot wide horizontal safely bench shall be provided at the top of the rock and at the toe of any overburden slope constructed after'. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. Page 6 8. Blasting The operator shall monitor each blast with a seismograph located at a distance no farther than the closest off site regularly occupied structure not owned or leased by the operator. A seismographic record including peak particle velocity, air overpressure, and vibration frequency levels shall be kept for each blast (except as provided under Operating Condition Nos. 88 and BD of this permit). The following blasting conditions shall be observed by the mine operator to prevent hazard to persons and adjacent property from surface blasting: A. Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 14. Bonding The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $500,000.00 blanket bond, is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. Archaeological Resources Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. Page 12 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or are likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. This is made from the large quarry stone and we consider it to suffice as the high -wall barner. The fence that the inspector commented on is a chain -link fence that we installed around the property as an extra security measure. We feel that it is not part of.any mine -permit requirement and believe that it can remain in place. The land owner has no plans for the acreage to be released and the fence will remain in place. We disagree with the mine inspection report comment that they will return to the site at a later date to verify that the fence has been moved. We are not moving the fence and have no plans to move the fence. You state that we should relocate the chain link fence that extends around the 7.7 acre area that:we are removing from the permit. This fence was installed as an additional safety measure and is not required by the Mine Permit. It has been Martin Marietta policy over the last decade to try to install additional chain link fencing around all of our sites as added security. The High Wall Barrier requirement in the permit (Condition 9) states that "a physical barrier consisting of large boulders placed end -to -end or fencing shall be maintained at all times along the perimeter of any highwall to prevent inadvertent public access." This site does have highwall protection around the top of the pit and this protection is a series of boulders. We consider these boulders as the device meeting the requirements of Condition 9. The fence will remain in the location that you observed. It will continue to serve as additional security but it will actually be located outside of our property for a short stretch where this 7.7 acres is located. We therefore do not believe that the chain link fence needs to be relocated. I wanted to clarify for you how we viewed the issue. Permit No. 68-02 Biologists with the North Carolina Wildlife Resources Canmission have reviewed the subject permit modification request and we are familiar with the habitat values of the area. Our comments are provided in accordance with provisions of the Mining Act of 1971 (as amended, 1982XG.S. 74.76 through 74-68 15 NCAC 5). The applicant is requesting a modification of its current mining permit to mine granite, The total permitted acreage is 165.1 acres, and the modification involves 2.0 acres. The applicant is proposing to increase the stockpile area; 1.6 acres in new area and 0.4 acres of existing processing area will be ro- designated as stockpile area. Phils Creek and its tributaries flow through the site. It appears that a 50-foot butler is maintained along Phils Creek and its tributaries. Phils Creek is a tributary of Morgan Creek in the Cape Fear River basin. There are records the federal species of concern and state endangered Savannah lilliput (Taxolasma pullus) downstream in Morgan Creek; therefore; protecting water quality is essential and proper erosion and sediment control should be strictly adhered to. While we have no objections to the proposed modification, we recommend that the following conditions be incorporated into the permit to reduce impacts to fish and wildlife resources. L In order to reduce stream impacts, while retaining some measure of wildlife habitat, we recommend a 100-foot undisturbed, native, forested buffer along perennial streams, and a 50-fool buffer along intermittent streams and wetlands for the present operation and any future expansions. Adequate riparian habitat and watershed protection is essential to the continued survival of rare aquatic species. Maintaining undisturbed, forested buffers along these areas will reduce impacts to fish and wildlife resources, water quality, aquatic habitat both within and downstream of the project area, and help prevent the extirpation of endangered and threatened species. In addition, these buffers will provide an adequate travel corridor for wildlife species. Whereas, a grassed buffer, particularly fescue, is a vegetated buffer but will nor provide the necessary and highly valuable functions as discussed for forested buffers. We request that sediment and control measures be located outside of these buffers. RACO ® 0 Page 3 January 14, 2003: This permit has been modified to increase the permitted acreage to 165.1 acres and the affected acreage to 130.7 acres as indicated on the Mine Map last revised December 4, 2002. The modification includes the expansion of the pit area to the southeast, development of a new berm, relocation of the entrance road and construction and maintenance of the associated erosion and sediment control measures. Expiration Date This permit shall be effective from the date of its issuance until May 19, 2013. Conditions This Permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, el. seq., and to the following conditions and limitations: OPERATING CONDITIONS: Wastewater and Quarry Dewaterino A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. OAny storm water runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Storm water Section, Division of Water Quality, to secure any necessary storm water permits or other approval documents. 2. Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. During quarry operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. Buffer Zones A. Any mining activity affecting waters of the State, waters of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. B. Sufficient buffer (minimum 50 foot undisturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the �\ integrity of the natural watercourse or wetland. All buffer zones shown on the Mine Map last revised April 10, 2003 shall be maintained to protect adjoining property. These buffer zones, with the exception of the installation of required sediment control measures and approved earthen berms, shall remain undisturbed. ® ® Page 5 5. Groundwater Protection Groundwater monitoring wells shall be installed and monitored as deemed appropriate by the Department. 6. Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angle that can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut slopes along the perimeter of the quarry opening shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum ten (10) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of any overburden slope. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Blasting The operator shall monitor each blast with a seismograph located at a distance no farther than the closest.off site regularly occupied structure not owned or leased by the operator. A seismographic record including peak particle velocity, air overpressure,eand vibration frequencydbveis shall be kept for each blast (except as provided under Sections B. and D. of this permit). Ground Vibration Without Monitoring: In the event of seismograph malfunction or other condition that prevents monitoring, blasting shall be conducted in accordance with the following formulas: W = (D/D3)2 W D = D V = 160(Ds)"-' W = Maximum charge weight of explosives per delay period of 8.0 milliseconds or more (pounds). D = Distance from the blast site to the nearest inhabited building not owned or leased by the mine operator (feet). Ds = Scaled distance factor. V = Peak Particle Velocity (inches per second). The peak particle velocity of any component shall not exceed 1.0 inch per second, for the purposes of this Section. C. Airblast With Monitoring: Airblast overpressure resulting from surface blasting shall not exceed 129 decibels linear (dBL) as measured at the immediate location of any regularly occupied building not owned or leased by the operator outside of the permitted area such as a dwelling house, church, school, or public, commercial or institutional building, unless an alternate level based on the sensitivity of the seismograph microphone as specified below is being used: ® Page 9 9. High Wall Barrier A. A physical barrier consisting of large boulders placed end -to -end or fencing shall be maintained at all times along the perimeter of any hlghwall to prevent inadvertent public access. In addition, a minimum 10 foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of any overburden cut slope. B. Highwall Barrier Option 1 or Option 2 shall be provided at all times along SR 1104 as indicated on the Mine Map last revised April 10, 2003 and Detail Map dated April 10, 2003 to prevent inadvertent public access. 10. Visual Screening A. Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Plan Modification The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. 12. Refuse Disposal A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1) On -site generated land clearing debris 2) Conveyor belts 3) Wire cables Page 12 C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegelation. E. No contaminants shall be permanently disposed of at the mine site. On -site disposal of waste shall be in accordance with Operating Conditions Nos. 12.A. through D. F. The affected land shall be graded to prevent the collection of noxious or foul water. Revegetation Plan: Disturbed areas shall be permanently re'evveg ted according to the Revegetation Plan provided on the Detail Map dated April 10, 2003. Whenever possible, disturbed areas should be vegetated with native warm season grasses such as switch grass, Indian grass, bluestem and gamma grass. In addition, the permittee shall consult with a professional wildlife biologist with the N.C. Wildlife Resources Commission to enhance post -project wildlife habitat at the site. 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. This permit, issued September 11, 1972, renewed September 27, 1982, renewed and modified April 16, 1993, and modified July 17, 1998, June 7, 2001, May 6, 2002 and January 14, 2003, is hereby renewed this 19°i day of May 2003 pursuant to G.S. 74-52. Permit No. 68-02 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject permit modification request. An on -site investigation was conducted on 12 May 1998 to further evaluate the potential for adverse impacts on fish and wildlife resources. Our cwmments are provided in accordance with provisions of the Mining Act of 1971 (as amended, 1982)(G.S. 74.76 through 74-68 15 NCAC 5). The applicant is requesting a renewalof its current mining permit to mine granite. The total permitted acreage is 165.1 acres. Phils Creek and its tributaries flow through the site, which is a tributary of Morgan Creek in the Cape Fear River basin. A previous expansion involved the relocation of a tributary stream of Phils Creek, and the applicant has indicated that. this relocation has been completed, the slope has been stabilized, and the tree plantings along the bank have been completed. Therc are records for the presence of the federal species of concern and stale endangered Savannah lilliput (Ta olosnra pullus) downstream in Morgan Creek; therefore; protecting water quality is essential and proper erosionand sediment control should be strictly adhered to. The applicant indicated that a minimum 5040ot buffer would be maintained for jurisdictional drainages an the site. We recommend that the following conditions be incorporated into the permit to reduce impacts to fish and wildlife resources. I . In order to reduce stream impacts, while retaining some measure of wildlife habitat, we recommend it 100-foot undisturbed, native. forested buffer along perennial streams, and a 50-foot buffer along intermittent streams and wetlands for the present operation and any future expansions. Adequate riparian habitat and watershed protection is essential to the continued survival of rare aquatic species. Maintaining undisturbed, forested buffers along these areas will reduce impacts to fish and wildlife resources; water quality, aquatic habitat both within and downstream of the project area, and help prevent the extirpation of endangered and threatened species. In addition, these buffers will provide an adequate travel comdot for wildlife species. Plan Modification The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit and any approved revisions to it. Approval to implement such changes must be obtained from the Department prior to on -site implementation of the revisions. 12. Refuse Disposal A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. Permit No. 68-02 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject permit modification request. An on -site investigation was conducted on 12 May 1998 to further evaluate the potential for adverse impacts on fish and wildlife resources. Our comments are provided in accordance with provisions of the Mining Act of 1971 (as amended, 1982)(G.S. 74-76 through 74-68 15 NCAC 5). The applicant is requesting a modification of its current mining permit to mine granite. The total permitted acreage is 118 acres, and the modification involves 58.1 acres: I 1 acres within the previously permitted boundary and an additional 47.1 acres, of which 30.1 acres will be disturbed. Phils Creek and its tributaries flow through the site. A previous expansion involved the relocation of a tributary stream of Phils Creek. Phils Creek is a tributaryof Morgan Creek in the Cape Fear River basin. There are records for the presence of the federal species of concern and slate endangered Savannah lilliput (Tosolasnia pulJus). downstream in Morgan Creek; therefore; protecting water quality is essential and proper erosion and sediment control should be strictly adhered to. We recommend that the following conditions be incorporated into the permit to reduce impacts to fish and wildlife resources, 1n order to reduce stream impacts, while retaining some measure of wildlife habitat. we recommend a 100-foot undistii il, native, forested buffer along perennial streams, and a 50-foot buffer along intermittent streams and wetlands for the present operation and any future expansions. Adequate riparian habitat and watershed protection isessential to the continued survival of rare aquatic species. Maintaining undisturhed. forested buffcrs along these areas will reduce impacts to fish and wildlife resources, water quality, aquatic habitat both within and downstream of the project area, and help prevent the extirpation of endangered and threatened species. Excessive silt and sediment loads can have numerous detrimental effects on aquatic resources including destruction of spawning habitat, suffocation of eggs, and clogging of gills of aquatic species. Permit No. 68-02 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject permit modification request. Anon -site investigation was conducted on 12 May 199S to further evaluate the potential for adverse impacts on fish and wildlife resources. Our comments are provided in accordance with provisions of the Mining Act of 1971 (as mnended, 1982)(G.S. 74-76 through 74-68 15 NCAC 5). The applicant is requesting a modification of its current mining permit to mine granite. The total permitted acreage is l 18 acres, and the modification involves 4.6 acres. Phils Crock and its tributaries Bow through the site. A previous expansion involved the relocation of a tributary stream of Phls Creek. Puts Creek is a tributary of Morgan Creek in the Cape Fear River basin. There are records for the presence of the federal species of concern and state threatened Savannah lilliput (Toxolasma pullus) downstream in Morgan Creek; therefore; protecting water quality is essential and proper erosion and sediment control should he strictly adhered to. We recommend that the following conditions be incorporated into the permit to reduce impacts to fish mid wildlife resources. l . In order to reduce stream impacts, while retaining some measure of wildlife habitat, we recommend a 100-foot undisturbed, native, forested buffer along perennial streams, and a 50-foot buffer along intermittent streams and wetlands for the present operation and tiny future expansions. Adequate riparian habitat and watershed protection is essential to the continued survival of rare aquatic species. Maintaining undisturbed, forested buffers along these areas will reduce impacts to fish and wildlife resources, water quality, aquatic habitat both within and downstream of the project area, and help prevent the extirpation of endangered and threatened species. In addition, these buffers will provide an adequate travel corridor for wildlife species. Whereas, a grassed buffer, particularly fescue, is a vegetated buffer but will not provide the necessary and highly valuable functions as discussed for forested buffers.
