Dear Mr. Miller: Enclosed are an original and five (5) copies of an application to modify PCS Phosphate Company, Inc. Mine Permit 07-01 to incorporate the initial mine move south of NC Hwy 33 (S33), the boundary of which was approved through the 2001-2009 Environmental Impact Statement process. Each contains the application form, a series of maps and drawings, and 13 attachments. Attachment 1 contains the erosion and sediment control plan for the land included in this modification. The "Notice" form and maps have been sent certified mail to the Beaufort County Manager and landowners receiving tax bills on all adjacent property of the permit modification boundary. The landowner parcel map and list of names and addresses are included with the original of this application package only, for your use. The certified mail green signature cards will be sent to you when they are received back to us. Also enclosed is a check in the amount of $1,000 for the permit modification fee. A total of 1,232 acres is requested to be added to the permit. There are no changes proposed in the operation of the mine. General Statute 74-51 lists seven criteria for permit denial, and they are addressed below: 1. No requirement of Article 74 or rule promulgated under it will be violated by the operation. 2. The operation will not have unduly adverse effects on potable groundwater supplies, wildlife, or fresh water, estuarine or marine fisheries. PCS Phosphate went through a 9- year Environmental Impact Statement process from 2001 — 2009 that analyzed these concerns in depth utilizing an interagency review team, and no unduly adverse effects were documented. 3. The operation will not violate any standards of air quality, surface water quality or groundwater quality, as the company has valid permits addressing these three environmental areas (copies of permit cover pages are found in the attachments to the application). � � 4. There have been no direct and substantial physical hazards to public 615 sa ety, a neighboring structure or public road in the over 50 years of mining at this �e3 1021 5. PCs Phosphate Company, Inc. remains the legal operating entity and permittee. r 6. There has been no history of substantial deposits of sediment in stream beds or lakes, landslides or acid water pollution at this site. 7. PCS Phosphate has been in substantial compliance with Article 74 of the General Statutes, rules adopted under that Article, and other State environmental laws or rules.
