Pursuant to 15A NCAC 05B .0113 — Response Deadline to Department's Request(s), Carolina Sunrock
LLC hereby requests that a one-year extension be granted by Mr. Brian Wrenn, Director, Division of
Energy, Mineral, and Land Resources so that we may fully respond to the remaining item listed in your
January 15, 2021 request for additional information. We also request that this one-year extension begin
on March 17, 2021 before the original 180-day response period expires.
The justification for this extension is that Carolina Sunrock has been diligently working with its air quality
consultants and legal team to address the Division of Air Quality's (DAQ) concerns related to our air
quality permit application that was denied on August 24, 2020. While we appear to have resolved DAQ's
concerns with our air quality modeling and other technical aspects of our air quality permit application, we
are still in ongoing legal discussions on the appropriate avenue to proceed with the air quality permit
application review process. Regardless of the path forward, we believe it will result in a DAQ resolution of
all the concerns raised in your January 15th request.
We will continue to keep you apprised of our progress in this matter. Once the air quality permit
application is under review, we will provide you documentation of such so that you may proceed with the
issuance of our mining permit conditional on our obtaining our air quality permit from DAQ.
