Harris Mining Program Secretary Land Quality Section SUBJECT: Mining Permit Application for Tim Morton Trucking, LLC Scott Farm Road Mine Jones County Please find attached for your review a copy of the mining permit application request for the above referenced project. Please review this information and advise as to the probability of this operation having unduly adverse effect on wildlife and freshwater fisheries (G.S. 74-51 (2)). Please respond by February 3, 2021 so that we may complete our review of this request within our statutory time limits. As is the case in our review of all mining permit applications, renewals and modifications, this office will carefully review all proposed erosion and sediment control measures to ensure that they are sufficient to restrain erosion and off -site sedimentation. However, any comments your agency can provide regarding effects on wildlife and freshwater fisheries would be greatly appreciated. If your staff wishes to perform a site inspection, it is recommended that they contact the person submitting this request to set up a convenient date and time. Also, please send a copy of your comments to the person noted in the application. Your continued cooperation is greatly appreciated. Dunn, Coastal Coordinator Habitat Conservation Division DATE: January 28, 2021 SUBJECT; Mining Permit Modification for Tim Morton Trucking, LLC, Scott Farm Road Mine, Jones County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed this permit application with regard to impacts of the mine on fish and wildlife resources_ Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.0 661-667d), Section 401(b) of the Clean Water Act of 1977 (as amended), and the North Carolina Mining Act of 1971 (as amended, 1982; G.S. 74-76 et. seq., 15 NCAC 5). The applicant is requesting a new mine permit to mine sand and fill dirt from a leased 32.3 acre area to a depth of-35'. No discharges into state waters are proposed. The mine site is located off Scott Farm Road near Pollocksville, NC. The NCWRC has reviewed the application and has minimal concern with the mine's direct impacts to wildlife resources. In addition, the permittee may consult with a professional wildlife biologist with the NCWRC to enhance post -project wildlife habitat at the site.
