REGAN Secretary BRIAN WRENN Director Certified Mail Return Receipt Requested 7019 1120 0000 5072 4434 Mr. Scott Martino Carolina Sunrock LLC 200 Horizon Drive, Suite 100 Raleigh, North Carolina 27615 NORTH CAROLINA Environmental Quality January 15, 2021 RE: Proposed Prospect Hill and Distribution Center Caswell County Roanoke River Basin Dear Mr. Martino: We have reviewed the application your company submitted for the referenced mine site and supplemental information dated September 04, 2019, October 02, 2019, May 11, 2020, June 01, 2020, August 19, 2020, October 21, 2020, and December 21, 2020. However, to date, this office has not received all of the information requested in the letter dated September 16, 2020. As required by 15A NCAC 5B.0013, you are advised that you have 180 days from the date of your receipt of that letter to submit all of the requested information. The above referenced letter was signed for on September 21, 2020. Therefore, your deadline to submit all of the requested information is March 20, 2021. In order for this office to complete its review of the referenced project in accordance with G.S. §74-50 and §74-51 of the Mining Act of 1971, please provide the additional or revised information in accordance with the following comments: In accordance with GS §74-51(d3), the Department may deny a permit upon finding: "That the operation will violate standards of air quality, surface water quality or groundwater quality that have been promulgated by the Department. " Please provide information on how the potential adverse effects to air quality referenced in the Division of Air Quality's permit denial dated August 24, 2020 will be mitigated, such as a subsequently approved air permit, or a statement from the Division of Air Quality stating that an Air Permit is not required. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If an extension of time is not granted or you do not respond to our request by the March 20, 2021 deadline, a decision will be made to grant or deny the mining permit based upon the information currently in the Departments files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response, we encourage you to provide the additional information requested by this letter as soon as possible.
