Ross Jr., Secretary We have reviewed the modification request and additional information your company submitted for the above referenced mine site. However, the following information is needed to continue processing your application: The comments stated in the US Fish and Wildlife letter dated May 8, 2002 have not been addressed. Please find enclosed another copy of their comments. The site must be surveyed for the listed species. Upon completion of the survey, please submit to my attention. 2. Please provide proof, such as the signed returned receipt from certified mail, that Mr. David P. Sprinkle has been notified of your modification request. Please find enclosed a notice form for your use. The reclamation bond has been calculated using the information submitted in the application. The reclamation bond total for this site is $59,000.00. The calculation worksheet is enclosed for your review and the new bond or balance ($500.00) will be required prior to approval of this modification request. For your convenience, I have enclosed a bond form, an assignment of a savings account form and irrevocable standby letter of credit form for your use in securing the required bond. Hill, Jr. On June 17, 2002, Mr. Hill and I met with Doug Miller of the Mooresville Regional Office and several other representatives of Land Quality to discuss the issues noted in your letter and Doug Millers comments as they related to work on site. After working to include revisions and modifications as recommended, I visited with Doug Miller on August 23, 2002 for a review of the work completed. Sheet No. 1 is sort of a compilation of the properties involve as well as the detail sheets 2 and 3. Revisions to sheet 1 are: Show all adjoining property owners. 2. Delineate the area to be disturbed (affected area) for easier recognition. Clarified buffer zones and included a screening buffer around the proposed rock stock pile. 4. Moved temporary boundary to provide more space for haul road and modified silt basin. 5. Modified silt basin No. 1 for 70% sediment removal. Other modifications or revisions include - - Calculations based on 25 year stoma. - Evidence of notification of County Manager. - Completion of sheet 5 from the permit booklet.
