Our office has completed its review of North American Emerald Mines, Inc.'s blasting
information, including blast reports and seismograph recordings, related to the blasts
conducted at its North American Emerald Mine during the period of December 5 through 16,
2003 and September 16, 2004. It was found that North American Emerald Mines, Inc. was in
compliance with the blasting requirements of its mining permit during the period in question.
All peak particle velocities, a measurement of ground vibration with units in inches per
second (ips), were well below the maximum allowable limits specified in North American
Emerald Mines, Inc.'s mining permit. More specifically, all recorded values were at or below
.04 ips at the closest offsite occupied structure (the location where compliance with the permit
limits is determined). According to extensive research by the U.S. Bureau of Mines and
others, particle velocities below 0.5 ips effectively eliminate the possibility of any structural
damage.
All airblast readings, a measurement of the atmosptWc pressure wave (overpressure)
with units in psi or dBL, were also below the maximum allowable limits specified in the mining
permit and well below the U. S. Bureau of Mines' recognized level of 164 dBL for prevention of
glass breakage. A key point worth noting is that glass breakage occurs at much lower levels
of overpressure than structural damage, such as cracking plaster.

We did note that some readings were slightly elevated. While these readings were

company's attention and have recommended that it review its blasting procedures to
determine what adjustments can be made, if any, to reduce the potential for future complaints.

I got a call from Dorothy Watikins of Hiddenite Gems, Inc. (02-04)
on 9/14 complaining about a mine blast from a nearby permitted gem
mine (02-06 North American Emerald Mine?). The specific blast date
was 9/10/04 about 11:30. She said the blast damaged one of her
structures and startled the school children at the mine. Please
conduct routine blast investigation for this. She also asked if
anything could be done about timing the blasts when the school
groups were not there, or at least giving her notice so she could
alert the school groups so they wouldn't be so startled. Perhaps,
we could ask the blaster to voluntary give notice of blasting to
Ms. Watkins, particularly when he is reportedly not in competition
for visitation of the school groups.

It is interesting to note both Ms. Watkins and Mr. Walker "complained" about noise
activity on days that we did not conduct blasts.

This office recently received an additional complaint directed at blasting practices
conducted at the above referenced quarry. According to the complainant, Ms. Dorothy
Watkins, the noise and vibration produced from the blasts at your mine site on
December 13, and 16, 2003 were excessive,
As provided In the mining permit for this site, you are requested to provide this
office duplicate copies of all shot records related to the blasts Conducted on December
123 and 16, 2003, including any seismograph recordings made. Furthermore, please
forward all shot information for one production shot conducted immediately prior to and
one production shot after the blasts in question for this offiice's review.

Dear Mr. Hill:
This office recently received an additional complaint directed at blasting practices
conducted at the above referenced quarry. According to the complainant, Ms. Dorothy
Watkins, the noise and vibration produced from the blasts at your mine site on
December 13, and 16, 2003 were excessive.
As provided in the mining permit for this site, you are requested to provide this
office duplicate copies of all shot records related to the blasts conducted on December
123 and 16, 2003, including any seismograph recordings made. Furthermore, please
forward all shot information for one production shot conducted immediately prior to and
one production shot after the blasts in question for this office's review.
It is recommended that you discuss this matter with Ms. Watkins. Her address
