I described to you a document I had prepared, a copy of which is now enclosed for your review. DENR. You told me that my proposed format was not acceptable to You told me that only the format prepared by DENR's counsel was acceptable. I asked you to fax a copy of the DENR form to me, which you did on February 20, 2007. The form is identical to the form which Lynn Hill, the President of my client, heretofore signed and attached to our application for a mining permit dated November 2, 2006. Lynn Hill as President of North American Emerald Mines, Inc., also signed page 1 of the permit application. The form you faxed to me has a line for signature by the _Applicant. The instructions on the form clearly state that the "signature must be the same as the individual who signed page 1 of this Application". It was Lynn Hill who signed page 1 of the Application. Martin dated July 1, 1995). As owners of the aforesaid land, we hereby grant to the North Carolina Department of Environment and Natural Resources, Division of Land Resources, Land Quality Section (hereafter "the Department") or its appointed representatives the right of entry upon and travel over that portion of the northern boundary of the referenced tract upon which lies an abandoned 60' right of way for an old road -bed lying on the common boundary of said tract and a tract immediately joining it to the north which is occupied by North American Emerald Mines, Inc., for the purpose of making necessary field inspections or investigations as may be reasonably required in the administration of the Mining Act of 1971. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the maps along with their corresponding (approximate) acreage. As a reminder, mining permits can only be issued for up to 10 years; thus, all mine and reclamation maps must only denote those activities that are intended to be conducted during the life of the mining permit. All maps must be of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at a minimum: a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located including easements and rights -of -way. b. Existing or proposed permit boundaries. c. Initial and ultimate limits of clearing and grading. d. Outline and width of all buffer zones (both undisturbed and unexcavated). e. Outline and acreage of all pits/excavations. f. Outline and acreage of all stockpile areas. gg Outline and acreage of all temporary and/or permanent overburden disposal areas. h. A buffer will be required between any Mining activity and any mining permit boundary or right-of- way. It may be an unexcavated 'buffer (no excavation, but roadways, berms and erosion & sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note that all buffers must be located within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site? Without contours, it is difficult to determine if diversion ditche§�':/ are needed to divert flow into the proposed silt basin at the rock processing yard. *3.)* It is still too difficult to determine the exact location of the haul road leading along the eastern and southern perimeters of tl�e site to the pump station turnaround. These comments are provided in accordance with certain provisions of the Mining Act of 1971 (as amended, 1982; G.S. 74-46 through 74-68; 15 NCAC 5) and the North Carolina General Statutes (G.S. 113-131 et seq.). The modification requested affects land within the existing permitted mine site. The modification will increase the rock storage and processing lot by approximately five (5) acres. Since these activities are within the existing permitted mine operation, we will not object to the modification as indicated. We request that existing permit conditions continue to be enforced and that autochthonous plants be utilized for revegetation and reclamation. Woody debris (slash or large trees) removed during clearing and development of the site should be placed along the outer construction limits in the form of brush piles and downed logs to provide cover and nesting habitat for wildlife. Professional wildlife biologists with this agency should be involved in final reclamation planning to provide optimal wildlife benefits. We discussed the mining activities currently taking place at the referenced site and the activities that maybe proposed in the future. As indicated in my previous letter dated July 6, 2006, and based on the July 19, 2006 field inspection, the following additional information is needed to continue processing your modification application: 1. A revised mine map is required. The revised mine map must clearly show the permit boundary and the affected area boundary, along with the haul road to its junction with a state -maintained road. 2. The sediment basin proposed in the June 2006 modification application is already installed, but was done so prior to approval by the Department. Please see the attached inspection report for further instructions on additional erosion and sedimentation control measures required in this area. An approved modified permit is required prior to any additional land disturbing activities at this site. Said area is located between the Phase I Mining and the proposed truck turn around area, as indicated on the mine map last revised June 6, 2006, and submitted by Mr. R. Carroll Williams. This area is on the same tract of land as the current mine, is contiguous to the excavation area and needs to be included into the total affected acreage at the site. Please submit revised applications and mine maps with the proper associated fee based on the change in affected acreage. All associated erosion and sedimentation control measures must be included in on the revised mine map with appropriate engineering calculations and supporting details. 4. Upon calculating all the proposed affected acreage and current affected acreage at the site, please completely fill out Page 5 of the application (attached). I cannot calculate the appropriate bond amount without this information. Please be advised that our review cannot be completed until all of the items listed above have been fully addressed. In addition, please note the Land Quality Section may request additional information, not included in this letter, as the mining application review progresses. These comments are provided in accordance with certain provisions of the Mining Act of 1971 (as amended, 1982; G.S. 74-46 through 74-68; 15 NCAC 5) and the North Carolina General Statutes (G.S. 113-131 et seq.). The mine application indicates that shovel and truck operations are used to remove emeralds, quartz and amethyst. Unspecified modifications appear to be proposed within the currently permitted area of the mine. Based on our review of the data for the general area, we are not aware of any reason to object to modifications within the existing mining area providing that appropriate Corps of Engineers 404 Permits and NC Division of Water Quality 401 Certifications are acquired pursuant to Clean Water Act requirements. We recommend that any woody debris (slash or large trees) removed during land clearing be placed along the outer berm construction limits in the form of brush piles and downed logs to provide cover and nesting habitat for wildlife. Autochthonous (native) plants should be used for stabilization and reclamation activities. Final reclamation plans should be approved by professional biologists with the North Carolina Wildlife Resources Commission. C . 27699-1612 Application for Modification to Permit Permit No. 02-06 North American Emerald Mines Alexander County Yadkin River Basin Dear Ms .Hicklin: I appreciate your taking time to discuss our situation at the Emerald Mines in Alexander County, and I apologize for not giving you anything to help understand what we wanted to do. Basically we have two items to modify in the plan. The first is a truck turn -around near the creek and is really a matter of safety. For dust control at the mining site and along the haul road the people pump water from a creek along the western border of the property. The road down to the creek is about one -quarter of a mile, one lane wide ( 8'-10') and about a 12 percent grade. Presently the driver has to back down the road ,load the water and drive out. With the turn around, the driver will always be traveling forward, seeing anything that may be a problem. See No 1 on the accompanying plan sheet. The second item is to push the silt basin on the rock storage yard about 60-65 feet to the east, but still remaining within the 5 acres designated as the rock storage yard. This would give the mine about a year's space to waste or stock pile over -burden dirt from the reining area and space for more rock. This is work that could be done in a few days. While the owners of the NAEM own the adjacent property, a 10' buffer wil be maintained. See No. 2 on the attached plan sheet.
