We are in the midst of re -drafting the permit map in order to provide you with the information
requested. An aerial photo fly over was conducted on March 18; however, due to unexpected
heavy workloads on their part, we don't expect to receive the topo map from the surveying
company until early next month. Once it's in hand, we'll need time to resurvey and plot land
boundaries, settling ponds, affected areas, etc. We respectively request an extension of no less
than 3 months to allow time to properly complete the permit map. We feel very confident that
once completed, the permit map will suffice for all your office requires.

Dear Mr. Simons,
In November of last year the above client requested a 6 month txrension to respond to a request
for information from your office concerning the renewal application for Mine Permit No. 02-06.
At that time a 3 month extension was granted to allow time to get proper mapping and other
items together for the information submittal.
As a result of several circumstances we are unable to properly respond to your information
request at this time due to lack of a good map. The flyover for the new map was done on Friday
March 18, 2011 and we will have the new map in hand by mid -April. This will allow us to create
a new map that clearly shows all the mining limits, affected areas, features and other disturbance
limits. We will also be able to properly sized all controls and give your office the items you need
to approve the permit renewal. We respectively request an extension of no less 3 months to
allow time to properly address this situation.

We have reviewed the renewal request your company submitted for the referenced
mine site. However, the following information is needed to continue processing your
application:
Although Page 1 has been corrected, we need the originally signed copy. Please
provide the original. I am enclosing a new page 1 if the original cannot be found.
2. The revised mine map is still not sufficient. Clearly show the entire 94.6 acre
permit boundary. Show the spillways and outlets of the sediment basins.
3. Show the proper location of the basin. A field inspection revealed it is 45 feet
from the creek but is shown on the plan 100 feet from the creek. Provide details
for the washed stone on the rock filter.
Provide a diversion to the basins, design calculations, including settling
efficiency, for any new measures that have not been previously.
Please be advised that our review cannot be completed until all of the items listed
above have been fully addressed. In addition, please note the Land Quality Section may
request additional information, not included in this letter, as the mining application review
progresses.

The permittee (applicant) and name on the reclamation bond must be the same.
The current permit has been issued to North American Emerald Mines, Inc. If
you wish to retain the same permittee, complete a revised page 1 that has North
American Emerald Mines, Inc as the name of the applicant (line 2). If you with to
change the permittee to James King Hill Jr., please request this in writing and
submit a $100.00 transfer fee.
2. A comprehensive detailed and properly scaled mine map must be submitted.
Currently your company has 94.5 acres permitted and is allowed to affect 22.96
acres of the permitted 94.5 acres. Clearly show on the mine map the 94.5 acre
permit boundary and the 22.96 acre affected acreage boundary. In addition
clearly show all the existing features on the mine map. Show the processing
area, stockpile areas, waste pile areas, current mine excavation limits, 10 year
mine excavation limits, roadways and any other features. Show all existing
erosion and sediment control measures, including properly scaled dimensions,
locations, spillways and outlets.

3. Clearly show and properly label the 100 foot undisturbed buffers along any
wetlands and waterway currently required by the permit. Clearly show and
properly label all 50 foot undisturbed buffers along the adjoining properties
currently required by the permit.
4. As the mine map submitted with the renewal request bears no resemblance to
the current approved mine maps, it appears you may be requesting to modify the
current permit. A written request to modify must be submitted with the proper
modification fee that is based on the acreage change. All proposed erosion and
sediment control measures must be shown to scale and you must include
supporting calculations. Basins must be designed to pass a 25 year 24 hour
storm event, to have 1800 cubic feet of sediment storage, and to have 70%
settling efficiency.
5. Add temporary diversion ditches on the northwest and southeast side of the silt
basin. Show the actual location of the basin in the southwest corner as it is in the
field.

Please find attached a copy of the mining permit renewal request for the above referenced project.
The North American Emerald Mine located in Alexander County does not appear to have an unduly adverse
effect on ground water supplies since dewatering proposed on site is less than 100,000 gpd (< 10,000).
However, if the mine starts to withdraw 100,000 gpd of water, they will need to register their water
withdrawals.
Facilities not in the fifteen county Central Coastal Plain Capacity Use Area are required to register their water
withdrawals in accordance with the North Carolina General Statute G.S. 143-215.22H. This statue requires any
non-agricultural water user who withdraws 100,000 gallons or more in any one day of ground water or surface
water to register and update withdrawals. This statue also requires transfers of 100,000 gallons or more in any
one day of surface water from one river basin to another river basin to register and update their water transfers.
Water withdrawal registrants must complete the annual water use reporting form by April 1 for the previous
year.

This correspondence responds to your request for our review of the referenced mine permit
renewal. These comments are provided in accordance with certain provisions of the Mining Act
of 1971 (as amended, 1982; G.S. 74-46 through 74-68; 15 NCAC 5) and the North Carolina
General Statutes (G.S. 113-131 et seq.).
The mining operation is requesting renewal of an existing permit without any indicated
modifications. Since the activities proposed are within the existing quarry boundaries, we will
not object to the renewal.
However, we recommend deleting fescue and other non-native plants from the proposed planting
schedule. The following recommendations are routinely provided for your consideration as
appropriate for mining permit conditions:
1. During any new land clearing activities, woody debris (slash or large trees) removed
during development of the site should be placed along the outer stockpile/compost area
construction limits in the form of brush piles and downed logs to provide cover and
nesting habitat for wildlife.
2. Should any stream relocation activities become necessary, relocations should use state-of-
the-art bioengineering techniques. Clean Water Act 404 permits and 401 certifications
must be obtained from the US Army Corps of Engineers and the NC Division of Water
Quality prior to any channel relocation. Native riparian plants should be incorporated into

statutory time limits.
As is the case in our review of all mining permit applications, renewals and
modifications, this office will carefully review all proposed erosion and sediment control
measures to ensure that they are sufficient to restrain erosion and off -site sedimentation.
However, any comments your agency can provide regarding effects on wildlife and
freshwater fisheries would be greatly appreciated. If your staff wishes to perform a site
inspection, it is recommended that they contact the person submitting this request to set
